ORONO CITY COUNCIL MEETING
MONDAY, JULY 24, 2000
ROLL
The City Council met on the above - mentioned date with the following members present:
Mayor Gabriel Jabbour, Council Members Charles Kelley, Barbara Peterson, Richard Flint,
and Bob Sansevere. Representing Staff were City Administrator Ron Moorse, City Attorney
Tom Barrett, Senior Planning Coordinator Michael Gaffron, Zoning Administrator Paul
Weinberger, Assistant Zoning Administrator Wendy Bottenberg, City Engineer Tom Kellogg,
Public Services Director Greg Gappa, and Recorder Jackie Young.
Mayor Jabbour called the meeting to order at 7:00 p.m.

PARK COMMISSION COMMENTS
White thanked the City Council members for approving the improvements to the Navarre Park.
White commented the improvements that the Citv has been making over the past several years
have turned Orono into a more attractive city.
Mayor Jabbour commented he has been speaking with Jerry Rockvam, Spring Park Mayor, who has
indicated that they have been planting trees along County Road 15 in order to expand their existing
green space.
Kelley commented with the potential of the land to the west of the Navarre Park being developed,
the Parks Commission may want to consider the possibility of relocating the play equipment to
that area, which is adjacent to the Dakota Rail and could potentially be accessed by more residents
to avoid the need to spend additional money on play equipment in the future.
White stated the equipment being purchased for the Navarre Park is an asset and should be around
for a long time. White stated he is unable to comment on what would be ideal for that area until the
Parks Commission has an opportunity to review the plans for that park.

required to permit an addition to the existing residence located at 300 Sixth Avenue North.

Brian Kerber, Applicant, was present.
Weinberger stated the Applicant is requesting variances to permit construction of a
60' by 40' (2,400 square foot) pole barn on his property located at the intersection of Orchard Park
Road and County Road 6, consisting of 4.8 acres. This property is located in the five acre zoning •
district, with the majority of the lots in this area consisting of acreage between 4.6 and 4.8 acres.

Weinberger stated the Applicant is proposing to construct a pole barn in excess of the City
Code, which permits an oversized accessory building to be no bigger than 2,000 square feet for a
lot of this size. A second variance is being requested to relocate a two -stall garage in the area
where the pole barn is proposed to be constructed. Relocation of the garage would require a
variance to the side street setback to allow the structure to be located 72.9 feet from the side
street lot line where 100' is required.
Weinberger stated City Code currently does not permit detached garages and other accessory
buildings to be located closer to the front or street lot line than the principal building on a
non - lakeshore lot.
City Staff had recommended approval of the variance to relocate the garage. The Applicant
has indicated he would be willing to relocate the garage further back if the City Council so
directs. Weinberger indicated some hardships do exist on this property due to the location of the
septic tanks and drainfield, which restrict the Applicant from construction of the pole barn behind
the house. The topography of this site also consists of sonic low land along with issues relating to
high water table and drainage. Location of a building behind the residence would also require
extensive regrading and construction of a very long driveway to the rear of the property.
City Staff feels this is the best location for the pole barn since it will allow use of the existing
• driveway for access as well as provide access to the existing two -stall garage.
City Staff recommended denial of the variance to allow construction of an accessory building in
excess of the 2,000 square feet permitted by City Code. The Applicant has indicated he needs the
oversized building in order to accommodate a truck and trailer utilized in his occupation, which
is 56' long and requires a larger building. Staff has concerns regarding the potential of a
precedent being set with granting of the variance to permit an oversized accessory building.
The Planning Commission recommended on a 3 to 2 vote to approve the variance to permit a
2,160 square foot pole barn on the property and to approve a variance to permit the garage to be
relocated closer to the side property line than the principal residence. It was the minority opinion
of the Planning Commission that permitting an accessory structure larger than what is permitted
for the lot would set a negative precedent. The Planning Commission indicated that a 60' by 40'
building would be too large for the size of the lot and recommended reducing the width of the
building to 36', which results in a 2,160 square foot stricture.
Kerber commented the vehicle and trailer he would like to store in this building is 56' long, and
he needs a 60' long structure in order to allow some room to walk around the vehicle as well as
to permit the vehicle and trailer to be backed out. Kerber indicated he is unable to make this
building a drive- through due to the location of the septic system to the rear of the building.
Kerber stated he needs to park the vehicle more towards the center of the shed to allow for it to
be backed out.
Mayor Jabbour inquired whether the Applicant would be willing to construct a 60' by 36' pole
• barn versus the 60' by 40'.

