To the property owner: Demolition of the principal dweiling structure on a property may automatically terminate
certain rights which may have accrued to the property by virtue of the continued existence of that building.
• Rebuilding on a substandard !ot af record {i.e. a lot that does not maet the zoning district required lot area or
width standards)will, with few exceptions, require variance approval by the City Council, and such approval is
neither automatic nor guaranteed but requires that a hardship be demonstrated.

Sec. 78-1279. Placement of structures on lots.
When more than one setback applies to a site, structures and facilities must be located to
meet all setbacks. Structures shall be located as follows:
(6) Average lakeshore setback. No principal or accessory structure shall be located closer to
the lakeshore than the average distance from the shoreline of existing residence
buildings on adjacent lots; except that this does not apply to stairways, lifts,
landings and lockboxes. Further, the average lakeshore setback shall apply only to
classified lakes and shall not apply to tributaries. The average lakeshore setback
line shall be a straight line connecting the most lakeward protrusions of the
residence buildings on the immediately adjacent lakeshore lots.
a. In instances where the average lakeshore setback can not be met,
administrative approval may be granted at the discretion of the planning
director provided no lake views of an adjacent lakeshore lot are obstructed
and adjacent neighbors provide written approval.

property requires variances to put their property to a similar single family
dwelling use, due to the fact tha� no buildable area exists with regard to
present day zoning ordinances. f also understand that the City of Orono
must, and wilf, grant variances for this to happen. I have reviewed the
design they are proposing, which I unders#and will have a lower ridge line
than their existing home, and f have no objection to their proposed project.

Melanie,
I have reviewed the grading plan for the proposed permit (plan dated 5/30/12) and have the following comments:
• The plans show retaining walls being installed up to the 75' setback line, but does not show any proposed
contours next to these walls. Grading will be required to take place next to these walls which will extend into
the 0-75' zone. The proposal should indicate how much earth will be moved and if more than 10CY of material
is planned to be moved, a Conditional Use Permit would be required.
• The retaining walls by the lake do not have the correct spacing between the walls and require plans and
specification signed by a professional engineer. The spacing between the walls need to be 2x the height of the
taller wall. Currently the plan shows a height of the middle wall at 3.5' so the spacing between the walls needs
to be a minimum of 7' or provide a plan signed by a registered engineer. The walls are currently shown to be
approximately 4-5' apart (scaled off).
• A portion of the retaining wall by the driveway is called out to be 4' in height. If changes are made in the field
and the final height of the wall exceeds 4',the applicant will be required to submit engineering plans for the
wall.
• Just north of the City's sanitary sewer lift station, there is an area of significant erosion. In order to minimize the
impact of the work to the homeowner,the City would want to work with the builder to correct this issue during
construction of the home. Currently,the City does was not planning on doing this work immediately, but if the
contractor would be willing to assist our Public Works Department, we would be willing to correct this issue this
year. The help needed would be to create an access path to the area of the erosion path and would require a
few trees to be removed. In turn the City would be willing to provide the labor, materials, and equipment to
correct the erosion currently taking place.

Dear Mr. Kopfmann:
This letter is being sent to discuss our typical engineered section for the proposed boulder retaining walls
at the McGlynn Residence project(Government Lot 4, Section 8-117-23) in Orono, Minnesota. This
design is based on Topographic Survey prepared by Gronberg&Associates dated May 30, 2012.
I understand that the proposed 3-tiered boulder retaining walls will have a ma�cimum exposed height of 4
feet each. A minimum wall batter/setback of 18° (�3 inches/vertical foot) should be used. Slopes as
noted below will be present at the top and bottom of the walls. No groundwater or other surcharge loads
have been designed for the walls. If site conditions vary from what is shown on the Typical Section,
please call me to discuss other options.
Refer to industry standard practice references for installation information, specifications, and details.
- Boulders shall be placed to avoid continuous joint planes in vertical or lateral directions.
- Each boulder shall bear on two or more rocks below it with good flat-to-flat contact.
- Compact any structural fill place behind the drainage zone to 95% standard proctor.
- Install woven landscape fabric behind the boulders to limit soil migration through the wall face.
- Drainage stone shall consist of clean 3/4" to 1.5" crushed stone
The design of the wall system assumes the following:
- Soil conditions: Sandy Silt/Clay,friction angle= 30.0 degrees,unit weight of 120.0 lb/ft3
- Allowable soil bearing capacity=2,500 psf
- No external surcharge loading behind walls
- Slope at bottom of wa11 =5:1; Slope at top= 10:1
- Minimum embedment depth=6"

Township 117 North, Range 23, lying North of a line drawn East perpendicular to the West line of said lot from a point
on said West line distant 1022.8 feet north from the West Quarter corner of said Section. Subject to the 20 foot
permanent easement for sanitary sewer and lift station purposes in favor of the City of Orono as contained in Hennepin
County Recorder pocument No. 4235108, Hennepin County Minnesota.
2. Owners request the City to review this application.
3. The City will commence its review of the application and incur costs associated with said review
only if the Owner establishes an escrow to ensure reimbursement to the City of its costs.
NOW THEREFORE, THE PARTIES AGREE AS FOLLOWS:
1. DEPOSIT OF ESCROW FUNDS. Contemporaneously with the execution of this Escrow
Agreement, the Owners shall deposit $2,500 with the City. All accrued interest, if any, shall be paid to the City to
reimburse the City for its cost in administering the escrow account.
2. PURPOSE OF ESCROW. The purpose of the escrow is to guarantee reimbursement to the City
for all out-of-pocket costs the City has incurred (including planning, engineering, in excess of $500, or legal
consultant review) or will incur in reviewing the plan. Eligible expenses shall be consistent with expenses the
Owners would be responsible for under a building permit application. The escrow will also guarantee
reimbursement to the City for all out-of-pocket costs the City has incurred to assure that the work is completed in
accordance with the Stormwater Pollution Prevention Plan and the provisions of Orono City Code Chapter 79.
The financial security may also be used by the City to eliminate any hazardous conditions associated with the
work and to repair any damage to public property or infrastructure that is caused by the work (including planning,
engineering, or legal consultant review) associated with permit#s 2012-00489 8� 2012-00490 if compliance with
the approved building permit is not accomplished.
3. MONTHLY BILLING. As the City receives consultant bills for incurred costs, the City will in turn
send a bill to the Owners. Owners shall be responsible for payment to the City within 30 days of the Owners'
receipt of bill.
4. DISBURSEMENT FROM ESCROW ACCOUNT. In the event that the Owners do not make payment
to the City within the timeframe outlined in#3 above, shall issue a Stop Work Order until the Owners pay all expenses
invoiced pursuant to #3. The City may draw from the escrow account without further approval of the Owners to
reimburse the Ciry for eligible expenses the City has incurred.
5. CLOSING ESCROW. The Balance on deposit in the escrow, if any, shall be returned to the
Owners when the review has been completed and written notification is received from the Owners requesting the
funds.
6. CERTIFY UNPAID CHARGES. If the project is abandoned by Owners, or if the eligible expenses
