Item Description: Request for Waiver of Consultant Fees - 420 Deborah Drive
Property owner Rachaelle Brady of 420 Deborah Drive contacted staff earlier this year regarding the
requirements for installing a swimming pool on her property. She was informed that the pool permit
would trigger the requirement to replace her non-compliant septic system. In August, as she was
finalizing plans for the septic system replacement, it was noted to her by staff that a wetland shown on
official City maps would potentially affect her pool permit.
She submitted a permit application for the pool in early September, paying a$30339 Plan Review Fee
and establishing a $2500 escrow account as required by City Code. The survey submitted with the
application noted there were no visible wetlands on the site. During the plan review process it was
determined that a small wetland does in fact exist on the site, as part of a much larger wetland complex on
the adjacent City property. This determination involved some preliminary work, a site visit and some
followup by the City's consulting engineers. The total pass-through costs for engineering services was
$1,030 which staff believes are legitimate costs for the work performed. Because the applicant is allowed
a$500 credit towards engineering services,the total to be billed to applicant was reduced to $530.
Shortly after the consulting engineer's site visit, applicant indicated she wished to stop the pool
application process because she was not interested in establishing the required 50' buffer. However, in
subsequent discussions initiated by the applicant, it was determined that a Functional Assessment of the
wetland might reveal that its management class would be reduced from `Preserve' to `Manage 3' which
would minimize the required buffer width. The cost of this assessment would be paid by the applicant.
Applicant chose to not move forward with the Functional Assessment process and has indicated a variety
of reasons why she feels the ordinance is unreasonable. Applicant is also disputing a portion of the bill for
engineering services, some of which were performed after she `called off' the project, and some of which
can be attributed to general information gathering regarding MCWD rules.
Staff has since learned that there may be some level of Council support for reviewing the buffer
requirements of the City's wetland ordinance in early 2013, in light of this application and other recent
applications.
COUNCIL ACTION REQUESTED
In contemplation of reviewing the City's wetland ordinances in 2013, and in light of the circumstances
noted above, staff is requesting Council consideration for waiving the $530 billing to the applicant and
refunding the escrow amount of$2500.

AGREEMENT made this Jr day of 4U' , 20� by and between the CiTY OF ORONp, a
Minnesota municipal corporation ("City") and ("Owners").
Recitals
1. _ A building permit appfication has been filed for ���1� �J located at
� the ("Subject Property"), legally described as lp ' 2 (. I , Hennepin
ounty Minnesota.
2. Owner requests the City to review thfs application.
3, The City will commence its review of the application and incur costs associated with said review only ff the
Owner establishes an escrow to ensure reimbursement to the City of its costs.
NOW THEREFORE,THE PARTIES AGREE AS FOLLOWS:
1. QEPOSIT OF ESCROW FUNDS. Contemporaneously with the execution of this Escrow Agreement, the
Owners shal! deposit$2,500 with the City. All accrued interest, if any, shalE be paid to the Clty to reimburse the City for its
cost in administering the escrow account.
2. PURPOSE OF ESCROW. The purpose of the escrow is to guarantee reimbursement to the City for all
out-of-pocket costs the City has incurred (inciuding planning, engineering, in excess of$50d, or(egal consu}tant review)or
will incur in reviewing tne plan. Eligible expenses shall be consistent wlth expenses the Owmers would be responsible for
under a building permit application. The escrow wil! also guarantee reimbursement to the City for all out-of-pocket costs
the City has incurred to assure that the work is compfeted in accordance with the Stormwater pollution Prevention Plan
and the provisions of Orono City Code Chapter 79. The financial security may also be used by the City to eliminate any
hazardous conditions associated with fhe work and ta repair any damage to public property or infrastri�cture that is caused
by the work (including planning, engineering, or legal consultant review) associated with buifding permit
#a?o�A-0087 �' if compliance with the approved building permit is not accomplished.
3. MONTHLY BILLING. As the City rece{ves consultant bil(s for lncurred costs, the City will in turn send a
bill to the Owners, Owners shall be responsible for payment to the City within 3Q days of the Owners' receipt of bill.
4. DISBURSEMENT FROM ESCROW ACCOUNT. En the event that the Owners do not make payment to the
Clty withln the timeframe outlined in #3 above, shall issue a Stop Work Order until the Owners pay all expenses fnvoiced
pursuant to #3. The City may draw from the escrow account wfthout further approval of the Owners to reimburse the City for
efigible expenses the City has incurred.
5. C�OSING ESCROW. The Balance on deposit in the escrow, if any, shall be returned to the Owners
when the review has been completed and written notificaiion is received from the Owners requesting the funds.
6. CERTIFY UNPAlD CHARGES. lf the project is abandoned by Owners, or If the eligible expenses
incurred by the City exceed the amount in escrow, the City shafl have the right to certify the unpaid balance to the subject
property pursuant to Minn. Stat. §§ 415.01 and 366.012.

