TO ML�IICIPAL ZONING CODE
SECTION 10.22, SUBDIVISIOl�' 2; SECTION 1(�.SG

`VH�REAS,Gary Gniffke and Larry Palm on behalf of Ace Properties(hereinafter
"the applicant'') is owner of the property located at 3349 Crystal Bay Road within the City of Orono
(hereinafter "the City") and legally described as follows:
Lot 10, Wallace's Addition to the Village of Nlinnetonka Beach, Hennepin Courity,
Minr.esota (hereinafter "the property"); and
WHEREAS, after due published notice and mailed notice in accordance with
t�linnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning �
Commission held a public hearing�n August 21,2000,at which time all persons desiring to be heard
concernin� this application were giver.the opportunity to speak thereon; and
�VHEREAS, the app;icants have applied to the City for variances to Municipal
Zonina Code Section 10.22, Subdivision 2 and Section 10.56, Subdivision 16(L)to permit 836 s.f.(29%)
hardcover in the 0-75' setback where 768.d s.f. (27%) etists and none is allo«�ed, and 972 s.£ (47%)
hardcuver in the 7�-2�0'setback�vhere 994 s.f.(48%)esists and 25%is allowed;Section 10.55,Subdivision
3 to permit the proposed residence 70'from the 929.4' lakeshore where a minimum setback of 7�'is required;
Section 10.?5, Subdivision 6 (B)to permit an 8' rear yard setback«�here 30' is required and to permit ne�ti�
construction on a lot less than .5 acre minimum in the LR-lC district.

2. This property is located in the LR-1 C Zoning District,where 1/2 acre is the minimum
lot area. The property consists of 4,901 s.f.
;. The Orono Planning Commission review�ed this application on August 24,2000 and
recommended approval by a vote of 6 to 0.
4. The Planning Commission made the follo�ving findings of fact:
A. The property has been developed for many years. The property owners have
stated the existing residence is in need of major repairs and would prefer to
construct a new house rather than remodel and add to the existing house. The
variances are required due to the small size of the lot. The lot size is .11 acre
in a '/2 acre (.5) zoning district.
B. The house would meet the 10' side setback requirements.
C. It is not possible to meet a rear setback of 30' and maintain an adequate
setback to the lake or Cry�stal Ba�•Road. Proposed is an 8' setback to the rear
property line.
D. The lot is only 4,901 s.f. �vhich �vas platted and developed prior to the
adoption of the zonina ordinance. It ��-ould not be possible to purchase
additional land from the adjacent residential properties as they are similar in
size to the subject lot.
E. To establish an adequate setback to the lakeshore and Crystal Bay Road, an
8' setback to the rear property line is appropriate. The property to the rear is
a 100' railroad right-of-«-ay, not residential property.
5. The City Council finds that the conditions existing on this property are peculiar to
it and do not apply generally to other property in this zonin� district; that granting
the variance would not adversely affect traffic conditions, light, air, nor pose a fire
hazard or other danger to neiahborinQ property; would not merely serve as a
convenience to the applicants, but is necessary to alleviate a demonstrable hardship
or difficulty; is necessary to preserve a substantial property ri�ht of the applicants;

and would be in keeping with the spirit and intent of the Zoning Code and
Comprehensive Plan of the City.
6. The City Council has considered this application including the findings and
recommendations of the Planning Commission,reports by City Staff,comments by
the applicants and the effect of the proposed variance on the health, safety and
�velfare of the community.
CONCLUSIONS, ORDER, AND CONDITIONS
Based upon one or more of the above findings, the Orono City Council hereby grants
variances to Municipal Zoning Code Section 10.22,Subdivision 2 and Section 10.56,Subdivision 16(L)
to permit 836 s.f. (29%) hardcover in the 0-75' setback�vhere 768.4 s.f. (27%) esists and none is allo�ved,
and 972 s.f.(47%)hardcover in the 75-250'setback where 994 s.f.(48%)exists and 25°/o is allowed;Section
10.», Subdivision 8 to permit the proposed residence 70' from the 929.4' lakeshore where a minimum
setback of 75' is required; Section 10.2�, Subdivision 6 (B) to permit an 8' rear yard setback where 30' is
required and to permit new construction on the non-conforming lot less than .5 acre in the LR-1C district.
Approval is subject to the following conditions:
1. Council approval is based on the site plan submitted by the applicant attached to this
resolution as E�chibit A. Any amendments to the site plan may require further
Planning Commission and City Council review.
2. It is the intent of the City Council that variances to develop the lot to exceed allowed
hardcover would not be looked upon favorably.
3. The roof pitch of the structure shall not exceed 10:12.
4. Authorities granted by this variance run with the property not with the applicant,but
are permissive only and must be exercised by application for a building permit within
one year of the date of Council approval, or this variance �vill expire on that date
(August 28, 2001).
5. Violation of or non-compliance with any of the terms and conditions of this variance
shall constitute a violation of the zoning code, shall automatically terminate any
authority granted herein, and shall be punishable as a misdemeanor.

6. The undersigned applicants have read, understood and hereby agree to the terms of
this resolution and on behalf of themselves, their heirs, successors and assigns,
hereby agree to the recording of this resolution in the Chain of Title of the property.
Adopted by the City Council of the City or Orono, ?`.�innesota at a regular meeting
held on the 28th day of August, 2000.
