A RESOLUTION GRANTING VARIANCES TO ORONO CODE SECTIONS 78-1288 AND 78-1511 FILE NO. 08-3386 WHEREAS, Jasin Larson, a single person. (hereinafter "Owner") is the owner of the property located at 3485 Crystal Place within the City of Orono (hereinafter "City") and legally described as: Lot 8, Block 2, Navarre Heights, Hennepin County, Minnesota(hereinafter "the Property"); and WHEREAS, the Owner has made application to the City for a variance to Orono Code Section 78-1288 to allow 39.3 percent hardcover in the 500 to 1,000 foot zone of the Property when the maximum allowed is 35 percent; and WHEREAS, the Owner has made application to the City for variances to Orono Code Section 78-1511 to place a detached garage on the Property five feet from the east property line and south property line when 10-foot setbacks are required; and WHEREAS, after due published notice and mailed notice in accordance with Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning Commission held a public hearing on November 17, 2008, at which times all persons desiring to be heard concerning this application were given the opportunity to speak thereon. NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, Minnesota: FINDINGS 1. This application was reviewed as Zoning File#08-3386. 2. The Property is located in the LR-1C-1 zoning district, where 0.5 acre is the minimum lot area and 100 feet is the minimum lot width. The Property is approximately 0.15 acre in area and 50 feet in width. 3. The Planning Commission reviewed this application on November 17, 2008 and on a vote of 4 - 2 recommended approval of the variances, based on the following findings: Page 1 of 4 041v ().1/1 ) ==A Q0.- CITY of ORONO vayt t, l,, ti Y.3,4 .*1'0°- IP RESOLUTION OF THE CITY COUNCIL ` iCESITOSiv NO. 8 25 a. The property is a year-round residence that has no garage. It is a hardship to not have a garage. b. An attached garage would have to be located well forward of the other houses on the block and thus be out of character with the surrounding area. c. Because of the location of the house the setback variances are necessary to provide vehicle access to the garage and allow drainage to flow between the house and driveway. d. The applicant proposes to remove hardcover, including a shed and portion of the house. 4. The City Council has considered this application including the findings and recommendation of the Planning Commission, reports by City staff, comments by the applicants and the public, and the effect of the proposed variances on the health, safety and welfare of the community. 5. The City Council finds that the conditions existing on this property are peculiar to it and do not apply generally to other property in this zoning district; that granting the variances would not adversely affect traffic conditions, light, air nor pose a fire hazard or other danger to neighboring property; would not merely serve as a convenience to the Owner but necessary to alleviate a demonstrable hardship or difficulty; is necessary to preserve a substantial property right of the Owner; and would be in keeping with the spirit and intent of the Zoning Code and Comprehensive Plan of the City. CONCLUSIONS, ORDER AND CONDITIONS Based upon the above findings, the Orono City Council hereby grants variances to Orono Code Sections 78-1288 to have 39.3 percent hardcover in the 500 to 100 foot zone when the maximum allowed is 35 percent and to Orono Code Section 78-1511 to allow a detached garage five feet from the south and east property lines when 10-foot setbacks are required, subject to the following conditions: Page 2 of 4 et° 4 =A 44 , CITYof ORONO .�jd, �'� ! Council approval is based on the site and garage plans submitted by the Owner and annotated by City staff, attached to this Resolution as Exhibits A and B. Any amendments to these plans may require further Planning Commission and City Council review. 2. Hardcover in the 500-1000' zone shall be limited per the proposed site plan and hardcover allowance summary as depicted on Exhibit C. The Owner is advised that any future requests to increase hardcover or change the nature of existing/approved hardcover shall require City approval. 3. The Certificate of Occupancy shall not be issued until an as-built grading plan verifying compliance with engineering and zoning approvals has been submitted and approved. Any deviation from the approved plan may require Planning Commission and/or City Council review. 4. Owner shall not place any plastic or fabric liner material under any landscaping on the property to ensure their permeability as non-hardcover surfaces. 5. Authorities granted by this resolution run with the Property not with the owner, but are permissive only and must be exercised by obtaining a building permit for the new construction before March 23, 2010 or the variance will expire on that date. 6. Violation of or non-compliance with any of the terms and conditions of this resolution shall constitute a violation of the zoning code, shall automatically terminate any authority granted herein, and shall be punishable as a misdemeanor. 7. The undersigned Owner has read, understood and hereby agrees to the terms of this resolution and on behalf of his heirs, successors and assigns, hereby agree to the recording of this resolution in the chain of title of the property.