following the 18th after I cancelled the project, should not be my responsibility. I know

Sec. 2-1. - Rules of procedure for appeals and other hearings.
The council may adopt by resolution certain written rules of procedure to be followed in all
administrative appeals and other hearings to be held before the council or other bodies authorized
to hold hearings and determine questions presented. Such rules of procedure shall be effective 30
days after adoption and shall be for the purpose of establishing and maintaining order and decorum

Sec. 78-96. - Board established.
(a) A zoning board of appeals and adjustments is established. The planning commission is
constituted as the board of appeals and adjustments. The decisions of the board are
advisory to the council. The board shall have the following powers:
��) To hear and decide appeals from any affected person where it is alleged that there is
an error in any order, requirement, decision or determination made by an
administrative officer in the enforcement of this chapter.
�2) To hear requests for variances in accordance with this chapter.
(3) To exercise other functions as provided in this chapter.
(b) Subject to such limitations as may be imposed by the council, the board may adopt rules for
the conduct of proceedings before it. Such rules may include provisions for the giving of
oaths to witnesses and the filing of written briefs by the parties. The board shall provide for a
record of its proceedings, which shall include the minutes of its meetings, its findings and the
action taken on each matter heard by it, including the final order.

Sec. 78-97. - Hearings.
Hearings by the board of appeals and adjustments shall be held within such time and upon
such notice to interested parties, as follows:
(1) The board shall within a reasonable time make its order deciding the matter and shall
serve a copy of such order upon the appellant or petitioner by mail.
(2) Any party may appear at the hearing in person o� by agent or attorney.
(3) Subject to such limitation as may be imposed by the council, the board may adopt

Sec. 78-98. - Notice of hearing.
(a) A notice of the time, place and purpose of the hearing on an appeal or variance shall be
mailed at least ten days before the day of the hearing to each owner of affected property and
property situated wholly or partly within 350 feet (150 feet in the case of a variance hearing)
of the property. For the purpose of giving mailed notice, the person responsible for mailing
the notice may use any appropriate records to determine the names and addresses of
owners. A copy of the notice and a list of the owners and addresses to which the notice was
sent shall be attested to by the responsible person, and shall be made a part of the records
of the proceedings. The failure to give published or mailed notice to individual property
owners or defects in the notice shall not invalidate the proceedings.
�b) In addition, a notice shall be published in the official newspaper once at least ten days before
the day of the hearing. If the board authorizes the issuance of a permit, the council shall
have six months from the date of the decision of the board to institute proceedings to acquire
such land or interest in the land; and if no such proceedings are started within that time, the
officer responsible for issuing building permits shall issue the permit if the application
otherwise conforms to this chapter. The board shall specify the exact location, ground area,
height and other details as to the extent and character of the building for which the permit is
granted.

Sec. 78-99. - Appeals procedures.
The applicant or other person or officers of the city affected may appeal by filing a written
notice stating the action appealed from and stating the specific grounds upon which the appeal is
made. The notice shall be accompanied by a fee in the amount prescribed by the current city fee
schedule payable to the city, which fee shall not be refundable.

