HomeMy WebLinkAboutResolution 2591City of oRolvo RESOLUTION OF THE CITY COUNCIL NO. 2591 • ' �jJ A RESOLUTION GRANTING ----f VARIANCES TO MUNICIPAL ZONING CODE SECTION 10.25, SUBDIVISION 6 (B), AND SECTION 10.22, SUBDIVISION 2 FILE- NO. 1377 ! WHEREAS, Richard Anderson (hereinafter "the applicant") is owner of the property located at 3980 North Shore Drive within the City of Orono (hereinafter "City") and legally described' as follows: Lot 12, Hickory Hill, Hennepin County, Minnesota (hereinafter "the property"); and WHEREAS, the applicant has applied to the City for a variance to Municipal Zoning Code Section 10.25, Subdivision 6 (B) to permit the construction of additions to an existing residence, which will be located 9.1' from the west lot line and 9.6' from the east lot line, where a 10' side setback is normally required from both side lot lines, and a variance to Section 10.22,. Subdivision 2 to permit additional hardcover in excess of the 25% hardcover normally allowed in the 75-250' lakeshore setback zone. •� NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, Minnesota: 1 FINDINGS 1. This application was reviewed as Zoning File #1377. 2. The property is located in the LR -1C Single Family Lakeshore Residential Zoning District. 3. The Orono Planning Commission reviewed this application on February 21, 1989, and recommended approval of the proposed variances based upon the following findings: A) Granting of the east side setback variance to allow replacement of foundation underneath the existing attached garage will have no additional impact on the neighborhood but will decrease the likelihood of a future hardcover variance application to construct a detached garage at the rear of the property. B) Their is little likelihood of the property to the west being developed with a residence since that property is owned by Hennepin County for highway purposes, hence the west side setback variance has little impact on the neighborhood. �� Page 1 of 4 City of oR,olvo RESOLUTION OF THE CITY COUNCIL NO. 2591 n the 75-250' zone which comprises 6,125 s.f in total area, total hardcover shall not exceed 1,720 s.f. or 28.1%, per the attached site plan. The applicant is advised that any future development of the property requiring additional hardcover will not be approved, but might be approved only in conjunction with concurrent removals of existing hardcover in the 75-250' zone resulting in no net increase in hardcover on the property. 5. Authorities granted by this variance run with the property not with the applicant, but are permissive only and must be exercised by application for a building permit within one year of the date of Council approval, or this variance will expire on that date (March 13, 1990). 6. Violation of or non-compliance with any of the terms and conditions of this variance shall constitute a violation of the zoning code, shall automatically terminate any authority granted herein, and shall be punishable as a misdemeanor. 7. The undersigned applicant has read, understood and hereby agrees • to the terms of this resolution and on behalf of himself, his heirs, successors and assigns, hereby agrees to the recording of this resolution in the chain of title of the property.
