Dear Commissioner::
D�uing this past year, we have had the displeasure oChavino new home construction on the lot adjacent to
us at 3329 Crystal Bay Road. During this time,construction vehicles for this home constn�ction have on
several or iz�ore occasions used our drive�vay to"shortcut"or to"stage"their constructio�work. My
concrete driveway was dama�ed durin�this improper use of my property, (We have a picture of their
vei�icles on our property,have a witness to both the improper use and dama�e to our concrete.) The
driveway is actually crushed and sunken in multiple places.
We have contacted the owner/developer Fred Johnson multiple times by phone and were told that he would
have the damage repaired by winter.After multiple false promises, missed appointments and absolutely no
response to our complaints, it is now late November and we arc very upset.
We ac�e writing you to insist that you assist us i�i seeing that this damage is repaired as prornised. My wife
and I live, pay taxes, and vote in yo�u�ciry. Does Mi•. 7ohnson? When you invited us to attend meetiilgs at
City Hall to question the multiple variances that Mr. Johnson was asking for, I even intervened on his
behalf? We don't feel it is unreasonable to ask that before you give him a Certificate of Occupancy,that you
see that our matter is taken care of to our satisfaction.
We are all for"progress" in our city,but we should not have to be adversely affected by it.
We would appreciate a swift response to my matter.Thank you.

Re: Driveway Issue
Dear Mr. Rehinan:
We are in receipt of your letter of November 20 regarding the damage to your driveway as a result of
the construction activity next door.
It is unfortunate tl�at sucll damage has occui-�-ed; however, this is a inatter that is outside the scope of
City ordinances, and would appear to be purely a civil inatter between you and your neighbor. �
Withholding the Certificate of Occupancy would not be an appropriate action by the City in relation to
your issue with Mr. Johnson. I suggest you contact an attonley if you are unable to gain satisfaction
fi•om Mr. Johnson.
The City's Building Inspector has, and will contiinle to, encourage Mr. Johnson to lnake satisfactory
repairs. However, the City does not have the legal alithority to require the repairs.

Dear Mr.Gaffron:
Thank you for responding to our letter regarding the damage to our driveway. We appreciate your frankness
and know that we have taken your advice to heart and contacted an attorney,who offered us several options
to our problem.
It is of some comfort to know that you are at least aware of our situation, and we appreciate the fact that
your Building Inspector is also aware of it.
We do wish that we had not been so quick to offer our support to the multiple variances that our good
neighbor asked for and had approved by your Planning Commission.