Kerber stated he would be happy with the 60' by 36' structure. Kerber inquired whether he would
be allowed under the City Code to construct two 2,000 square foot buildings on his property.
Weinberger indicated the Applicant would be permitted to have one oversized accessory building,
with the maximum square footage for a lot of this size being 4,000 square feet. Weinberger stated
the Applicant technically could construct one accessory building consisting of 2,000 square feet
and two buildings consisting of 1,000 square feet under current City Code.
Kerber commented if he is unable to construct a 2,160 square foot building, he would need to
consider the possibility of constructing another 1,000 square foot building on his property. Kerber
stated if he is allowed to construct a building consisting of 2,160 square feet, he would not need to
construct another structure on his property.
Kelley commented that there apparently is a flaw in the zoning code that needs to be reviewed
further by the City Council. Kelley stated in his opinion the opportunity to construct three
structures on the property totaling the allowable 4,000 square feet was not the intent of the code.
Kelley stated he is not in favor of allowing two additional 1,000 square foot buildings on this
property in addition to a 2,000 square foot building.
Sansevere inquired whether there was a minimum spacing permitted between the structures. is
Weinberger stated the property owner would need to keep a minimum of ten feet between the
structures unless a fire wall was constructed.
Mayor Jabbour commented in his opinion this is a reasonable request by the Applicant.
Kelley commented in his view the City Council is being placed in a position -where they have to
approve the variance or the Applicant will build another structure.
Peterson commented the Applicant Awould still be able to construct another building under City
Code.
Kerber commented he does not want to have to construct another building on his property and
would be happy with the 2.160 square foot structure.
Peterson inquired what the hardship is to allow the variance to the oversized accessory building.
Mayor Jabbour stated in his view the Applicant would need to waive his right to construct
one of his 1,000 square foot buildings if the variance is granted. Jabbour inquired whether the
Applicant would be willing to give up his right to construct one of his 1,000 square foot buildings
that he is permitted under City Code if the variance is granted.
Kerber reiterated lie does not want to construct another building on his property and would prefer
to construct the 2,160 square foot building.
Tom Barrett, City Attorney, stated in his opinion the City could request the Applicant give up his •

right to construct one of the 1,000 square foot buildings as a condition of the variance being
granted.
Mayor Jabbour stated the Applicant would still be allowed to construct a 1,000 square foot
building on his property but he would be giving up his right to construct two 1,000 square foot
buildings if he elects to construct the 2,160 square foot pole barn.
Sansevere inquired whether a future property owner would be held to the same restriction.
Mayor Jabbour stated that would be part of the agreement.
Kelley reiterated City Staff should review this part of the code.
Sansevere commented the wetland area of the property should also be taken into consideration
when considering this type of application.
Kelley stated he is in agreement that the amount of wetland on the property should be considered
and that perhaps the code should apply only to dry buildable land rather than the total acreage.
Mayor Jabbour stated lie also is in agreement that the code should apply to dry buildable land only.
• Flint inquired whether the Applicant will be relocating the garage further back.
Kerber stated he will attempt to push the garage back as far as possible, but noted that he is unable
to relocate it much further back due to the steep grade that exists at the rear of his property. Kerber
stated he could possibly locate it six to eight feet further back.
Kelley stated in his view the hardship is the storage of this vehicle and trailer. Kelley inquired
what assurance the City Council would have that this vehicle and trailer will be parked inside the
building.
Kerber indicated he has gone through six trailers in the past ten years by having them sit outside and
having them rust due to the elements and would prefer to store his vehicle and trailer indoors.
Kelley reiterated that he would like the Applicant to store this vehicle and trailer inside rather than
utilize the pole barn for storage of other items.
Kerber stated he would be willing to put this into writing if so requested.
Sansevere commented the fact that the Applicant needs storage for his vehicle and trailer is not
a hardship in his view.
Kelley stated the City Council is required by law to grant variances based on a hardship.

