FULL AND FINAL RELEASE OF ALL CLAIMS
IN CONSIDERATION of the payment of ' j ,.,,�. {�;��,�,� ;�;� �,�,��(��� -�.��
and �'/100 Dollars ($ ��;C`. C`� )paid by the City of Orono, a Minnesota municipal
corporation,we do hereby release and forever discharge the City of Orono, its past,present or future
appointed or elected officials, employees, representatives, agents, insurers, successors and assigns
(the"City of Orono"), of and from any and all claims, demands, actions, causes of action,
obligations, liabilities, expenses, costs, attorneys' fees,proceedings and judgments,both known and
unknown, fixed or contingent, liquidated or unliquidated, direct or derivative and of whatsoever
kind,nature and description under the Constitution of the United States or any state, or any state or
federal law or laws or of the common law, which we had or now have against the City of Orono, as
a result of the damage to our driveway by the Orono Public Warks Department while they were
trying to locate a water shut off valve.
IT IS FURTHER AGREED AND UNDERSTOOD that this payment is not to be
construed as an admission of liability and is a compromise of a disputed claim, and is entered into
because of the parties' desire to avoid the cost and uncertainty of litigation.
This Release contains the ENTIRE AGREEMENT between the parties hereto and the terms
of this Release are contractual and not a mere recital.
