A RESOLUTION GRANTING
-PRELIMINARY APPROVAL OF A
SUBDIVISION APPLICATION FOR
DONALD R. KEMPF
FILE NO. 1372
WHEREAS, Donald R. Kempf (hereinafter "the applicant") on January
24, 1989 filed a formal subdivision application with the City for a Class
II Subdivision, plat of two lots of the property legally described as
follows:
The South 199.40' of the Southeast quarter of the Northeast quarter of
Section 07, Township 117, Range 23, Hennepin County, Minnesota, lying
East of County Road 151. Subject to a right-of-way easement over the
East 101, the North 10', and the South 101, (hereinafter "the
property") and;
WHEREAS, after due published and mailed notice in accordance with
Minnesota Statues 462.358 et. seq. and the City of Orono Zoning Code, the
Orono Planning Commission. held a public hearing on February 21, 1989 at

which times all persons desiring to be heard concerning this application
were given the opportunity to speak thereon; and
WHEREAS, at their regular meeting held on March 13, 1989, the
Orono City Council considered the subdivision application of the applicant,
noting the following findings of fact:
1. The property is located within the LR -1B Single Family Lakeshore
Residential Zoning District requiring a minimum of 1 acre of land
within each newly created lot.
2. The property contains a total of approximately 2.5+ acres.
3. The proposed plat contains 2 lots each exceeding the 43,560 s.f.
minimum lot area requirement (Lot 1 = 60,212 s.f.; Lot 2 = 58,325
s.f.) .
4. Access to Lot 1 shall be via an approved curb cut at North Arm
Drive. Lot 2 shall be served via Loma Linda Avenue. Lot 2 has
adequate width along the public roadway providing adequate sighting
distance for the new curb cut.
5. All lots meet the required 140' width adjacent to the road and at
the rear of the front yard setback line.
• 6. A single family residence can be constructed on all proposed lots
without the need for any variances.

7. The property is located within a sewered district and has been
assessed for two units. No additional sewer payments are required by
the applicant.
NOW, THEREFORE BE IT RESOLVED, that based upon one or more of the
findings noted above, the City Council of the City of Orono hereby approves
the preliminary plat application of Donald R. Kempf per plat drawings by
James H. Parker, Registered Land Surveyor No. 9235 of Advance Surveying and
Engineering Company dated November 8, 1988, revised November 12, 1988,
subject to the following conditions:
1. Prior to the issuance of a building permit for new construction on
Lot 2, the final plat must be filed with either the Hennepin County
Recorder's office or the Registrar's Office.
2. FINAL PLAT SUBMITTALS:
The following list of final submittals must be submitted to the Zoning
Administrator two weeks prior to the regularly scheduled Council
• meeting on the second and fourth Mondays of the month:
A. RECORD PLAT drawings in the form of two (2) mylar copies and
one (1) copy reduced to 1"=2001. Drawing to include:
a) Lot lines platted per preliminary survey by Advance
Surveying and Engineering Company, James H. Parker,
Registered Land Surveyor, dated November 8, 1988, revised
November• 12, 1988.
b) Dedication of "drainage and utility easements" as shown
on the above described preliminary survey subject to the
following modifications:
i. Continue 10' wide drainage and utility easement
along the south and east borders of Lot 2 where it has
been omitted.
ii. Designate 30' wide drainage easements within Lot 1
and 2 as shown on attached sketch.
iii. Dedication of right-of-way of Loma Linda and Loma
Linda Avenue as shown on the above referenced
preliminary survey. In addition, the City must ask -for
additional dedication of right-of-way at the northwest
• quadrant of the intersection of Loma Linda Avenue and
Loma Linda, refer to attached sketch.

B. LEGAL DOCUMENTS required:
a) Title opinion addressed to the City. All owners,
mortgage holders or others with property interest indicated
therein shall sign the plat and all other documents affected
by such interest.
b) The applicant must provide certified copies of all
recorded easements currently affecting the property.
c) Signed and executed Drainage Easement over drainage
easements within Lots 1 and 2 (the area shown as the 30'
wide drainageways within Lots 1 and 2). See form attached.
C. FEES TO BE PAID: Total Due $700.00.
a) Park dedication fee per current schedule:
• Lot 2 at $400.00
b) Final plat fee = $150.00.
c) Legal review and filing fees of $150.00.
3. Proposed access drive/curb cut at Loma Linda Avenue to serve Lot 2
to be moved 25' further west to improve sighting distance at driveway
intersection. Applicant to provide a revised site plan upon filing
for a building permit.
4. Existing accessory structure on Lot 2 to be removed at the time of
the issuance of the building permit or by September 1, 1989, whichever
occurs first.
Adopted by the City Council of the City of Orono, Minnesota at a
regular meeting held this 13th clay of March, 1989.
