The City is in receipt of your building permit application which was received by this office
on September 29, 2009. This is a permit for construction of a 3-season porch addition
with decks. Your application is incomplete. Additionally, the City's wetland regulations
and wetland buffer requirements may be triggered by the project. Please review the
enclosed information sheet regarding Construction near a Wetland and follow the
instructions provided. The following items must be submitted or revised in order for your
application to be considered complete and for the plan review to continue:
1) Certificate of Survey. Please provide a revised copy of a signed and dated
Certificate of Survey meeting the City's survey requirements (enclosed).
2) Wetland Delineation Report. If applicable.
3) Escrow 8� Escrow Agreement. Building permits involving grading and/or review by
the City's engineer require submittal of an escrow and an escrow agreement. The
purpose of the escrow is to guarantee reimbursement to the City of out-of-pocket costs
incurred during the review of your plans. Additionally this escrow will guarantee
conformance with City Code Chapter 79 relating to erosion control and stormwater.
The required escrow amount for this project would be $2,500. The escrow agreement
is enclosed. The property owner must sign the escrow agreement and submit a check
for$2,500.

He wanted more information on a wetland delineation. He said he read the `construction near a wetland' and
didn't feel that he met those requirements. In fact the homeowner told him the wetland wasn't his property, it
was the Associations.
Evelyn was in my office when I was returning his call, so I asked her why it wasn't clear on your letter if he
needed one or not. She looked at the survey with me and we informed him the wetland map of the city showed
there was wetland on the property and the survey from 2000 indicated it also.
He then said he was only replacing a deck that was there and adding a small 3-season porch. I found the permit
from 2000, but it was only hand drawn. I informed him City requirements have changed since then and we
need an updated survey as the one we had showed `proposed home'. I went on to say, "make sure the survey
includes grading" and he cut me off saying that wasn't necessary as he wasn't doing any excavating. I said, "so
you're using the same footings that are currently there" and he said, "well...no".

Subject: New House Construction 175 Crystal Creek Road
Dear Mr. Vogelgesing;
RVC Homes is currently building a new house in the Crystal Creek Subdivision. Crystal Creek
Road is a private road that is owned and maintained by the Crystal Creek Homeowners
Association. The original bituminous curb that was installed by the subdivision developer was '
defective and was replaced in August. Shortly after installation, this new curb was damaged by
construction vehicles associated with the new house construction. My understanding is that you
are a���are of the need to correct this situation per previous conversations with Lyle Oman, City
of Orono Building Official. A site inspection today indicates that the curb replacement has not
. yet been completed. The curb along the entire lot frontage is damaged from construction vehicle
traffic and needs to be replaced
It is now too late in the construction season to install new bituminous curb and still have a high
quality product. To ensure completion of the necessary curb replacement, next year during
suitable ���eather conditions, the City of Orono is requesting that a financial guarantee be
provided to the City before a"Certificate of Occupancy"' is issued far the house. This financial
guarantee needs to be either a financial escrow or letter of credit for 150°% of the estimated curb
replacement costs. This 150% financial guarantee is the amount that is used on all development
projects in the City of Orono.

The esUmated cost for removal and replacement of bituminous curb is $12.00 per foot. This is
based on the $10.00 per foot cost for the 2,600 feet of curb that was replaced in August plus an
inflation factor and the smaller quantity of curb in this project. The lot frontage is 280 feet for a
total of$3,360 plus the additional 50% cost results in a$5,000 financial guarantee being
required.