Sec. 78-100. - Subdivisions.
Appeals to the board of appeals and adjustments may be taken by any affected person upon
compliance with any reasonable conditions imposed by the subdivision regulations. The board has
the following powers with respect to the subdivision regulations:
(1) To hear and decide appeals where it is alleged that there is an error in any order,
requirement, decision or determination made by an administrative officer in the
enforcement of chaqter 82
�2) To hear requests for varying the regulations as they apply to specific properties where
an unusual hardship on the land exists, but variances may be granted only upon the
specific grounds set forth in the subdivision regulations. Unusual hardship includes
but is not limited to inadequate access to direct sunlight for solar energy systems.

After an official map is adopted, designating locations for future land that is needed for future
street purposes and as sites for other necessary public uses, if a permit for a building in such
location is denied, the board of appeals and adjustments shall have the power, upon appeal filed
with it by the owner of the land, to grant a permit for building in such location in any case in which
the board finds, upon the evidence and the arguments presented to it, that:
(1) The entire property of the appellant of which such area identified for public purposes
forms a part cannot yield a reasonable return to the owner unless such a permit is
granted; and
�2) Balancing the interest of the city in preserving the integrity of the official map and of
the comprehensive municipal plan and the interest of the owner of the property in the
use of his property and in the benefits of ownership, the grant of such permit is
required by considerations ofjustice and equity.

What Wayne was referring to is; he quoted me $200 for coming out to assess the area. If he would have to do a
complete delineation it would be $900. He ended up charging me for 41/2 hours of work and an hour of drive time.
Totaling$324.50. I asked what happened to the $200 fee because he hadn't done the computer work yet. He said if I
wasn't going ahead with the project then he wanted to get paid for the time he came out. I said that was misleading
since we stood around and talked a good portion of that time and I didn't know he was charging me. I felt taken
advantage of. His email showed an over the top reaction.

that you want to leave the wetland classified as a Preserve wetland and maintain a 50'
buffer. If the existing vegetation meets our requirement for buffer vegetation (ie. native

note however, if the vegetation doesn't meet our requirements a planting or
improvement plan (and escrow) will be required. It is my understanding from our field
inspector's report much of this area is primarily turf grass and would have to be

Recitals
1. A building permit application has been filed for ����lP ���� located at

2. Owner requests the City to review this application.
3. The City will commence its review of the application and incur costs associated with said review only if the

1. DEPOSIT OF ESCROW FUNDS. Contemporaneously with the execution of this Escrow Agreement, the

2. PURPOSE OF ESCROW. The purpose of the escrow is to guarantee reimbursement to the City for all
out-of-pocket costs the City has incurred (including planning, engineering, in excess of$500, or legal consultant review)or
will incur in reviewing the plan. Eligible expenses shall be consistent with expenses the Owners would be responsible for
under a building permit application. The escrow will also guarantee reimbursement to the City for all out-of-pocket costs
the City has incurred to assure that the work is completed in accordance with the Stormwater Pollution Prevention Plan
and the provisions of Orono City Code Chapter 79. The financial security may also be used by the City to eliminate any
hazardous conditions associated with the work and to repair any damage to public property or infrastructure that is caused
by the work (including planning, engineering, or legal consultant review) associated with building permit
#o?o��-DD$7 �f if compliance with the approved building permit is not accomplished.
3. MONTHLY BILLING. As the City receives consu►tant bilts for incurred costs, the City will in turn send a
bill to the Owners. Owners shall be responsible for payment to the City within 30 days of the Owners' receipt of bill.
4. DISBURSEMENT FROM ESCROW ACCOUNT. In the event that the Owners do not make payment to the
City within the timeframe outlined in #3 above, shall issue a Stop Work Order until the Owners pay all expenses invoiced
pursuant to #3. The City may draw from the escrow account without further approval of the Owners to reimburse the City for
eligible expenses the City has incurred.
5. CLOSING ESCROW. The Balance on deposit in the escrow, if any, shall be returned to the Owners
when the review has been completed and written notification is received from the Owners requesting the funds.
6. CERTIFY UNPAID CHARGES. If the project is abandoned by Owners, or if the eligible expenses
incurred by the City exceed the amount in escrow, the City shall have the right to certify the unpaid balance to the subject
property pursuant to Minn. Stat. §§ 415.01 and 366.012.