Peterson stated a hardship in her view is inherent to the land and not the need for additional
storage space.
Mayor Jabbour commented he would like to see the properties in Orono be as uncluttered as
possible.
Sansevere moved, Jabbour seconded, to approve the variance to permit construction of a
2,160 square foot pole barn and a variance to the street lot line for the property located at 740
Orchard Park Road, with the stipulation being that if the Applicant wishes to exercise
his right as presently exists in the Ordinance to construct an additional shed, that building
must comply to City standards, and with the understanding the Applicant will store his
vehicle and trailer inside the newly constructed structure, and further with the understanding
that the existing two -stall garage will be relocated as far back as possible.
Jabbour commented in his view the hardship is based on the land and the Applicant relinquishing
his right to constrict four structures on his property.
VOTE: Ayes 4, Nays 1, Peterson Opposed.
Peterson stated in her view there is no hardship inherent with the land and that the Applicant should
be required to limit the size of the building to 2,000 square feet.
( 47) JAMES ANDERST— NARROWS SALOON, 3380 SHORELINE DRIVE— PERMIT
REVIEW
James Andcrst, Applicant, was present
Weinberger stated the City of Orono has issued a building permit to the Applicant to allow the
additional remodeling of the Narrows Saloon which includes expanding the bar into the former
Minnetonka Photo space, which is now vacant. This property is located in the B -1 Retail Sales
Business District in .which a Class II Restaurant is defined as a restaurant which serves
intoxicating liquor or has live entertainment. Weinberger stated the expansion of the building
requires the owner to obtain a conditional use permit since Class II Restaurants are allowed by
a conditional use permit.
The applicant has made a formal application for a conditional use permit, but would technically
be considered to be an after- the -fact application since the owner was permitted to proceed
forward with the remodeling and expansion of the restrooms.
Weinberger stated the proposed expansion meets all setback requirements for the B -1 District,
with no change to the footprint of the building except for the small expansion to the restroom area.
Weinberger stated the expansion to the restroom is needed in order to make the restrooms
handicap accessible.

Subsequent to issuance of a building permit, Staff determined that a conditional use permit is •

needed for the expansion project. The Planning Commission will review this conditional use permit
application at their next meeting. The Applicant has requested that he be allowed to proceed with
the remodeling and expansion. City Staff would request a letter in writing from the Applicant
indicating that all work is done at the owner's risk at this point since a conditional use permit is
required.
Weinberger stated the Applicant is requesting the City Council approve the continued remodeling
of the Narrows Saloon prior to the August 21" conditional use permit review and prior to the
issuance of the conditional use permit.
Anderst stated he obtained a demolition permit from the City to tear a concrete wall out and erect
a beam. Anderst stated he submitted architectural drawings to the City and obtained a building
permit. Anderst stated he proceeded with the remodeling and requested a footings inspection
and was told at that time that he needed to appear before the City Council. Anderst stated he was
informed by the building inspector that he did not notice the new footings at the time lie
reviewed the plans.
Mayor Jabbour stated it was his recollection that at the time the Applicant approached the City
for a liquor license, he had indicated lie wanted to remodel the structure. Jabbour stated the issue
relating to live music will be part of the conditional use permit, but the restaurant and bar license
has been approved.
• Weinberger stated the Applicant is expanding into the vacant Minnetonka Photo space, and
technically a conditional use permit is required. Weinberger stated any building permits to expand
the size of this building, requires City Council approval as part of a commercial site plan review,
which is part of the conditional use permit process.
Mayor Jabbour inquired why the owner is proceeding at his own risk since the City has previously
granted a liquor license based on the existing plan and also a building permit.
Weinberger stated the issue relates to the live entertainment.
Kelley stated in his view the City has errored by not realizing the Applicant would be expanding
the use of his business, which requires a conditional use permit, without having a commercial
site plan done first. Kellcy stated City Staff should have realized at the time of the request for a
demolition permit that the business was being expanded and that a site plan review was required
as well as a conditional use permit to do that.
Mayor Jabbour pointed out the Applicant is attempting to .work with the City on this matter and
that hopefully a mutual agreement can be reached.
Kelley indicated as part of a commercial site plan other factors cone into play, such as lighting,
signage, and parking, which the Applicant should be aware of Kelley stated he has concerns
that the City Council gives the okay to proceed forward with the remodeling .without these other
issues being addressed. Kelley commented in his view it is not proper for the City Council to
proceed forward with this application without a site plan review and conditional use permit
review.

