NOW THEREFORE BE IT RESOLVED by the Village Council of the
Village of Orono, Minnesota, as follows:

1. Those permanent utility easements and temporary
construction easements required for construction
of sanitary sewer improvements 63 IS 19 63 TS 19
63 TS 21 63 LS 19 63 LS 2 and 63 TLS 1, shall be
acquired by purchase or condemnation.
2. N. L. Newhall,Jr,Village Attorney,' shall act as
agent of the Village in the acquisition of these
easements and is authorized to have them apprais-
ed as to property damage resulting `from said ac-
quisition in order to determine a fair compensa-
tion for the easements and to negotiate with the
owners inan effort to purchase said easements,
and further is authorized to commence and prose- <<,
cute condemnation proceedings to acquire said
easements in accordance with•MSA 117.Ol,etc.and
465.01.

ORDERING ACQUISITION OF SUITABLE PROPERTY
IN THE FRENCH LAKE AREA
FOR -CONSTRUCTION OF A MUNICIPAL�
SANITARY SEWAGE TREATMENT PLANT AND AN
ACCESS ROAD THERETO.
By resolution of the Village Council adopted March 25,1963,``;
pursuant to Sections 429.011 through 429.111,Minn.Statutes,
a public hearing was set for April 16,1963,f'or the purpose
of considering construction of a Sewage Treatment Plant in
the French Lake area,together with sewage appurtenances to
serve either immediately or in the future,certain`portions '
of the Village of Orono.
Pursuant to the applicable Statutes due notice of said sche-

duled meeting was given by mail and by publication to all
required persons.

0. On April 16919639pursuant to said Resolution and notice,a
public hearing was held on the proposition. All persons de -i
siring to be heard were afforded an opportunity to be heard
at said meeting.
D. By Resolution dated April 22,19639 the Village.Council has
ordered the construction of a Sewage Treatment Plant in the
"French Lake" area.
NOW,THEREFORE',IT IS HEREBY RESOLVED by the Village Council of
the Village of Orono,Minn.esota, as follows: -
1. The following described real estate located in the "French
Lake" area -of the Village of Orono shall be acquired by
purchase or condemnation for the purpose of constructing

a Sewage Treatment Plant:
{ All that part of Section 9, Township 117,Range,,23,Henne
pin County,Minnesota,described as follows: Beginning at.
a point on the'North line of the Northeast i of said
f,. Sedtion 9 distant 140 rods East of the Northwest corner
thereof; thence West along the North line of -said Section
a distance of 80 rods; thence South a distance of 80 rods;
thence East 80 rods more or less to a point due South of
the point of beginning;thence North 80 rods to the point
of beginning.
2. The following descrioed real estate located in the "French
Lake area of the Village of Orono shall be acquired by
purchase or condemnation for the purpose of providing
access to the sewage treatment plant site .described in
(1) above: _
The South 50 feet of the following described property,as
measured at right angles to the South line thereof,subject
to the right of way of.County Road.number 84 over and ac=
r,oss the Westerly 33 feet thereof:
•Commencing at a point 53.72 rods South of .the Northwest
<` corner of the Northeast 4 of Section 9, Township 117,
` Range 23,Hennepin County,Minnesota; thence North 494.58
feet; -thence East 990 feet along the'South line of tracts.

is authorized to have it appraised in order to determine
the -fair market value,to negotiate with the .owners in an
effort to purchase the said property at its fair market

SANITARY SEWER TRUNKS SYSTEM AND'FILING
THE BIDS ON THE SEWAGE TREATMENT PLANT
FOR FUTURE ACTION.
BE IT RESOLVED by the Village Council of the Village of
OronoMinnesota:, as follows:

("1) It is hereby found,determined and declared that the bids
-received by the Council for construction of 63 IS 1, 63 TS 19
63 TS 2,.63 LS 19 63 LS 2, and 63 TLS 1 are considered exces
sive and that all.said bids received June 10,1963 are rejected.
The Clerk,is hereby authorized and directed to return'the bid
deposits of all bidders on said projects.
(2) The Clerk is hereby authorized pd directedr.,:to file. the
bids received June 10,1963 for construction of a'se'wage treat- ,
-went plant,together with the bid bonds submitted with each bid
received for said project for action by the Councillat a future.

RESOLUTION APPROVING AMENDMENTS TO THE FINAL
PLANS AND SPECIFICATIONS OF THE SANITARY.SEWER }
TRUNK SYSTEM AND CALLING FOR BIDS THEREON.
BE IT RESOLVED by the Village Council of the Village of
Orono,Minnesota,as follows:
(1), The amended detailed plans and specifications hereto-
fore prepared by William T. Mills for construction of 63.IS 1,
63 TS 19 63 TS 21 63. LS 19 63 LS 2 and 63 TLS 1 are hereby
approved and ordered filed. 4,
(2) This Council shall meet bn Friday,July 12,1963,at
5:30 o'clock PM.,CDST, at the Village Hall in the Village of
Orono for the purpose of receiving and considering sealed bids +,._
for the construction of said improvements, and the Clerk
hereby authorized and directed to cause notice of said meeting .'
to be published in the official newspaper and in the Construe A
tion Bulletin, published at Minneapolis,Minnesota,.once at least l�i
three weeks prior to the date of said meeting,which notice shall'i
specify the time and place of the meeting the nature of the work,
that sealed bids for said work must be received 'by'the Village, ;,"

to hold such bids for a period of 40 -days without award and the
right to reject any and all bids without explanation and to waive
