HomeMy WebLinkAboutResolution 2307 y� � • Ci.t� o� ORONO RESOLUTION OF THE CITY COUNCIL °I r� NO. 2307 � ' • ' • • A R$SOLDTIOId GRAIdTIAiG A CONDITIONAL OSE PERMIT PER MIJNICIPAL ZONING CODE � SECTION 10.27, SIIBDIVISION 3 (A) FILB #1219 WH�R$AS, Bruce Olson, an authorized representative of the Orono Community Church (hereinafter "the appl�icant") has an interest in the property located at 770 OId Crystal Bay Road North within the City of Orono (hereinafter "City") and legally described as follows: The West 642.00 feet of Lot 2, Block l, Crystal Crest, Hennepin County, Minnesota (hereinafter "property"); and WHBRE�S, the applicant has applied to the City of Orono for a Conditional Use Permit to permit the use of the church buil.dings for day care use by the Busy Beaver Day Care per Municipal Zoning Code Section 10.27, Subdivision 3 (A). I�OW, THSREFOR$, BE YT RESOLVED by the City Council of Orono, • Minnesota: FINDINGS l. This application was reviewed as Zoning File #1219. 2. The property is located in the RR-1B Single Family Rural Residential Zoning District. 3. On November 23, 1987, the Orono Planning Commission reviewed the application as proposed and recommended approval of the conditional use permit that would allow the Orono Community Church to be used by the Busy Beaver Day Care based on �he following findings: A) The applicant has completed the following improvements to insure that all fire and safety code standards have been met: i. Fire extinguishers provided; ii. Child proof caps on electrical outlets; , iii. Locks on all janitor closets; iv. Outdoor play area fenced; v. Designation of all fire exists. B) The proposed use of the church is in accord with the intent of the Zoning Code and Comprehensive Management Plan. iC) The operation of the day care will not pose hazards to the public safety or welfare nor to the property owners within the adjacent neighborhood. The City Council has considered this application including the findings and recommendations of the Planning Commission, reports by staff and comments of the applicant and the effect of the proposed use on the health, safety and welfare of the community. 5. The City Counci 1 f inds that granting a Conditional Use Permit to allow the day care at the Orono Community Church will not be detrimenta 1 to the hea Ith, saf ety or genera 1 we 1 f are of the pub 1 i c, would not adversely affect light, air nor pose a fire hazard or other danger to neighboring properties, nor will it depreciate surrounding property values and that the proposed level of use of the property will be in keeping with the intent and objectives of the Zoning Code and Comprehensive Plan of the City. CO2dCL�SIO1dS, ORDffit AI�D CONDITIONS Based upon one or more of the above findings, the Orono City Council hereby grants a Conditional Use Permit per Municipal Zoning Code � Section 10.27, Subdivision 3 (a) to permit the Busy Beaver Day Care to operate a day care facility at the Orono Community Church, subject to the following conditions: l. This permit shall limit all day care use of the facility to 29 occupants at any one time. Such occupants to include students, teachers, teaching assistants, aides, etc. Violation of the occupancy load may result in the immediate termination of this permit. 2. The day care facility shall be limited to 12 s.f. of• signage. Such sign shall require a building permit from the City of Orono. 3. The applicant/owner, Orono Community Church, shall be solely responsible for maintaining the conditions of this permit. � 4. Violation of or non-compliance with any of the terms and condi- tions of this resolution shall constitute a violation of the zoning code, shall automatically terminate any authority granted herein, and shall be punishable as a misdemeanor. , 5.