Anderst stated the building is not changing except for the four foot expansion to the restroom
area. Anderst commented he is merely expanding into existing space.
Mayor Jabbour stated in his view the Applicant is entitled to proceed forward with his remodeling
project.
Anderst stated the improvements have enhanced the neighborhood.
Mayor Jabbour stated the Applicant will be required to meet certain conditions at the time the
site plan and conditional use permit process are reviewed.
Weinberger stated the City Council will need to approve the Applicant proceeding forward with
the remodeling project, noting the building currently is open and construction is underway.
Flint commented since the Applicant is in the midst of the remodeling at the present time, it is
difficult for the City Council to tell the Applicant not to proceed forward since City Staff failed
to inform the Applicant of the proper procedure that needs to be followed. Flint reiterated the
applicant will be required to meet certain conditions that are normally required as part of the
conditional use permit.
Flint moved, Jabbour seconded, to approve the continued remodeling of the Narrows
Saloon located at 3380 Shoreline Drive prior to the August 21, 2000 Conditional Use Permit •
review and prior to the Conditional Use Permit being issued by the City of Orono, with
the understanding the Applicant will be required to meet certain required conditions as
part of the Conditional Use Permit process.
Anderst inquired what typically is required with a conditional use permit.
Mayor Jabbour stated the requirements vary from property to property and are undetermined at
this time. Mayor Jabbour stated there still is an issue with the live entertainment that will need to
be further addressed.
Kelley stated the kitchen may need to be brought up to code and other items such as
lighting, signage, parking, and hours of operation will need to be reviewed. Kelley expressed
concern that he is being requested to approve this application without those questions being
answered.
Flint commented that the City Council is not approving the conditional use permit at this time
but is merely allowing the Applicant to proceed forward with the remodeling.
Mayor Jabbour stated the City Council in his view will not be able to den\- the Applicant the
right to continue to operate as he was in the past, but that any expansion of use will need to be
reviewed. Jabbour stated the issuance of a building permit has triggered a number of
requirements which will need to be addressed.
Kelley stated the amount of parking required for this business differs from the photo business •
that used to exist at this location.

Anderst commented lie experiences a number of people parking in the public parking lot that
frequent Lord Fletchers.
Sansevere inquired what increase in capacity the Applicant is expecting with this additional space.
Anderst stated he is not sure at this time. Anderst stated the total square footage of the building
is 3,000 square feet.
Sansevere inquired what the current capacity of the building is.
Anderst stated Code allows 15 square feet per person at the present time. Anderst stated he is
not aware of what that number is offhand.
Kelley stated he is not trying to be opposed to this project, but that the City needs to be careful
about informing the Applicant that he will be required to meet certain conditions as part of this
project. Kelley inquired whether the City Council would be in favor of closing this business down
should the Applicant not be able to meet the required conditions.
Mayor Jabbour stated in his view the City Council should not take that position since the City
did issue a building permit to the Applicant and did not inform the Applicant that he needed to
obtain a conditional use permit.
Flint commented in his opinion it has been made clear to the Applicant that he will be required
to comply with certain conditions as part of this proicct.
Anderst requested he be allowed to keep the live entertainment.
Mayor Jabbour commented that will need to be discussed further. Jabbour noted he has received
calls in support of the improvements from the residents in the area.

MAYOR /COUNCIL REPORT
Mayor Jabbour noted he \vill be meeting with the County Commissioners regarding the Dakota Rail
to Trail project this Nveck.
Mayor Jabbour stated the issues relating to Narrows Dock have not been resolved. Jabbour
indicated he has discussed this matter with a few of the residents of this area who have expressed
dissatisfaction with the parking. Jabbour stated a consensus was reached with the neighbors that
this was primarily a personal matter and that the City should probably not be involved. Jabbour
stated he suggested a meeting be held with all the owners of the docks to try to obtain first rights
of refusal for the purchase of the dock lots by the owners of adjacent properties.
• Mayor Jabbour stated the issue relating to the additional water patrol was not meeting with much

success, noting there is a lack of funding.
Kelley commented there is a problem with people rafting within 30 feet of the shoreline, with
a couple of the residents in this area requesting additional patrol.
Mayor Jabbour stated the LMCD did approve the additional water patrol concept but that there
is an issue relating to the funding and that the LMCD has elected not to make this a top priority
at this time.
Kelley expressed concern that this matter is not being pursued more actively in light of the fact
that all the cities have indicated that additional water patrol is needed.
Mayor Jabbour commented this is an issue that needs to be discussed at the time the City's
budget is being prepared.
Sansevere stated that perhaps the City should consider installing no trailer parking signs on
Northshore Drive cast of the Noerenburg Channel to limit parking. Sansevere commented there is
also a problem with vehicles waiting to get their boats out of the water as well as the number of
vehicles with trailers being parked in this area.
Mayor Jabbour commented that there is also a lack of courtesy being shown on the part of the
drivers and that access to this dock may need to be limited. •
It was the consensus of the City Council to erect no trailer parking signs in the area of
Noerenburg Park.
Jabbour moved, Sansevere seconded, to direct City Staff to request Hennepin County to
erect no car trailer parking signs along County Road 51 in the area of Noerenburg Park, and
that parking will be prohibited along County Road 51 all the way to Highway 84.
VOTE: Ayes 5, Nays 0.
Mayor Jabbour indicated this action is being taken out of concerns for public safety.
Sansevcre inquired whether the police department will be notified of this action.
Moorse stated the police department will be notified first of the change in parking for this area.
Mayor Jabbour indicated he has spoken with the Community Education coordinator as part of the
Chamber luncheon that he recently attended. Jabbour indicated he informed the coordinator
of the discussion held at the City Council workshop regarding the activities held within the City
and the local parks. Jabbour stated as the population in this area and Independence increases,
there will be an increase in the use of the local parks, which needs to be considered.
Kelley commented once the new Highway 12 is completed, there will be an increase in population
and that steps will need to be taken on how to accommodate that added growth.
Flint commented that the City of Independence was looking at changing its ordinance regarding •
the amount of livestock and horses allowed per acre.

