A RESOLOTION APPROVING
A METES AND BODNDS SDBDIVISION OF
A LOT LINE �LARRAwGEMENT FOR
HpiNS G. WLILER AND DON RL�MPF
FILE NO. 1003 ,
WHEREAS, the City of Orono is a municipaY corporation
organized and existing under the laws of the State of Minnesota; and
WHEREAS, the City Council of the City of Orono (hereinafter
"City Council") has adopted subdivision regulations for the orderly,
economic and safe development of Iand within the City; and
WHER$AS, the City Council has considered the application for
a subdivision by Hans G. Weiler and Don Kempf, (hereinafter "the
subdividers") of properties legally described as follows:
Lots 22, 23, 30 and 31, Skarp and Lindquist's Fernhill, according
to the recorded plat thereof, Hennepin County, Minnesota; and
• Lots 20, 21, 32 and 33, Skarp and Lindquist's Fernhil�, according
to the recorded plat thereof, Hennepin County, Minnesota; and
WHEREAS, the subdividers have compYeted all requirements of
. the City for metes and bounds subdivisions for division and
combination purposes.
NOW, TH$RLFORE BE IT RESOLVED, that the City Council of the
City of Orono hereby approves the metes and bounds division of a lot
Iine rearrangement for Hans G. weiler and Don�Kempf as shown on the
Certificate of Survey by Harry S. Johnson dated March 25, 1986 and
attached to this resolution, subject to the following conditions:
1. Upon approval of the subdivision by the City Council of
Orono, the owner of Parcel B as described in the Certificate of
Survey referenced above must apply to the City for legal
combination for tax purposes with Parcel C as described in the
same survey. .

2. The owner of combined Parcels B & C shalY execute a Special
Lot Combination Agreement with the City of Orono recognizing the
common onwership and limitations on use of Lot 6, Skarp and
Lindquist's Fernhil l, an undeveloped, riparian lot divided from
Parcels B & C by an unimproved public roadway.
3. The aforesaid division as shown on the attached Certificate
of Survey shall be filed by the City of Orono on or before May
24 , 1987 together with a certified original copy of this
resolution. "
The approval granted by this Resolution shall expire if the
division has not been filed by the date specified above. In that
event, it will be necessary to file a new application with the City of
Orono for subdivision review.
Adopted by the City CounciY of the City of Orono this 24th
day of November, 1986. ,
