Re: Deck Construction/Without Building Permit
Dear Mr. Anderson:
It has come to the attention of this department that a deck has been
constructed on your property. This letter is to inform you that a
building permit is required for deck construction in the City of
Orono. Please provide the enclosed permit application and the
required submittals before April l, 1992. If you have any questions
or if you have a problem meeting this deadline, please feel free to

Re : Deck Construction Witl�out Building Permit
Dear Mr. 1lnderson:
On March 18 , 1992 this office notified you of the requirement for a
building permit £or the deck that has been constructed on your
property. I spoke to Nancy on the pl�one about the requirement for a
survey of the property to process your building permit application.
She indicated that it was a financial hardship and I gave her the
option of having a surveyor verify that the deck meets property line
setbacks. As of tliis date, this situation remains unresolved.
ThereLore, the City must require you to remove the deck or submit a
permit application, deck plans and a survey or setback confirmation
before August 3 , 1992. If this deadline is not met, the City will
issue citations and refer the matter to the City Attorney for further
legal action. If you have any questions, feel free to contact me at

RE: Deck Construction
Dear Mr. and Mrs. Anderson:
I am in receipt of your deck plans and site plan. The deck plan
is complete and the deck seems to meet all code requirements.
However, I am sorry to say that your site plan will not suffice
for a survey. Orono City Council has decided to require surveys
for all construction projects when a new structure is erected or
an existing structure is enlarged. The only exception is
detached accessory buildings under certain conditions. Their
decision was based on problems experienced when the rules were
more lax. Property lines are not always where homeowners believe
them to be and unknown easements often disected proposed
projects.
Therefore, the City must require a survey by a State licensed
surveyor. Since this is an after-the-fact application, the City
must require you to remove the deck or provide a survey and a
permit application before August 19, 1992. If this deadline is
not met, the City may issue citations.

Re: Deck Construction without Building Permit
Dear Mr. Anderson:
The City of Orono has provided ample time for you to submit a survey required to complete the
after-the-fact building and zoning review of the permit application you submitted for the deck
constructed on your property.
Your failure to submit the survey or verification of setbacks by a surveyor leaves the City no
alternative but to initiate legal proceedings. Action will be withheld until April 30, 1993. If
you have failed to comply by that date, the City will issue citations and refer the matter to the
City Attorney for further legal action. If you have any questions, feel free to contact me at my
office.
