RE: Request for Appeal for an Unreported Demolition at 3345 Crystal Bay Rd
Dear Mr. Willett:
I am writing to request an appeal for an unreported demolition credit at 3345 Crystal Bay
Road.
We recently had an audit by the Metropolitan Council on Apri123, 2008. The audit went
back to 2005. We have also had several properties double checked to make sure all
records match these were not a part of the actual audit.
Until this audit was done, we did not realize we had a typo. We missed reporting this
property as a demo credit in September 2006. We had everything marked on our files to
report things, but it was not turned in due to a clerical error.

The Met Council would like us now to go back and collect SAC from this homeowner
(which may not even be the same) or contractor, now almost two years later, because of a
clerical error. They are telling me because it has been more than one year, we can not
adjust the records and had it been done sooner(within that year) we wouldn't have to pay
SAC; but since they did not catch it until now we have to pay SAC.

I understand rules, and why we make rules. However in this situation I just see this as a
wash clerically and feel that the request is unreasonable for the following reasons.
• The purpose of an audit is to catch mistakes, and correct them.
• If we can't do audits within in time frames, that allow you to correct things—
cities, homeowners or contractors shouldn't be penalized.
• I see this situation as a simply cleaning the books. I don't see it as a property
that we would have collected SAC anyway; because they were Grandfathered in.
It's a simple wash. Something we would have put on the books for two months
only to take off in two months.
• This would have been a wash in the same year, had we not had a clerical error it
would have not been an issue. Demo in September (put on the books), and
Rebuilt in November(take off the books). It's not a case where we would have
actually collected money anyway. I see it as being an internal clerical correction,
just to know that a rebuild has been done.
• In past audits, we have made corrections, and never have we been asked to write
an appeal. I just see this as unusual measures to correct an error. I am happy to
write the letter, in hopes to correct the situation.
• The question I have, if we have made these corrections in the past; because an
audit was done for similar situations. How can we justify making changes in the
past, but try now to collect money, when it was a situation that they were truly
grandfathered in. My question would be wouldn't we have to do that for
everyone? All Cities, not just Orono?
I am asking on behalf of the City, the homeowner and contractor; that you see this as a
clerical correction to simply make note of it. I am also asking that we are exempt from
trying to collect SAC from a permit that was issued 2 years ago, simply because of a
clerical error at that time that was not caught until 2008; because of the Grandfathered
status would have been a wash anyway.
I have never written a letter of appeal, and hoping this explains the situation. If you have