Thank you for taking the time to ask for clarifications to my comments. Please show silt fence on the downhill of the
proposed pool is being installed so it will capture all runoff generated from the construction of the pool.
In regards to your comments regarding the tennis court and septic mound locations being shown as approximate. The
permit survey requirements do clearly state all existing accessory structures need to be shown. With that being said, I
do understand the rational you performed in showing the approximate structure and septic mound location on the
survey. I also understand you do not want to have to send your crews back out to get this information for the permit
approval.
I am willing to allow this, but when your crews are back on the site performing the final as-built survey, I will require you
get the definite locations of the shed,tennis court, septic mound location, and any other structure (retaining walls) not
shown on the survey. Please keep this in mind for all future surveys and provide all the information requested in the
survey requirements of the permit applications (http://www.ci.orono.mn.us/vertical/Sites/%7BCBFC8FAF-C313-4854-
A229-98A3482257F0%7D/uploads/Survey Requirements.pdf).
The major outstanding issue which has the potential to hold up the permit would be the wetlands. Please refer to City
Code 78-1601 (c)-(4) (http://library.municode.com/index.aspx?clientld=13094&stateld=23&stateName=Minnesota).
City maps indicate wetlands may be located on the property. Therefore,the applicant will need to determine if are
wetlands located on the property. If wetlands are determined to be on the property,the applicant will need to perform
an official wetland delineation and assessment. I would also recommend having this person evaluate the existing buffer
to see if it would meet the required width and qualities as outlined by City Code 78-1605
(http://library.municode.com/index.aspx?clientld=13094&stateld=23&stateName=Minnesota). This delineation will
need to be approved by Orono's consulting wetland expert.

Hello. I'm a surveyor for the property at 420 Deborah Drive, Orono. The owner contacted me this
morning regarding your denial of her application, and I'd like to follow up with you on your concerns
with the survey. Here are the issues as I understand them:
Wetlands: Our surveyor walked the south line of the parcel and didn't think that it looked like wetlands
encroached north of the boundary line. While the aerial photo looks like there might be wetlands close
to the south line of the parcel, they are three to four times farther than the minimum setback from the
pool. I have contacted our wetland delineator, Wayne Jacobson, who has reviewed the survey and
soil maps of the area. He will be contacting the MCWD today on the owner's behalf to request that a
wetland delination need not be perFormed.
Approximate structure locations: Our field crew has precisely located the lot corners, house, deck,
patio and trees. These are not approximate locations. After submitting an initial copy of the survey,
Chris Mattson asked for additional structures (including tennis court, shed, driveway & new septic
mound, which was put in place after our initial survey) to be located, we used our precise location of
the boundary, house and trees to add an aerial photo to the survey. Using this method, we were able
to add the requested additional structures (tennis court, shed, driveway) to the survey. The septic
system is still under construction, but the surveyor has indicated the general location of the mound at
the easterly corner of the lot. While these locations are approximate, they are supported by the
surveyor's presence on site verifying general location as well as the aerial photo. It is my
understanding that these structures are so much farther than minimum setback from the pool that it
seems reasonable to accept location based on aerial photo. The proposed septic tanks will not be
installed until after the pool is installed, so they can not be located at this time.
Silt Fence: I'm happy to add proposed silt fence to the survey. Where is it needed?
I do not know if you have received the copy of the survey with the aerial photo included. For your
reference, copies of the survey with and without aerial photo are attached as well as a copy of the
aerial photo available on the Hennepin County website. Please review them and re-consider the need
for re-locating the tennis court and septic mound. I'm happy to discuss this by phone as well. Please

I have reviewed the application for the proposed pool and have following comments:
• The locations of the existing house, existing tennis court, existing septic mound location, and proposed septic
tank locations should not be "approximate" but should be located and shown by the surveyor.
• The City's wetland maps indicate there is a possibility of a preserve wetland on the property. There should be a
delineation performed to determine if the wetland is located on the property. If the wetland is determined to
be located and determined to have a preserve classification,the applicant will be required to install a 50'

• The locations of the existing house, existing tennis court, existing septic mound location, and proposed septic
tank locations should not be "approximate" but should be located and shown by the surveyor.
• The City's wetland maps indicate there is a possibility of a preserve wetland on the property. There should be a
delineation performed to determine if the wetland is located on the property. If the wetland is determined to
be located and determined to have a preserve classification, the applicant will be required to install a 50'
wetland buffer along the wetland.

