is the owner of the property located at 3415 Crystal Hay Road within

permit the construction of an attached qarage and deck which would

3. The Orono Planning Commission reviewed this applicat3on on
February 18, 1986, and recommended approval of the proposed
variance based upon the following findinqss
A) Applicant's hardship is that there is no existing usable

cently granted elsewhere in the neiqhborhood. �`

C) The proposal includes a sliqht decrease in the 0-75' �
hardcover. �

reports by City staff, comments by the applicant and the effert �}

5. The City Council finds thet the conditfons exis�inq on thia
property are peculiar to ft and do not apply qenerally to other
property in this zoninq district; that grantinq the variance
would not adversely affect traffic conditiona, liqht, air nor �,. ,
pose e fire hazard or oth�r danqer to neiqhborinq property= �rould "'�
not merely serve as a convenience to the applicant, but is
necessary to alleviate a demonstrable hardship or difficultyt is
neaessary to preserve a substantial property right of the appli-

lakeshore setback line, and driveway apron of approximately �

�' qrantinq of the variance is 3425 square feet or 28.Se. ApplicAnt �'
is notifiec3 that eny future udditions of hardcover on the �;
property will likely not be approved by the City without �;
concurrent removals of existing hardcover.

3. As a gart of this variance approval, applicant shall remove 6''
the followinq items of existinq hardcover prior to final �'
� inspection of the additions lalso see Exhibit A attached� :

a) removal of rear garaqe shed (222 squere feet) , €
b) removal of 25' r.ear portion of qravel driveway (250
square feet) ,
c) removal of front qravel parking area to retain a maximum
width of 10' for driveway purposes only (removal of �,;;
approximately 312 square feet in 75-250' sone).

4. The deck a 1 1 owed on th� f ront of the house sha 11 be no hiqher

enclosure of the deck will firet require a variance to the
avere�qe lakeshore s�etback.
5. Authorities grnnted by this variance run with the property
� not with the applicdnt, but are permissive only and must be
exercised by applicAtion for a buf ldinq permit within one year of
the date of Council approval, or this variance will expire on
that date (February 24, 1987).
6. Violr�tion of or non-ctimplianc� with any of the terms a�nd
conditfons of this variance shall constitute a violation of the
zoning code, shell automatically terminate any suthority qranted•,
herein, and ahall tae punishable as a misdemeanor.
7. The undersigned applicant has read, understood and hereby
aqrees to the terms of this resolution and on behalf of himself,
his heirs, succesaors and assiqns, hereby aqrees to the recordinq
of thia resolution in the chain of title of the property.
