Home My WebLink About#5598-vacating drainage/utility easements-2007 , , � ��2��`t ' �� ¢Oq�1 � 0 8�4(��? 3 � �S��(vG A O J�_ loqo9l� 'y1 �CV� � o�f'y�(o�i7 OO I � 49'?�� '�� CITY of ORONO ��"��2�� a. - � ��::s'`', ti ti RESOLUTION OF THE CITY COUNCIL �L`�kESH��G No. 5 5 9 g A RESOLUTION VACATING CERTAIN DRAINAGE AND UTILITY EASEMENTS WITHIN THE PLATS OF CRYSTAL CREEK; MEYER DAIRY ADDITION; SPRUCE ACRES; ORONO OAKS; AND WOOD END ACRES IN THE CITY OF ORONO, HENNEPIN COUNTY, MINNESOTA WHEREAS, the City of Orono is a municipal corporation or�anized and existing under the laws of the State of Minnesota; and WHEREAS, as part of the MnDOT Highway 12 relocation project, the Minnesota Department of Transportation (MnDOT) acquired certain residential properties, portions of which will Uecome owned by the Burlington Northern and Santa Fe Railway Company(BNSF) for railroad right-of-way purposes; and WHEREAS, as part ot the pending ownership transfer, BNSF has required MnDOT to have existing drainage and utility easements vacated within the new railroad right-of- way where they no longer have any public purpose; and WHEREAS, on March 21, 2007, Lee Williams on behalf of MnDOT (hereinafter the "petitioner") filed a petition and application with the City of Orono (hereinafter "the City") requesting the vacation of certain portions of the Drainage Easements and Drainage & Utility Easements dedicated within Outlot B, CRYSTAL CREEK; within Lots 3, 4, and 7, Block 1, MEYER DAIRY ADDITION; within Lots 1, 2, and 3, Block l, SPRL`'CE ACRES; witliin Lots 1, 2, 3, 4, 5, and 6, Block l, ORONO OAKS; and within Lots 1 and 2, Block 1, WOOD END ACRES; and WHEREAS, the portions of said Easements to be vacated are formally and legally described in Exhibit A attached hereto; anci WHEREAS, after due published and posted notice, a public hearing was held by the Orono City Council on April 9, 2007 regarding said vacations and all interested persons were given an opportunity to be heard; and 1 � O� O 4 '��;a: C ITY of ORONO � � � � ::�?"�' � � G RESOLUTION OF THE CITY COUNCIL �`�kEsKo4� rvo. 5 5 9 8 WHEREAS, after due standing and consideration, the City Council of the City of Orono finds that said vacations as proposed are in keeping with the public interest and in consideration of the following findings: 1. The portions of dedicated easements to be vacated no longer have a public benefit � because the public drainage and utility purposes no longer exist; the approved topographic chan�es within the railroad con•idor have resulted in the obliteration, removal or relocation of all pre-existing drainageways, wetlands, utility lines, etc. in the area of the easements to be vacated. 2. The vacation of said easements will not eliminate access to any adjoining or nearby properties. 3. Utility companies have been notified of the proposed vacations and none have indicated opposition to the vacations. 4. The City does not intend to use the easements to be vacated for any fiiture public puipose. NOW, THEREFORE, BE IT RESOLVED, that the petition of MnDOT is hereby granted by the Council of the City of Orono and that the portions of easements as legally described and depicted in Exhibits A and B attached hereto, are hereby vacated.