The intent of the variance procedure has never been used for, nor was it intended to be used for, not having to upgrade
the septic system. The variance procedure is to allow for setbacks that cannot be met or the sizing of systems and the
like. Mrs. Brady was first notified in 1999 that the system is non-compliant and had a septic system design drawn up in
2002, in anticipation of the pending upgrade deadline. She is now requesting to spend thousands of dollars on an
inground pool. This is not only unnecessary for enjoyment of the property but may impact a future septic site if she is
not required to upgrade the system as part of this project.
If Mrs. Brady does request a variance I will have no choice but to turn her down. To allow a variance for her to construct
hard cover,without upgrading the septic system, would open up a can of worms that the City cannot allow to happen.

is what I've found.
I have pasted the City Code sections below relating to permit issuance. Also attached are the septic system inspection
records for your property since 1990. Please note that beginning in 1999 your property was identified by the City as
being "non-compliant"due to the lack of State-required groundwater separation. You were notified of the 2010 deadline
for compliance at that time and with each subsequent inspection. Beginning on January 1, 2011 City code Section 58-
47(b) applies specifically to your situation. Because of this, in my opinion, there is no"gray area"as we discussed. You
must upgrade your septic system to meet the MN State minimum standards and Orono City Code prior to the issuance of
any non-maintenance type of building permit (maintenance permits include re-roofing, windows, mechanical, etc).
City Code 58-73 outlines the ability of the on-site manager (Willie Gibbs) to grant variances in cases of hardship etc. You
must request a variance in writing. I will be candid and say that I don't believe your situation will qualify for this rype of
variance but the code allows you to request one. If your variance is denied by Mr. Gibbs you may appeal Mr. Gibbs'
decision to the City Council.
Lastly, there is a Preserve classification wetland on or very near the southern portion of your property which is a further
limiting factor relating to location of septic system treatment areas and the swimming pool. I do not have a record of a
wetland delineation to provide you with more direction as to the size of the wetland but I thought I should mention it...

a site evaluation and design is approved by the on-site systems manager. The site evaluation must include the
identification of both primary and alternate drainfield sites suitable for a minimum of a five-bedroom residence. If
the building will be connected to an existing system, a site evaluation and design must be approved by the city,
including the existing system specifications and a future site meeting the provisions of this article. A new
residence must be connected to an ISTS meeting the definition of a code system.
(b) Required upgrade or replacement. A sewage treatment system not meeting the requirements of Minnesota
Rules Chapter 7080, as amended, or the requirements of this article, whichever is more restrictive, must be
upgraded, at a minimum, at any time a building permit is required for any improvements on, or use of, the
property, subject to the following:
(1) Any such system for which the city has previously issued orders requiring upgrade or replacement of
the system by December 31, 2007, shall not be subject to this requirement until January 1, 2008.
(2) Any such system for which the city has previously issued orders requiring upgrade or replacement of
the system by December 31, 2010, shall not be subject to this requirement until January 1, 2011.
(3) Regardless whether previous upgrade or replacement orders have been issued, this upgrade or
replacement requirement shall not apply when said building permit is for regular maintenance or upkeep
including but not limited to replacement of inechanical equipment such as air conditioning, furnaces,
water heaters, or water softeners, or for re-roofing, re-siding or window replacement.
(c) Construction of additiona/bedrooms or construction including water-using appliances that will increase the
sewage flow into an ISTS. A building permit shall not be issued until the city confirms that the existing ISTS is
compliant and of adequate size to treat the sewage flow from the building and that a future drainfield site is
designed and preserved. If the existing ISTS must be repaired or replaced, an ISTS design for both the existing
ISTS and a future drainfield site must be approved before issuing a building permit. If expansion or replacement
of the ISTS is required, the ISTS must be installed and inspected before a certificate of occupancy shall be issued
for the construction. Failure to identify satisfactory drainfield sites for the proposed sewage flow for use now as
well as a future site shall result in the denial of the building permit application.
(d) Expansion of an existing building, including decks and patios; construction of an accessory building, driveway
or land alteration. A future drainfield site must be designed and preserved prior to the issuance of a building
permit for any expansion of an existing building, construction to an accessory building or driveway or land
alteration on a property using an ISTS. A building permit will not be issued when the proposed work would
preclude the use of the only future drainfield site approved by the city.