PUBLIC SERVICE DIRECTOR'S REPORT
( #8) PURCHASE OF NEW FURNACE FOR CRYSTAL BAY POST OFFICE
Kelley inquired whether the City has a profit and loss statement on this building and whether the
amount of money the City puts into the building exceeds the amount of rent revenue received.
Moorse indicated the City receives $5,100 a year in rent.
Mayor Jabbour commented it was his understanding it was approximately $11,000 a year or
$800.00 a month.
Moorse stated the City did some significant work approximately eight years ago, which amounted
to a year's *vorth of rent, and has not performed any improvements since that time.
Gappa stated this project has been prompted as a result of a concern regarding the fuel tanks
located on this property. Gappa stated the fuel tanks are to be removed following installation of
the gas furnace.
Kelley commented he is not opposed to the project, but that he would like to be assured that
taxpayer money is not being used to improve this project.
• Moorse stated the City is not losing money on the rental of this building.

Kelley inquired whether the soil will be tested following removal of the tanks.
Gappa stated the tanks are located above ground and that lie was not planning on having the
soil in this area tested since there is no evidence that the tanks have ever leaked.
Kelley recommended the soil in this area be tested
Mayor Jabbour stated if there is obvious signs of contamination, the City does have an obligation
to take appropriate steps to correct the problem.
Peterson moved, Flint seconded, to approve the quotation for installation of a new
furnace and air conditioner for the Crystal Bay Post Office building from Vogt Heating
And Air Conditioning, St. Louis Park, Minnesota, in the amount of $3,975.00 to be funded
from the 2000 Capital Outlay Budget.
Flint inquired whether the amount included the costs for hookup.
Gappa stated it was his understanding the utility pays for the cost of bringing the gas to the
building and meter, with the City paying the other costs associated Nvith hookup, which is included
in the bid.

*( #9) PURCHASE OF SEWER VACUUM TRUCK
Peterson moved, Sansevere seconded, to approve the purchase of a Vactor Series sewer
vacuum truck through the State of Minnesota Cooperative Purchasing Program from
MacQueen Equipment, Inc., St. Paul, Minnesota, for a total cost of $247,238.00, to be
funded from the Sewer Fund; and to approve a budget adjustment to reflect the
expenditure. VOTE: Ayes 5, Nays 0.
*( #10) REQUEST FOR PAYMENT 92 — 2000 LIFT STATION PROJECT
Peterson moved, Sansevere seconded, to approve Request for Payment #2, 2000 Lift
Stations Project to Ford Construction Co., Inc., in the amount of $38,018.05.
VOTE: Ayes 5, Nays 0.

( 911) AWARD QUOTATION FOR DEMOLITION OF BUILDINGS AT 3790 SHORELINE
DRIVE
Flint stated it was his understanding the City would be splitting the costs of tills project with the
Parks Commission, Nvhich is not reflected in the memorandum. Flint stated this land was to be
treated 50 /50 with the Parks Commission.
Mayor Jabbour stated the section of land that the City owns is next to County Road 15, which
does not have anything on it.
Flint commented that section of land is valued higher than the other section.
Mayor Jabbour stated it is better to deplete the Park Fund and for the City to make a contribution
to the Park Fund.
*( #12) REPLACEMENT OF FACSIMILE MACHINE — BUDGET ADJUSTMENT
Peterson moved, Sansevere seconded, to approve the purchase of a Xerox Document
WorkCentre Pro 657 facsimile machine through the State of Minnesota Cooperative
Purchasing Program from Precision Business Systems, Inc., for a total cost of
$2,007.53, to be funded from the Improvement and Equipment Outlay Fund; and to
approve a budget adjustment to reflect the expenditure. VOTE: Ayes 5, Nays 0.
