Summary: All proposed lots were found to have hi�h water tables,
necessitating the use of mound systems. Percolation rates in the
upper soil profile generally were suitable for mound systems,
with slower rates found in deeper test holes. Slopes on th� entire
site are fairly level and suited for mour..� systems.
Tris report will consist of: a) a short review of each lot of the

4. 0 feet. Perc rates are acceptable for the primary site and
slightly slow at the secondary site. (Refer to Lot 5, Block 1)
This lot has the overall worst set of gercolation rates of the
division. 'However, only two of the peres were taken in the
topsoil, the others, two of which were very slow, were at depth.
I recommend that a mound system be used on this site. If peres
were re-taken in the topsoil, ic is likely they would pass as
did nearly all others done in this nanner.

Subject: Buildability Status, 701 Dickey Lake Drive - Lot 1, Block 2, Ringerswood
This lot was created in 1982 as part of the plat of Ringerswood. Prior to subdivision the lot included a
small wetland in the southwest quadrant. That wetland was shown on the preliminaryplat drawings dated
2-4-82 as a 0.5 acre pond within a 2.5 acre lot,leaving 2.0 acres net dry area.The lot designation during
the preliminary plat stage was Lot 2, Block 2, which changed to Lot 1 Block 2 on the final plat.
The City accepted the plat subject to the filing of a Flowage and Conservation(F&C)Easement over
the wetland area, which was to be shown as a"drainage easement"within the lot. The area of said
easement showed up on the plat as a"utility and drainage easement". However,it was intended that the
area be subject to the F&C Easement;if the F&C Easement does not show up in the chain of title
for the lot,then a new such easement should be correctly granted prior to issuance of a building
permit for the property.
In 1987 or 1988 filling and excavating in the pond area occurred on the property without City approvals
and without permits,in violation ofthe F&C Easement.Eventually apermitwas administrativelyissued
to restore the pond and adj acent land to its approximate prior condition,and such restoration grading
occurred. The land has remained undeveloped since that time.
In 2004 the properiy owner and/or others began to pursue confirming the buildability ofthe lot. A wetland
delineation was completed by Svoboda in 2004 which demarcated the existing wetland boundary under
current delineation methods,and a survey was performed to show the boundary on paper. The boundary
may have been reviewed and accepted by the Minnehaha Creek Watershed District(MCWD)but our files
have no paperwork confirming that.Our MCWD maps show an extensive Type 2 wetland mapped within
the site,encompassing approximately 1/3 of the site and extending to within 100'ofthe eastboundary. If
this mapped wetland boundary is accurate,it severely limits buildability of the site. Before a building
permit is issued,written confirmation of MCWD acceptance of the Svoboda wetland delineation
is required.
The dry buildable area of the property is defined by the area not encumbered by the F&C Easement.The
total area of the property is approximately 2.46 acres per Hennepin County Tax Information. The area
of the F&C Easement is approximately 0.66 acre per my calculation. The area of the delineated wetland
is approximately 0.12 acre per my calculation. The dry buildable area of the property exclusive of the F
&C Easement is approximately 1.8 acres. The property is zoned RR-1B which requires a dry buildable
area of 2.00 acres.

Because the City accepted the plat in 1982 under the current 2-acre zoning standards,with an area not
encumbered bythe F&C Easement of less than 2.0 acres,and because the area of the currently delineated
wetland apparently does not exceed the boundaries of the F&C Easement,it is my conclusion that a lot
area variance is not required,pending MC WD confirmation that the delineated wetland boundary is
correct.
Orono is currently under a moratorium on issuing permits for any work within wetlands or within 26'of
wetlands. This moratorium will likely result in new standards for wetland protection in Orono. The
preliminary draft ordinance would require a 16'wetland buffer and a 20'structure setback from the buffer
edge for a wetland of the size delineated by Svoboda. If adopted,that ordinance would result in a 36'
setback requirement from the delineated wetland. Under the prior ordinance,a 26'wetland setback would
be required. The moratorium is scheduled to expire August 23,2005. We hope to have a new ordinance
adopted by that date. Any new construction on this site will be subj ect to the ordinances in effect at the
time of building permit application.
The RR-1 B standards require a 50'front and rear setback,50'side street setback,and 30'side setback
farprincipal buildings. The south lot line abutting Dickey Lake Drive was established as the front lot line
on the preliminary plat drawings.The east boundary ofthe property is a side lot line.If the MCWD accepts
the delineated wetland per Svoboda,it appears there is ample space to construct a single family residence
between the wetland and the east lot line,meeting all required setbacks. One access driveway to Dickey
Lake Drive will be allowed. No access driveway to Willow Drive will be allowed.
The City has no information regarding soil suitability for construction on this lot. It is my understanding that
the City has approved connection to the municipal sewer system for this property, the costs of such
connection to be paid by the property owner per Greg Gappa's memo dated September 27,2004. Water
service will be by private well.
Summary:
1. The lot does not require a lot area variance.
2. Prior to issuance of building permit, owner/applicant must provide evidence that the F &C
Easement over the area defined as"Utility and Drainage Easement"is of record. If not,a new F
&C Easement must be granted and evidence of filing(copy of easement with document number)
must be provided.
3. Before a building permit is issued,written confirmation of MCWD acceptance of the Svoboda
wetland delineation is required.
