Dear Mr. and Mrs. Childs:
I am writing in regards to your above addressed property, tax parcel number03-
117-23-22-0017. This Office first notified you aboLrt your failing septic system in
2002. A letter was sent to you on August 25, 2003 requiring that the septic
system be replaced by November 1, 2003. You did not update the septic system
as required. This system is considered an imminent public health threat and is a
violation of City Ordinance 199, Section 12.3, Subdivision 8, part 4, subpart c.
You were next notified of the need to update the septic system on July 7, 2004
with the requirement of having it updated by the summer of 2005. It is now the
summer of 2005 and I have not received a septic system design for the upgrade of
the system. Since you were first notified of the problem in 2002, I expect that you
have contacted a site evaluator/designer to prepare a plan. I need this plan
submitted to this Office for review by August l, 2005. Once the plan has been
reviewed by the City, usually one to two days, you can then have your installer
apply for the septic permit and work can commence.
If I do not receive the septic system design by August 1, 2005, I will consider that
as a sign of un-cooperativeness. I will then be forced to turn this matter over to
our City Attorney, to initiate misdemeanor charges. I sincerely hope that it does
not come down to involving the Attorney's Office to achieve compliance. Please

Dear Mr. Gibbs:
1 wish to acknowledge receipt of your letter of June 30 on this subject,and to assure yuu that I
have taken,am taking, and shall take,remedial actions necessary.
When your notice was received,we acted on the matter by purchasing an oxygen injection
system to improve the chemical function of the mound system. This pumping unit failed over
the past winter, and has now been replaced. We shall test further to determine the full
efficacy of this system and present evidence as a part of an overall remediation plan. While
we desire to avoid the major capital expense of a new mound if at all possible,we respect the
need to bring the system in full compliance and will do what is needed to achieve that end.

Dear Childs:
This letter is regarding the failing septic system on your property. Last summer I completed an
inspection and it revealed that }�our mound was starting to 7Jse`�ee on the ground. I said that we
will need to continue to monitor this to see if it needs to be replaced. I completed another
inspection last week and it was still surfacing. Due to the dry year and the mound is still not
working properly I am requiring that you replace your mound septic system. It is a health risk to
���, and yo>>r nPighbors. State law requires it to be repla:,,:u �,�.�itl:in 90 days. Due to the dry
summer I feel like you should be able to replace the mound this fall. Please replace the mound
septic system by November 1, 2003.
If you cannot get the mound replaced by November 1, 2003 than you will have to use the septic
tanks as holding tanks all winter and have them pumped out when they become full. You�vill
then have to replace the mound as soon as possible next spring.

An inspection of your septic system was conducted on July 10, 2000. A summary of the inspection
is below.
Se�tic Tank Condition
1. Pumpout needed within one month. (Last pump out 9/9/96)
The septic system is a compliant septic system which means it meets all current City and State
Standards. The drainfield is slightly saturated meaning there are "�vet spots" over the drainfield. No
repair is needed regarding the system at this time. There are two possible reasons for the saturated
drainfield. There may be leaky fixtures in the home or there may be more water being used than the
system was designed for. Check all fixtures for leaking and try to reduce the amount of water being
used on a daily basis.
Enclosed is a list of state licensed septic contractors who work in Orono on a regular basis. Also
enclosed is a fact sheet explaining how a septic system works and an as-built drawing that shows the
approximate location of the septic system. The septic system will be inspected again next summer
to check and see that the mound system is functioning properly.

COMMENTS: In order to confirm that your septic system meets Minnesota standards, soil borings