Thank you Mike for all the work you put into my project. After reading and re- reading your information, I've
decided that I whole-heartedly can't consider any of the options. I've spoken with many council members and
Lili, and they agree, that revisions need to be considered with the wetland buffer code. Guidelines are just that.
We as humans still have the power to make judgement calls when there are circumstances that require it.
Triggers are just triggers. To dispute: 1. drainage to the wetland, it's hard pressed for any of the runoff getting
that far without seeping into the ground before it gets there. 2. We will be regrading the area so the runoff will
be toward the tennis court and a berm to the right of the pool. 3. The added hardcover is still way under the
allowed percentage, so that should not even be considered. Is this pool project really going to harm the wetland
area? I've lived on this piece of property for almost 26 years and I've loved taking care of it. I only want to
make it more enjoyable for my extended family and generations to come. My hope is that the code will be
changed to allow the distance to the wetland be a factor. I would like to finish the septic system next spring
along with the pool. If my 51/2 acres were divided into 5 lots, 4 of them could have pools. In conclusion, I am a
victim of a vague code, new obstacles thrown in in the 1 lth hour, and poor information about whether or not I
even have a wetland on my property. It was questioned by surveyors, wetland specialists, a delineator,
excavators, elevation guy for the pool, and my septic installer. I am asking you to please revise this code in my
favor.

Mark Perry has discussed the issue of wetland classification with Catherine Bach at the
Watershed District (MCWD). Here is my analysis of the situation:
Your wetland is currently classified as a Preserve management category, which requires a 50-
foot buffer.
Because your proposed construction activity meets all the Code criteria that triggers
establishment of a buffer, the 50-foot buffer is required to be established. Those criteria are: 1)
the area of the pool construction drains toward the wetland; 2) the amount of grading activity
associated with the pool exceeds 50 cubic yards (it's actually more than 100 cubic yards); and 3)
the pool results in a net increase in the square footage of impervious surface that drains toward
the wetland. Unfortunately there is no provision in the Code that would negate any of these
factors just because the pool is 350 feet from the wetland.
Your wetland delineatar, Wayne Jacobsen, staked out the edge of the wetland approximately 16
feet south of the rock wall. The City's consultant wetland expert, Mark Perry of Bolton & Menk,
was on the site and he agrees with Wayne's staked location of the wetland boundary.
We discussed the possibility that the current classification of the wetland as a Preserve category
might be incorrect. The only way to get it changed to some lower category would be to perform
a"MnRAM Assessment" which must be performed by a wetland expert. Catherine Bach
indicated MCWD will not perform the MnRAM assessment, but would review an assessment
performed by someone else. You would have to have your wetland delineator do the MnRAM
assessment.
Your goal in having that MnRAM assessment completed would be to have the wetland
reclassified to a lesser management category than Preserve, such as Manage l, Manage 2, or
Manage 3. Manage 3 would be your best result, because it only requires a 16.5-foot buffer, and
you already have that in place behind the rock wa1L If it turned out to be Manage 1 or Manage 2,
the buffer required would be 35' or 25' respectively from the edge of wetland. Mark tells me he
is fairly confident it would be reclassified to a lower category than Preserve, but until the
assessment was done we would not know exactly which category.
I understand that Melanie has offered to assist you in choosing the right plantings to establish a
buffer if you decide to go ahead with the buffer establishment based on the current Preserve
classification. However, if you want to spend the money to have a MnRAM assessment done in
the hopes that a lesser or no additional buffer will be required, that is up to you.
As I see it, your options for dealing with the buffer issue are as follows:
Option 1. Have your wetland person do a MNRAM Assessment.
If the MNRAM Assessment indicates that the classification should be
Manage 1, 2 or 3 instead of"Preserve", then have him submit it to the MCWD far
approval. Once they approve it, you would then proceed with submitting to us a
buffer plan to have the appropriate buffer established in the case of Manage 1 or
Manage 2; or if it's a Manage 3 no added buffer is necessary and we could issue the
pool permit once you re-apply.
If the MnRAM Assessment concludes that it's still a Preserve category, in order to
move forward you would have to do the required 50-foot buffer as noted previously.

