A RESOLUTION GRANTING
VARIANCES TO
MUNICIPAL ZONING CODE
SECTIO\S 10.22, SUBDIVISIONS 1 (A) � (B), AND 2;
10.2�, SUBDIVISION 6 (B)

WHEREAS, Patricia A. Guttormson (hereinafter "the applicant") is owner of the
propert�� located at 331� Crystal Bay Road within the City of Orono (hereinafter "City") and
leQally described as follo«�s:
Lots 2, 3, 4, Vr'allace's Addition to the Village of Minnetonka Beach and adjoining �
foot strip of railroad ri;ht-of-��ay, Hennepi�:� County, Minnesota (hereinafter "the
propert��"); and v
`'�'HEItEAS, the applicant has applied to the City for after-the-fact variance to
Municipal Zoning Code Section 10.�2. Subdivision 1 (A) and Subdivision 2 to approve
structural repairs to the foundation of an existin� detached Qa�age located completely within
the 0-7�' setback area �t�here no structures are allo�ved and variances to Section 10.22,
Subdivisions 1 �A) R. (B). ? and Section 10.2�, Subdivi�ion 6 (B j to pernlit the rebuilding of
a decl: to the lake and «�est side of the e�istin� residence to be placed =�4' from the shoreline
���here a 7S setbacl: is required and w�here a 44' setback e�ists, 7' in front of the averaQe
�- lakeshore setback line «�here no encroachment is allowed and ���here a 7' encroachment exists
and 19' from the rear lot line ���here a 30' setbacl: is required and w�here a 19' setback exists.
Both improvements «�ill result in hardcover reductions as follows:
A. 0-7�'setbacl: area = 7.830 s.f. (just for area of Cn�stal Bay Road)

NOW, �'HEREFORE, BE IT RESOLVED by the City Council of Orono,
Minnesota:
FINDINGS
1. "Chis application «�as re��iP�ved as Zoning File #2097.
2. The propem� is located in the LR-1C, Lakeshore Residential Zoning District
requirinb U? acre in area or 21,780 s.£ The propert}� consists of 14.530 s.£,
adjusted area = 11,030 s.f. (-3,�00 s.f. of Crystal Bay Road area).
3. The Orono Planning Commission reviewed this application on January 16, 1996,
and reconunended unanimous approval of the variances as proposed based upon
the followinR findin�s:
A. The proposed impro��ements will result in a structural covera`e reduction
-- brinaina lot coveraQe into conformance at 14.6% �vhere 1�% is allowed
and�l 6�l% exists. �
B. Hardco��er in the 7�-��0' setback area shall be reduced from 26.28% to
�� '?o'
._�o no lon�er requirina a ��ariance.
C. The a�e and condition of the t�vo stor5� garaQe structure required
structural repairs rather than simple repairs. Applicant's contractor had
obtained the permits to do repair work on �araQe but soon realized the
need to do the structural repairs to the foundation.

D. The �araQe and stora��e above are the only stora�e areas on the property
that contains a small residence �ti�ith t�t-o small closets and no basement
area.
E. Deck is deterioratin� and unsafe. The deck has been designed so that
access is provided at four doors tl�at open out onto the deck. The
redesian results in a reduction of 172.1 s.f. of deck area.
F. There is a need to retain as much off street parkin� on this p:�operty as
there is no parkin� on Cr}�stal Bay Road.
G. 3,�00 s.f. of City road encroaches the property via a prescriptive
easement.
H. The majoriri� of the lot is located �vithin the 0-75' setback area (7,830 s.f.
in the 0-75: �.200 s.f. in the 7�-2�0' setback area).
4. The City Council finds that the conditions existing on this property are peculiar
to it and do not appl}� �enerally� to other property in this zoning district; that
�rantina the ��ariance ���ould not adversely affect traffic conditions, light, air nor
pose a�fire hazard or other danger to neighborin� property; would not merel��
serve as a con��enience to the applicant, but is necessary to alleviate a
demonstrable hardship or difficult}�; is necessary to preserve a substantial
�� property ri�ht of the applicant; and ���ould be in keeping with the spirit and
intent of the Zonin� Code and Comprehensi�-e Plan of the City.
�. The Cit�� Council has considered this application including the findinas and
recommendations of the PlanninQ Commission, reports by City staff, comments
b�� the applicant and the effect of the proposed variance on the health, safety and
«�elfare of the communit��.
CO\CLUSIONS, ORDER AND CONDITIONS
Based upon one or more of the above findinas, the Orono City Council hereby
arants �-ariances to I�lunicipal ZoninR Code Sections listed above to permit the reconstniction
of a dec�: at the lal:e and �ti-est sides of the existin, residence and to approve structural repair
to an existin� detached aaraae subiect to the followina conditions:

l. All existina hardcover impro��ements scheduled for removal and as shown on
PaQe 7 of this resolution shall be completed prior to the footina inspection for
the new construction.
2. Authorities aranted by this variance run with the property not with the applicant,
but are permissi��e only and must be exercised by application for a buildinb
permit w�ithin one year of the date of Council approval, or this variance will
expire on that date (Februar�� 12, 1997).
3. Violation of or non-compliance ���ith any of the terms and conditions of this
resolution shall constitute a viulation of the zonin, code, shall automatically
terminate an}� authority �ranted herein, and shall be punishable as a
misdemeanor.
4. The undersi�ned applicant has read, understood and herebv aarees to the temis
of this resolution and on behalf of herself, her heirs, successors and assigns,
hereby a�rees to the recording of this resolution in the chain of title of the
property.
