City of Orono. Please feel free to contact me with any questions.
Jon and Brad: Please note that per the conditions of permit#15-031, MCWD requires an updated site plan to be
submitted depicting the approved wetland boundary,the 25' wetland buffer(as Brad and I discussed a couple of weeks
ago), and the wetland buffer monuments. Please make sure to include a label indicating the buffer width and a legend
for your wetland buffer monument symbol. Once we receive an updated plan, I will connect you with our Permitting
Clerk Theresa Zerby, who can provide you with instructions for the buffer declaration.

Gonyea Homes & Remodeling (Jon Connolly) applied for wetland boundary & type
confirmation for the wetlands located at 790 Brown Road North in the City of Orono,
Hennepin County, Minnesota (PID 34-118-23-11-0003). Legal description: NE '/ of the NE
'/ Section 34, Township 118 North, Range 23 West. The boundary &type determination was
requested in conjunction with MCWD permitting of new single family home construction on
site.
A wetland delineation was conducted by Kjolhaug Environmental Services Company on May
20, 2015. A complete delineation report and WCA application were submitted to MCWD on
6/26/2015. One wetland was delineated on site. Wetland 1 was identified as a Type 1/3,
floodplain forest/ shallow marsh. One upland island, associated with an uprooted tree, and
one upland peninsula, associated with raised topography, were identified within the general
wetland boundaries. The eastern side of the subject parcel slopes into Long Lake, a DNR
Public Water.
MCWD reviewed the boundaries in the field on 8/4/15. MCWD was in agreement with the boundaries
of the wetlands on site and the Type 1/3 classification. The upland island and upland peninsula were
further inspected far wetland characteristics and determined to be nonwetland due to a lack of

sufficient hydrology indicators.
MCWD approves the wetland boundaries and types as delineated in the field and documented in the
delineation report. This decision is valid for five years. The current MCWD permit for this project
requires wetland buffers to be recorded to the property, as previously communicated to the applicant.
A future project located on this property may require an additional permit from the MCWD.
For Replacement Plans using credits from the State Wetland Bank:

Replacement Plan Approval Conditions. In addition to any conditions specified by the LGU, the
approval of a Wetland Replacement Plan is conditional upon the following:
❑ Financial Assurance: Forproject-specific replacement that is not in-advance, a financial assurance
specified by the LGU must be submitted to the LGU in accardance with MN Rule 8420.0522, Subp. 9
(List amount and type in LGU Findings).
❑ Deed Recording: For project-specific replacement,evidence must be provided to the LGU that the
BWSR "Declaration of Restrictions and Covenants" and "Consent to Replacement Wetland" forms
have been filed with the county recorder's office ii� which the replacement wetland is located.
❑ Credit WithdrawaL• For replacement consisting of wetland bank credits, confirmation that BWSR
has withdrawn the credits from the state wetland bank as specified in the approved replacement plan.
Wetlands may not be impacted until all applicable conditions have been met!

Additional approvals ar permits from local, state, and federal agencies may be required. Check with all
appropriate authorities before commencing wark in ar near wetlands.
Applicants proceed at their own risk if work authorized by this decision is started before the time period
for appeal (30 days) has expired. If this decision is reversed or revised under appeal, the applicant may be
responsible for restoring or replacing all wetland impacts.
This decision is valid for three years from the date of decision unless a longer period is advised by the TEP
and specified in this notice of decision.

