. ,
1. This application was reviewed as Zoning File #1085.
2. The property is located in the LR-lA Single Family Rural
Residential Zoning District.
3. The Orono Planning Commission reviewed this application on
October 20, 1986, and recommended approval of the proposed

B) The topography of the site is such that a stairway
heading straight down to the lakeshore without prependicular
landings would likeYy require unusual excavation and
construction techniques and is not reasonabYy feasible.
C) Existing mature trees Wii serve to partially screen the
stairway structure from the lake.
D) The stairway with the proposed perpendicular Yandings
wi1 1 provide a safety stop should anyone trip or fall on the
stairway.
E) The proposed lighting fixtures integrated within the
stairway Wii i point downward and wii serve a safety purpose
while not causing a nuisance to the neighbors.
• F) The proposed stairway and the existing pumphouse
comprise a total of 2.6 hardcover in the 0-75' lakeshore
. setback zone.
4. The City Council has considered this application including
the findings and recommendations of the Planning Commission,
reports by City staff, comments by the applicant and the effect
of the proposed variance on the health, safety and welfare of the
community.
5. The City Council finds that the conditions existing on this
property are pecuYiar to it and do not apply generally to other
property in this zoning district; that granting the variance
would not adversely affect traffic conditions, light, air nor
pose a fire hazard or other danger to neighboring property; would
not merely serve as a convenience to the applicant, but is
necessary to alleviate a demonstrable hardship or difficulty; is
necessary to preserve a substantial property right of the
appYicant; and would be in keeping with the spirit and intent of
. the Zoning Code and Comprehensive Plan of the City.
CONCLIISIONS, ORDB1t AND CONDITIONS
Based upon the above findings, the Orono City CounciY hereby
grants a variance to the Municipal Zoning Code Section 10.22,
 Subdivisions 1 & 2 and Section 10.55, Subdivision 8 to permit the
constructon of a stairway within the 0-75' lakeshore setback zone
where no structure is normally allowed, and which structure Wii1
increase the hardcover in the 0-75' lakeshore setback zone to 2.6$
, where no hardcover is normally allowed, and which structure encroaches
into the average lakeshore setback where no encroachment is normally
allowed, subject to the fol lowing conditions:
