DRAINAGE EASEMENT
THIS INDENTURE, made this ����-- day of March, 2005, by and beri�eeil Fred
Jolulson, Pro�erty owner of 3329 Crystal Bay Road, Orono, Mimlesota hereinafter refei-�ed to as
"Grantor(s)", and the City of Orono, a municipal corporation, hereinafter referred to as "Grantee".
WITNESS, that Grantor(s), in consideration of the sum One Doll1r($1.00) and other
good and valuable consicleration given by Grantee, the receipt of which is aclaiowled�ed by
Gr�ntor(s), do(es) hereby grant, bar�ain, sell aild convey to Grantee, its successors and assigns, a
perpetual easement for draina�e purposes and uses, including the rigllt to construct and maintain
drainage facilities, together with the right of access for drainage purposes over, above, under and
across the land located in the State of Milulesota, County of Heiuiepin, legally described as follows:
A permanent drainage easement for the benefit of the public, over, under
and across, the south 5 feet, and the east 10 feet of Lot 6, Wallace's Addition
to Minnetonka Beach, Hennepin County, Minnesota, according to the plat
thereof on file or of record in the office of the Registrar of Titles in and for
said County.
ii�cluding, but izot by way of limitation, a filll and free right and authority to euter Lipon said land to
constrlict,install,maintain,and operate Lulderground drainage facilities,incidental and related thereto,
(all of which are hereinafter referred to collectively as the Improvements). The Grantee shall have the
right to mal<e use of said land as is reasonablv necessary and advisable to the construction,installation,
inaintenance, operation and repair of the Improvements.
In addition to anv other remedy the Grantee nlay h�ve, the covenants and restrictions
contained herein may be enforced by injunetion.
Grantor(s) cov�nants that he is in fee title to the above property,has a lawfi.il right and
authoritv to convey and grant this easel�lent.
