GRANTING A VARIANCE
TO THE ORONO, MINNESOTA, CITY CODE
SECTION 78-420
FILE NO. 10-3439
WHEREAS, Sean Joseph McLean and Marie Theresa McLean, husband
and wife, (hereinafter "Owners") are the owi�ers of the property located at 25 Cygnet P(ace
��ithin the City of Orono (hereinafter "City") and legally described as: Lot 1 B1ock 1 Swan
Lake Addition Hennepin County, Minnesota (hereinaiter "the Property"); and
WHEREAS, Sean and Marie MeLean have made application to the City for a
variance to Orono Code Section 78-420 for a setback variance to construct an open entry
porch with a 36 foot setback from CyQnet Place when a 40 foot setback exists and a �0 foot
setback is required as well as approval to chanQe the roof line over the existing entry porch
and portion of the �arage� within the �0 foot setbacks from Cygnet Place and Watertown
Road: and �
WHEREAS, after due published notice and mailed notice in accordance with
Minnesota Statutes and the Orono, Minnesota, City Code, the Orono Plannin� Commission
held a public hearinQ on January 19, 2010, at which times all persons desirin� to be heard
concernin� this application were given the opportunity to speak thereon.
NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono,
Minnesota:
FI�"DINGS
1. This application was reviewed as ZoninQ File #10-3439.
2. The Property is located in the RR-1B zoninQ district, where 2 acres is the
minimum lot area and 200 feet is tl�e minimum lot width. The Pro�erty is
approximately 0.81 acre in area and 1�� feet in width.
3. The Plannin� Commission reviewed this application on January 19, 2010 and
on a vote of 6 - 0 recommended approval of the request, based on the
followin� findin�s:

a. The house was constructed in 1970 and confonned to the setback
requirements. It was made non-conforming by the rezoning of the property
in 1975 to RR-1B.
b. The new entry porch will allow the existing entry porch to be converted
into an entry room. The enlaraed entry will eliminate the current unsafe
and undersized entry and allow a direct connection between the living
space and the attached garage.
c. The enclosure of the existing porch and the addition of a new porch as �vell
as the chan�es in the roofline will allow the owners to make a simple
update their residence that will improve its livability while enhancing the
neighborllood.
4. The City Council has considered this application including the findings and
recommendation of the Planning Commission, reports by City staff, comments
by the applicants and tl�e public, and the effect of the proposed variance on the
health, safety and welfare of the community.
�. The City Council finds that the conditions existing on this property are peculiar
to it and do not apply generally to other property in this zoning district; that
�ranting the variance would not adversely affect traffic conditions, light, air
nor pose a fire hazard or other danger to neighboring property; would not
merely serve as a convenience to the Owners but are necessary to alleviate a
demonstl-able hardship or difficulty; is necessary to preserve a substantial
property right of the Owners; and would be in keeping with the spirit and
intent of the Zonin� Code and Comprehensive Plan of the City.
CONCLliSIONS, ORDER AND CONDITIONS
Based upon the above findinas, the Orono City Council hereby grants a variance to Orono
Code Section 78-420 to allow�an opel7 enhy porch with a 36 foot se�back from Cy�net Place
when a 40 foot setback exists and a 50 foot setback is required and to allow changes to the
roof lines over the existing entry porch and portion of the gara�e within the �0 foot setbacks
from Cygnet Place and Watertown Road, subject to the followin� conditions:

1. Council approval is based on the site and house plans submitted bc the Owners
and annotated by City staff, attached to tliis Resolution as Exhibits A and B.
Anv amendments to these plans may require further Planning Commission and
City Council review.
2. Authorities granted bv this resolution run with the Propertv not with the
owners, but are permissive only and must be e�ercised bv obtainin� a buildin�
permit for the new construction before January 2�, 2011 or the variance will
expire on that date.
3. Violation of or non-compliance with anv of the terms and conditions of this
resolution shall constitute a violation of the zoning code, shall automaticallv
terminate anv authority �ranted herein, and shall be punishable as a
misdemeanor.
4. The undersigned Owners have read, understand and hereby agree to the terms
of this resolution and on behalf of their heirs, successors and assians. herebv
a�ree to the recordin� of this resolution in the chain of title of the property.
