Sea 13.04 RIGHTS OF SUBJECTS OF DATA
Subd. 1. Type of data. The righu of individual on whom the data is stored or to be stored shall be as set forth in this section.
Subd.2. Information required to be given individual. An individual asked to supply private or co�dential data concerning himself shall
be informed of: (a)the purpose and intended use of the requested data within the collecang"state agency,political subdivision,or statewide system;
(b)whether he may refuse or is legally required to supply the requested data;(c)any l�own consequence arising from his supplying or refusin�to supply
privat�or confidenrial data;and(d)the iden�ry of other persons or entides authorizzd by statz or fzderal law to receive the data. This requirzment shall
no[apply when an individual is asked to supply investigative data,pursuant to section 13.82, subdivision 5,to a law enforcemen[officer.
The commissioner of revenue mav p]ace the noace required under this subdivision in the individual income tax or property taz refund
instrucdons instead of on those forms.
3ubd.3. Access to data by individual. Upon request w a responsible authoriry,an individual shall be informed whether he is the subject
of stored data on individuals,and whether it is classified as public,private or confidential. Upon his further request,an individual who is the subject
of stored private or public data on individuals shall be shown the data without any charge to him and, if he desires, shall be informed of the content
and meaning of that data. After an individual has been shown the private data and informed of iu meaning,the data need no[be disclosec�to him for
six months thereafrer unless a dispute or action pursuant to this secdon is pending or additional data on the individual has been collected or created.
The responsible authority shall provide copies of the private or public dara upon request by the individual subject of the data. The responsible authoriry
may require the requesting person to pay the actual cosu of making,certifying, and compiling the copies.
The responsible authority shall comply immediately,if possible,with any request made pursuant to this subdivision,or within five days of
the date of the request,excluding Saturdays,Sundays and legal holidays,if immediate compliaace is not possible. If he canno[comply with the request
within that time,he shall so inform the individual,and may have an addiaonal five days within which to comply with the request,ezcluding 3aturdays, •
Sundays and legal holidays.
Subd.4. Procedure when data is not accurate or complete. An individual may contest the accuracy or completeness of public or private
� data conceming hicnself. To ezercise this right,an individual shall nodfy in wriang the responsible authoriry describing the nature of the disagreement.
The responsible authoriry shall within 30 days either: (a)correct the data found to be inaccurate or incomplete and attempt to noafy past recipients of
inaccurate or incomplete data, including recipienu named by the individual;or(b)notify the individual that he believes the data to be correct. Data
in dispute shall be disclosed only if the individual's statement of disagreement is included with the disclosed data.
The determination of the responsible authority may be appealed pursuant to the provisions of the administraave procedure act relating to
contested cases.

Notes:
1 Floors over unheated spaces.
For floors of heated or mechanically cooled spaces over unheated
spaces, the overall U-Value for the floor shall not exceed 0.05. For
floors over outdoor air, such as overhags, the overall U-Value for the
floor shall meet the same requirement as for roofs, U-Value of 0.04.
2 Slab-on-grade floors.
For slab-on-grade, the insulation around the perimeter of the exposed
floor shall have a minimum R-Value of 6.4. The insulation must
extend downward from the top of the slab a minimum of 3'-6"or
downward to the bottom of the slab then horizontally beneath the
slab for an equivalent distance.
3 Vapor Barriers
The maximum perm rating for the vapor barrier is 0.1. A minimum of
4 mil polyetheline, or equal, is required to achieve this. The vapor
barrier must be continuous with all joints overlapped and made over
framing members or blocking.

2 The Energy Code requires that, if the floor above the basement or
crawi space is not insulated,the foundation wall must be insulated.
Either the foundation must have a minimum R-10 insulation applied
from the top of the foundation to the frost line or a minimum R-5
insulation appiied over the entire foundation wall. The R-Value
specified is for the insulation material only.
3 If rigid foam insualtion is to be applied to the exterior of the foundation
wall, the above grade portion must be protected from the sun, the
weather and physical abuse.