Option 2. If you choose to skip the MnRAM and just go ahead with the Preserve
buffer of 50', you should proceed with the steps outlined previously by Melanie and
Chris.
Option 3. You could apply for a variancefrom the buffer requirements, which has a
$700 application fee and would take about two months to process. You would have
to convince the Council that you have a practical difficulty that prevents you from
establishing the buffer. From staff's perspective, we don't see that you have a
practical difficulty, and staff would not support the variance. But, that is an option if
you wish to pursue it, with no guarantee it would be approved.
I did research your question about why the septic system had to be replaced. The City inspector
did a soil boring on the property on October 8, 1999 and his boring logs (attached) indicate the
seasonal water table of the existing system was only 14 inches below the trenches, not meeting
the 30" minimum separation requirement. It had a deadline of December 31, 2009 to be
replaced, but replacement is also triggered by new construction on the site or by a sale of the
home. It is important that you complete the installation of the septic system regardless whether
you proceed with the pool.

that you want to leave the wetland classified as a Preserve wetland and maintain a 50'
buffer. If the existing vegetation meets our requirement for buffer vegetation (ie. native
grasses) you can meet this requirement by discontinuing the mowing of this area. Please
note however, if the vegetation doesn't meet our requirements a planting or
improvement plan (and escrow) will be required. It is my understanding from our field
inspector's report much of this area is primarily turf grass and would have to be

The existing rock wall is allowed to remain as located. I will be forwarding you a

I am very sorry for the confusion pertaining to the wetland on your property. I misunderstood
my conversation with Mark Perry yesterday. After speaking with him again this morning and
discussing your situation with Melanie Curtis, the following is a summary of what must happen
before we can issue your pool permit.
According to the official City of Orono wetland map there is a wetland on your property. The
official map indicates iYs a preserve wetland. If it's your delineator's opinion that it is not a
preserve wetland a Minnesota Routine Assessment Method (MNRAM) must be completed
along with a delineation to reclassify it. The Minnehaha Creek Watershed District (MCWD) will
then review and make a determination if a reclassification of the wetland is appropriate. If the
MCWD agrees with the MNRAM and reclassifies the wetland, it may result in a reduced buffer
width (16.5' or 25' buffer) versus a 50' buffer as required with a preserve wetland.
You may choose to leave the classification as is. A wetland delineation still must be performed
to show the wetland edge and a 50' buffer based on the preserve classification. After the
MCWD approves the wetland delineation, the edge of the wetland and the 50' buffer must be
staked on the property and shown on your survey. If buffer improvements are necessary in the
50' buffer area, a vegetative buffer planting plan will be required. Based on the wetland buffer
improvement plan our wetland specialist will determine the cost associated with the work
required to conform to code (complete the buffer plan). The City will require and hold an escrow
amount (to be determined) until the buffer is established. Once the buffer work is established,
usually one growing season, the wetland buffer escrow money will be refunded to you. In this
instance, the pool permit can be issued once the MCWD approves the wetland delineation, a
wetland buffer improvement plan has been submitted and approved and buffer escrow
submitted. The actual buffer improvement can take place next spring.