WETLAND DELINEATION SUMMARY
• The 1.94-acre property at 790 Brown Road North in Orono was inspected on May 20,
2015 for the presence and extent of wetland.
• The National Wetlands Inventory (NWI) showed areas of PEM1A/PEM1C wetland and
L2UBH deepwater habitat in the northeast portion of the site and immediately east of the
property, respectively.
• The soil survey showed Glencoe loam and Muskego muck as the hydric soil types present

I. INTRODUCTION
The approximately 1.94-acre property at 790 Brown Road North in Orono was inspected on May
20, 2015 far the presence and extent of wetland. The property was located in the NE '/ of the
NE '/ of Section 34, Township 118 North, Range 23 West, City of Orono, Hennepin County,
Minnesota. The property is located between the eastern cul-de-sac of Brown Road North and the
northwestern shore of Long Lake (Figure 1). The site limits correspond to Hennepin County
PID 34-118-23-11-0003.
The review area consisted of a wooded residential lot. A home was under construction at the
time of the site visit. The property sloped to the northeast toward Long Lake and elevations
ranged from 990 at the building site near the cul-de-sac to 946 in the wetland that adjoined Long
Lake.
One Type 1 L/3 (PFO1 B/PEM 1 C) wetland was identified and delineated on the property(Figure
2). The upland portion of the site was dominated by sugar maple forest. The forested portion of
the wetland consisted of boxelder/silver maple woodland and the marsh adjoining Long Lake
was dominated by cattails. The site is bordered on the south, west, and northwest by large
residential lots, and on the northeast and east by cattail inarsh and Long Lake.
II. METHODS
Wetlands were identified using Routine Determination methodology described in the Corps of
Engineers Wetland Delineation Manual (Waterways Experiment Station, 1987) and Regional
Supplement to the Corps of Engineers Wetland Delineation Manual: Midwest Region (Version
2.0) as required under Section 404 of the Clean Water Act and the Minnesota Wetland
Conservation Act.
Wetland boundaries were identified as the upper-most extent of wetland that met criteria for
hydric soils, hydrophytic vegetation, and wetland hydrology. Wetland-upland boundaries were
marked with pin flags and were located by Sathre-Bergquist, Inc.
Soils, vegetation, and hydrolo�y were docuinented at representative locations along the wetland-
upland boundary. Plant species dominance was estimated based on the percent aerial or basal
coverage visually estimated within a 30-foot radius for trees and vines, a 15-foot radius for the
shrub layer, and a 5-foot radius for the herbaceous layer within the community type sampled.

Soils were characterized to a minimum depth of 18-24 inches (unless otherwise noted) utilizing
Munsell Soil Color Charts and standard soil texturing methodology. Hydric soil indicators used
in reporting are from Field Indicators of Hydric Soils in the United States (USDA Natural
Resources Conservation Service in cooperation with the National Technical Committee for
Hydric Soils, Version 7, 2010).
Plants were identified using standard regional plant keys. Taxonoiny and indicator status of plant
species was taken from the 2014 National Wetland Plant List (U.S. Army Corps of Engineers
2014. National Wetland Plant List, version 3.2, https://wetland�lants.usace.anny.mil Engineer
Research and Development Center, Cold Regions Research and Engineering Laboratory,
Hanover, NH).
III. RESULTS
Review of NWI, Soils, and DNR Information
The Natioiaal Wetlands Invento�y (NWI) (Minnesota Geospatial Commons 2009-2014,
https://�isdata.mn.gov/dataset/water-nat-wetlands-inv-2009-2014) showed areas of
PEM 1 A/PEM 1 C wetland and L2UBH deepwater habitat in the northeast portion of the site and
immediately east of the property, respectively (Figure 3).
The Soil Su��vey of Hennepin County, Mi�znesota showed hydric and predominantly non-hydric
soils inapped within the review area (l�ttp://soils.usda.gov/survey/�eo�raphy/ssurgo/). Glencoe
loain and Muskego muck are hydric soils mapped in the wetland location on the eastern part of
the site, and Lester loain is mapped in the western upland part of the site. A soils map indicating
the soil and hydric soil categories on the property is included in Figure 4.
The Minnesota DNR Public Waters Iiiventory for Hennepin County
(https://�isdata.mn.gov/dataset/water-mn-public-waters) showed Long Lake (DNR Pubic Water
27-160P) located at the eastern edge of the site (Figure 5).
The National Hydrography Dataset (U.S. Geological Survey, htt�://nhd.us�s.gov/) also
showed Long Lake at the eastern edge of the site (Figure 6).
Wetland Determinations and Delineations
Potential wetlands were evaluated during field observations on May 20, 2015. One wetland was
identified and delineated in the eastern portion of the property (Figure 2). Corresponding data
forms are included in Appendix A. The following description of the wetland and the adjacent
upland reflects conditions observed at the time of the field visit. At that time, precipitation
conditions were normal based on available 30-day rolling precipitation data and dry based on the
three-month antecedent conditions (Appendix B). A Certificate of Survey prepared by Sathre-
Bergquist, Inc. and showing the wetland boundary is included in Appendix C.
Wetland 1 was a Type 1 L/3 (PFO1B/C)bottomland forest/shallow inarsh that covered most of
the eastern and northeastern part of the property. The wetland elevation ranged from
approximately 1 to 3 feet above Long Lake. Vegetation in the wetland included a forest

