This application was reviewed as Zoning File #1278. ;� 2. The property is located in the LR-1B Single Family Lakeshore ;; Residential Zoning District. - 3. The Orono Planning Commission reviewed this application on June 20, 1988, and recommended approval of the proposed variance based upon '� the following findings: •� A) The proposed deck is at or below grade level of the adjacent � affected house, hence no lake views currently enjoyed by the J neighboring property owner will be encroached upon. ? B) The proposed deck is entirely within the 75-250' setback � zone. The applicant has agreed to remove existing areas of non- � structural hardcover which wil 1 reduce the 75-250' hardcover on ,.� the property from 43.9� to 38.2$, a net decrease of hardcover on • the property of more than 700 s.f. 4. The City Council has considered this application inc].uding the findings and recommendations of the Planning Commission, reports by City staff, comments by the applicant and the effect of the proposed variance on the health, safety and welfare of the community. f. The City Council finds that the conditions existing on this property are peculiar` to it and do not apply generally to other property in this zoning district; that granting the variance would not adversely affect traffic conditions, light, air nor pose a fire hazard or other danger to neighboring property; would not merely serve as a convenience to the applicant, but is necessary to alleviate a demon- strable hardship or difficulty; is necessary to preserve a substantial property right of the applicant; and would be in keeping with the sp.irit and intent of the Zoning Code and Comprehensive Plan of the ' City. �� . f CONCLIISIONS, ORDffit AND CONDITIONS i •; Based upon one or more of the findings noted above, the Orono � City Council hereby grants a variance per Municipal Zoning Code Section • 10.22, 5ubdivision 1 (B) to permit the construction of a deck which will encroach p:ast the average lakeshore setback line, and a variance to Section 10.22, Subdivision 2 to allow hardcover of 34.9� in the 75-250' zone where � only 25� hardcover is normally allowed, subject to the following �j conditions: � 1. Hardcover on the property is allowed as follows: 0-75 ' = 18 s.f. tie border around flower bed (0.2$) 75-250' (area within zone = 12,872 s.f. ) : House 1,711 s.f. � Front Stoop 84 s.f. , ; Garage Apron 48 s.f. � Patio 504 s.f. � Driveway 1,617 s.f. t Deck 528 s.f. ; ___-________ � TOT�,L 4,492 s.f. (34.9�) ` 2. Applicant shall remove areas of hardcover as shown on Exhibit A, � prior to final inspection of deck. Applicant is further advised that enclosure of any portion of this approved deck that will encroach past the existing site line from the property at 4480 North Shore Drive, as defined by the existing corner of the applicant's house, will require a formal variance application. 4. Authorities granted with this resolution run with the property not with the applicants, but are permissive only and must be exercised by .. � . . application for a building permit within •one year of the .date o£ Council approval, or this variance will expire on that date (July 11, 1989 ) . 5. Violation of or non-compliance with any of the terms and conditions of this resolution shall constitute a violation of the , zoning code, shall automatically terminate any authority granted herein, and shall be punishable as a misdemeanor. 6.
