The rights of individual on whom the data rs s�ored or ro be stored shall be as set forth in this section. Subd.2. Information required to be given individuaL An indivrdual asked to supply private or confidentral data concerning himself shall be rnjormed of. (aJ the purpose and intended use ojthe requested data wrthin the collecting state agency,political subdivision,or statewide system;(b)whether he may refuse or is legally requrred to supply the requested data;(c)any known consequence arising from his supplying ar refusing to supply prrvate or confidential data;and(d)the identiry ojother persons or entities authorized by state or federal law to receive Jhe data. This requirement shal!not apply when an individual is asked to supply investigative data,pursuant to sectian 13.82, subdivision S, to a law enforcement o�cer. The commissioner of revenue may place the notice required under thrs subdivision in the indrvidual income tax or property tax rejund rnstructions rnstead ofon those forms. Subd.3. Access to data by individual. Upon request to a responsible authority,an individual shall6e informed whether he is the subject of stored data on individuals, and whelher it is classified as public,private or confrdential. Upon his further request,an individua!who is the subject of stored private or public data on indivrduals shall be shoivn the data ivithout any charge to him and, if he desires,shal!be informed of the content and meanrng of that data. After an individual has been shotivn the private data and rnjormed of rts meanrng, the data need not be disclosed!o him for six months thereafter unless a dispute or actron pursuant to this sectron is pending or additiona!data on the individual has been co!lected or created. The responsible authoriry shall provide copres oJthe private or public data upon request by the individual subject of the data. The responsible authoriry may require the requesting person to pay the actua!costs of making,certifying,and compiling the copies. The responsible authorrty shall camply immediately,ifpossible,with any request made pursuant ta this subdivision,or withinftve days of the date ojthe request,excluding Saturdays,Sundays and lega!holidays,rf immediate compliance is not possible. If he cannot comply with the request within that time,he shallso inform the individual,and may have an additional five days withrn tivhich to comply wrth the request,excluding Saturdays,Sundays and legal holydays. Subd.4. Procedure when data is not accurate or complete.An individual may contest the accuracy or completeness ofpublrc or private dala concernrng himself. Ta exercise this right, an individua!shall not�in writing the responsible authorrty describrng the nature of the disagreement. The responsible authority shall within 30 days either: (a)correct the data found to be inaccurate or incomplete and attempf to notify past recipients of inaccurate or incomplete data,including recipients named by the individual;or(b)not�the individua!that he believes the data to be correct. Data rn dispute shall be disclosed only if the rndividua!'s sratement of drsagreement is included tivith the disclosed data. The determination of the responsible authorrty may be appealed pursu4nt to!he provisions oJthe adminrstrative procedure act relating to confested cases.
