Dear Barker:
This is in regard to your meeting and related discussions
with Mr. Joseph Yanta of the Regulatory Branch concerning an
authorization under Department of the Army nationwide permit 26
(file 1994-02434-NW-JJY, which was confirmed by letters dated May
13 , 1994 and August l, 1994) . The special conditions of the
permit confirmation note that the Covenant of Dedication covering
wetland mitigation areas and buffers prohibit certain activities,
unless approved in writing by the Corps of Engineers . You asked
that we approve construction of an addition to a berm on the
south (nonwetland side of the existing berm in Block 4 , Lot 5
(2965 Deer Run Trail) of the Old Crystal Bay Road Addition
(Coffin Site) . This widening of the berm would allow truck
access so that additional trees to be planted. No fill would be
placed in any wetland (see enclosed drawings) .
We have determined that this berm widening is acceptable .
You should install silt fence, as necessary, to prevent any fill
from migrating into the wetland (Basin C-4) , blocking
drainageways, or encroaching on any other property. You should
also coordinate with the Minnesota Department of Natural
Resources, Trails and Waterways Division, which manages the Luce
Line Trail , adjacent to the berm. If the trail corridor is owned
by another party rather than the Minnesota Department of Natural
Resources, you should also contact the actual owner.
All other terms and conditions of the permit and the
covenant of dedication remain unchanged.
