(hereinafter "Owners") are the owners of the property located at 25 Cygnet Place within the City of Orono (hereinafter "City") and legally described as: Lot 1 Block 1 Swan Lake Addition Hennepin County, Minnesota (hereinafter "the Property"); and ��VHEREAS, Sean and Marie MeLean have made application to the City for a variance to Orono Code Section 78-420 for a setback variance to construct an open entry porch with a 36 foot setback from Cygnet Place when a 40 foot setback exists and a �0 foot setback is required as we11 as approval to change the roof line over the existin� entry porch and portion of the Qara�e within the �0 foot setbacks from Cygnet Place and Watertown Road: and y WHEREAS, after due published notice and mailed notice in accordance with Minnesota Statutes and the Orono, Minnesota, Citv Code, the Orono Plannin� Commission held a public he�arin� on January 19, 2010, at which tiines all persons desiring to be heard concernin�this application were given the opportunity to speak thereon. NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, Minnesota: FINDINGS 1. This application was reviewed as Zoning File �10-3439. 2. The Property is located in the RR-1 B zoning district, where 2 acres is the muiimum 1ot area and 200 feet is the minimum lot width. The Property is approximately 0.81 acre in area and 1�� feet in width. 3. The Plannin� Commission reviewed this application on January 19. 2010 and on a vote of 6 - 0 recommended approval of the request, based on the followina findinQs: PaQe 1 of 4 � �� O O �'��a;a�- ; CITY of ORONO � � ,� �� � �� �� �`���� �.� RESOLUTION OF THE CITY COUNCIL ��kESHOg'� N0. 5 7 � 9 a. The house was constructed in 1970 and conformed to the setback requirements. It was made non-confonning by the rezoning of the property in 1975 to RR-1B. b. The new entry porch will allow the existing entry porch to be converted into an entry room. The enlarged entry will eliminate the current unsafe and undersized entry and a11ow a direct connection between the living space and the attached garage. c. The enclosure of the existing porch and the addition of a new parch as well as the chan�es in the roofline will allow the owners to make a simple update their residence that will improve its livability while enhancing the neighborhood. 4. The City Counci] has considered this application including the findin�s and recommendation of the Planning Commission, reports by City staff, conzments by the applicants and the public, and the effect of the proposed variance on the health, safety and welfare of the community. 5. The City Council finds that the conditions existing on this property are peculiar to it and do not apply generally to other property in this zoning district; that granting tlle variance would not adversely affect traffic conditions, light, air nor pose a fire hazard or other danger to nei�hboring property; would not merely serve as a convenience to the Owners but are necessary to alleviate a demonstrable hardship or difficulty; is necessary to preserve a substantial property right of the Owners; and would be in keeping with tl�e spirit and intent of the Zoning Code and Comprehensive Plan of the City. CONCLUSIONS, ORDER AND CONDITIONS Based upon the above findings, the Orono City Council hereby ��-ants a variance to Orono Code Section 78-420 to allow an open entry porch with a 36 foot setback from Cygnet Place when a 40 foot setback exists and a 50 foot setback is required and to allow changes to the roof lines over the existing entry porch and portion of the garage within the �0 foot setbacks from Cygnet Place and Watertown Road, subject to the following conditions: Page 2 of 4 � O � O O �'��aa_.-., ,� � CITY of ORONO �a ��✓- ti ��� ��� �p~' RESOLUTION OF THE CITY COUNCIL `9kESH04' ►vo. 5 9 � 9 1. Council approval is based on the site and house plans submitted by the Owners and annotated by City staff, attached to this Resolution as Exhibits A and B. Any amendments to these plans may require further Planriina Commission and City Council review. 2. Authorities granted by this resolution run with the Property not with the owners, but are permissive only and must be exercised by obtaining a buildina permit for the new construction before January 25, 2011 or the variance will expire on that date. 3. Violation of or non-compliance with any of the terms and conditions of this resolution shall constitute a violation of the zoning code, sha11 automaticallv terminate any authori�y �ranted herein, and shall be punishable as a misdemeanor. � 4. The undersi�ned Owners have read, understand and hereby agree to the terms of this resolution and on behalf of their heirs, successors and assians, herebv a�ree to the recording of this resolution in the chain of title of the property.
