A RESOLUTION RELEASI�iG LOTS 1 THROUGH 8,
CRYSTAL BAY PRESERVE FROM RESOLUTION
NO. 1757

WHEREAS, George W. Stickney (hereinafter the "subdivider") has requested a
Conditional Use Permit, appro�-ed on May 13, 1985 be released within the plat of Crystal Bay

WHEREAS,on Au�ust 23, 1999,the City Council approved the plat of Crystal Bay
Preserve; and
WHEREAS, the plat of Crystal Bay Preserve included property located at 250
Old Crystal Bay Road legally described as follows:
That part of Lot 1, Auditor's Subdivision Two Hundred twenty-nine (229),
Hennepin County, I�linnesota, according to the plat thereof on file or of record
in the office of the Registrar of Titles in and for said county, lying Southerly of
a line drawn parallel with and 240 feet Southerly of, as measured at right angles
to, the North line of said Lot 1 and lying Westerly of a line drawn parallel w-ith
and 1,070 feet Easterly of, as measured at right angles to, the West line of said
Lot 1 (hereinaft?r "the property"); and
`VHEREAS, at their regular meeting held on December 13, 1999, the Orono City�
Council releases Lots 1, 2, 3, 4, �, 6, 7 and 8 from the Conditional Use Pemut, per Resolution
`'o. 17�7 based on the findinas noted below:
1. A conditional use permit for a guest apartment was approved by the Orono City
Council for property located at 250 Old Crystal Bay Road.
?. The plat of Cr�-stal Bay Preserve was approved for eight lots, no lots can meet
the required area standard for two residential properties.

3. At the time of final plat approval the conditional use permit for the guest
apartment was not released and subsequently the conditional use permit is
recorded on the titles for Lots 1 through 8, Crystal Bay Preserve.
4. The subdivider has requested the City of Orono release Lots 1, 2, 3, 4, 5, 6, 7
and 8 from document number 17902�5 from the conditional use permit for a
guest apartment.
NOW, THEREFORE, BE IT RESOLVED, that based upon one or more of
the findings noted above, the City Council of the City of Orono hereby releases Lots 1, 2, �,
4, �, 6, 7 and 8 from the Conditional Use Permit, per Resolution No. 1757, recorded as
document number 1790255 in the Hennepin County, Minnesota Office of the Registrar of
Titles.
Adopted by the City Council of the City of Orono, Minnesota at a regular
meetin� held this 13th day of December, 1999.
