A RESOLI�T'ION APPROVING THE
PLAT OF CRYSTAL BAY PRESERVE
FILE NO. 2518
WHEREAS, the City of Orono is a municipal corporation organized and e:cistin�
under the laws of the State of Minnesota; and
`VHEREAS, the City Council of the City of Orono has adopted subdivision
regulations for the orderly, economic and safe development of land within the City; and
WHEREAS,the City Council has considered the application for a subdi�zsion of�
eight(8)lot residential de�•elopment by Geor�e W. Stickney on behalf of ililid-US Properties Limite�
Partnership (hereinafter "the subdivider"); and
�VHEREAS, the subdivision has been found to meet all standards of the RR-1B.
Single Family Rura1 Residential Zoning I}istrict fi.nding that each lot is of a size and confiauration
that would allow its use for a sin;le famil�-residence to be fully developed; and
VV��REAS,the subdivider has completed or has aa eed to complete all requiremen�
of the platting regulations of the City, including:
1. Completion of all the requirements of Resolution No. 4314, the resolution grantin�
preluninary approval of the Class III subdivision.
2. Dedication on the plat of srandard perimeter drainage and utility easements.
3. A variance is granted for�idth of Lots 3, 4 and 5 which do not meet the 200' wzdli�
requirement for the RR-1B zonin� district, and a variance to allow filling a sma11
amount of wetland on pro�rty o�ned by the DNR to raise the Luce Line Trail.
4. Desijnation and dedication of drainaae easements over the stormwater pond a^d
designated wetlands within the plat.

5. A Homeowners Association has been developed for ownership and maintenance of
the private road to be located within Outlot A. The Homeowners Association shall
also be responsible for maintenance of all stormwater facilities szrving the
subdivision, including the outlet structure wzthin Lots 5 and 6.
6. Subdivider has granted to the City an underlying Road and Utilities Easement for
Outlot A.
7. The MCWD has conditionally appro�-ed the grading and drainage irnpro�-ements on
this property and the wetland fill to accommodate the culvert under the Luce Line
Trail to the south being reduced from 36" to 18".
8. Creation of covenants for all lots for protection of drainfield sites, including
protective language for alternate septic sites along with site plans locatin� both
primary and alternative sites, and alerting future property owners of the need to
protect sites on adjacent properties.
9. Execution of a Subdivider's Agreement providing for the installation of draina�e and
stormwater facilities required as a condition of subdivision approval, and postinQ of
security to ensure that these required improvements are completed to the City's
satisfaction, the design of said improvements subject to approval of the City
Engineer.
10. Applicant has granted a 10' wide trail easement along the west boundary of the
properry.
11. Payment to the City for the final plat review fee and fee for legal revie�i-and fili.nQ
of the plat, easements and covenants in the amount of$400.00.
12. Payment to the City for park dedication fees for the creation of six(6)ne«-lots in the
amount of$29, 400.
13. The private road within Outlot A shall be known as Deer Run Trail East_

NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Orono
hereby approves the plat of Crystal Bay Preserve, Hennepin County, Minnesota, subject to the
following conditions:
1. Prior to release of the plat for filing, applicant shall provide to the City permit for
grading and erosion control from the Minnehaha Creek Watershed District.
2. Applicant shall not proceed with any grading on the property prior to receiving a
grading permit from the Mirulehaha Creek Watershed District.
3. All identified primary and altemate sewage system drainfield sites within the
subdivision shall be fenced off prior to any land alterations, and such fencing shall
remain in place until such time the individual lot is developed.
4. The storm�vater improvements shall be constructed to City requirements, subject to
the Developers Agreement executed between the City and the developer. Draina�e
and stormwater improvement construction can begin as soon as the final plans have
been formally approved by the City Engineer and the Developers Agreement has
been executed.
5. No building permits shall be issued until the stormwater manaaement improvements
have been completed and road is constructed by the developer and approved by the
City.
6. Prior to City release of the plat for filing, applicant shall provide evidence of fee
ownership of the property in a form acceptable to the City Attomey, and applicant
shall meet any other title requirements as may be required by the City Attomey.
7. Applicant shall provide all documents noted in this resolution in a format
acceptable to the City Attorney prior to release of the plat for filing, and shall
complete all conditions to the satisfaction of City staff, prior to release of the plat for
filing.

8. The aforesaid plat shall be filed by the City of Orono with either the Hennepiy
County Recorder's Office or Registrar of Titles Office on or before February-23,20a�
together with a certified original copy of this resolution and executed copies of th:
easements and covenants noted above.
The approval granted by this resolution shall expire if the plat has not been filed b�•the da::
specified above. In that event, it will be necessary to file a new application with the City of Oro��
for subdivision review. Dated this 23rd day of August, 1999.