overstory dominated by the boxelder, silver maple, and American elm, with an open patchy herb
layer that included reed canary grass, bluejoint reed grass, and small amounts of giant goldenrod
and garlic mustard. Shrubs were patchy and variable, consisting of common buckthorn and other
species. The forested wetland transitioned to cattail marsh near the northeastern limits of the
property. This wetland covered 30,988 square feet (0.71 acre) within the property boundary.
Two upland areas were delineated as exceptions to the wetland. The first exception was a raised
upland island covering about 200 square feet and associated with an uprooted tree near the
lakeshore. The second exception was a raised forested upland peninsula covering about 4,000
square feet that extended onto the adjoining property to the south.
The wetland boundary corresponded to a rise in topography accompanied by an increase in the
predominance of FAC, FACU, and UPL forbs. The wetland-upland plant community
transitioned from boxelder-silver maple-American elm forest to sugar maple forest, with
com�non buckthorn in the shrub layer. Predominant species in the upland herb layer included
garlic mustard, common burdock, enchanter's nightshade, sticky willy (aka cleavers), and
prickly gooseberry.
The boundary between the wetland and the wooded upland to the west generally paralleled the
950 contour, but diverged from the contour where a triangular upland area about 1 foot above the
wetland boundary jutted out into the wetland (Figure 2). This area was raised enough to differ in
vegetation and soils from the wetland, but it did not rise enough to appear on topographic
mapping.
The cattail marsh portion of the wetland is shown on the NWI map as PEM1 A/PEM1 C wetland,
but the forested portion of the wetland is not shown on the NWI map. The county soil survey
shows parts of the wetland as hydric soils, including Muskego muck and Glencoe loam. The soil
survey maps the western portion of the wetland and the adjoining upland as predominantly non-
hydric Lester loam. The Minnehaha Creek Watershed District (MCWD) wetland inventory
assigns a Preserve wetland management classification to the northern portion of this wetland
(Figure 7). The southern forested portion of the wetland is not classified on the MCWD map.
Other Areas
No other areas with hydrophytic vegetation or wetland hydrology were observed on the site. No
other areas were mapped with hydric soil on the soil survey map, or as wetland on the NWI map.
IV. CERTIFICATION OF DELINEATION
The procedures utilized in the described delineation are based on the U.S. Army Corps of
Engineers 1987 Wetland Delineation Manual as required by Section 404 of the Clean Water Act
and the Minnesota Wetland Conservation Act. Both the delineation and report were conducted in
compliance with regulatory standards in place at the time the work was completed.
All site boundaries indicated on figures within this report are approxiinate and do not constitute
an official survey product.

Good Morning,
We issued the building permit for 790 Brown Road North on March 6, 2015 with the stipulation and in agreement with
Amanda Bendar the applicant would obtain an approved wetland delineation and execute a wetland buffer declaration
prior to the issuance of the final certificate of occupancy. The builder dropped off a survey dated June 1, 2015 showing
a delineated edge, but I don't see I've received a NOD from the MCWD. They have not requested a final CO but I wanted
to see where you stood with their requirements. Please advise.
