Box G6 Crystal Bay, MN ss3z3-oo�� FEg � � �gg� i��!Y OF O�;CNO February 17, 1997 I am writing in response to the letter you sent me dated February 6, 1997, regarding Municipal Code Section 10.60 Subdivision 8, which states lighting should not be detectable at the lot line. I have received your letter, but feel I must comment on the procedures that have/have not been followed in this situation. I feel that your enforcement of this code has been one sided thus far. The neighbors on either side of my property are appro�cimately 7+ feet from my lot line, and if and when they turn their outdoor light on the garage to the west, and their back door light to the east, it can't help but shine on my property and beyond my lot line. If a complaint was filed about their lights shining on my property and yard, they would no longer be able to turn their lights on at all and still be in compliance with this particular code. I have sent a copy of this letter to the Mayor and City Council. Therefore if this code is correct and enforceable please notify my neighbors that they will no longer be able to use the lights next to my lot and will have to remove them. I had contacted your office in October, 1996 and reported that NSP had turned the light and lowered it. You did not make any effort to contact me prior to writing your letter of complaint, nor did you contact NSP, so your decision was made without all of the necessary information. You were not aware of the measures I had already taken to accommodate the neighbors in this regard. Besides the changes NSP made, the addition of the fence screened direct light, and I had begun to plant G to 7' arborvitae trees on the fence line to provide year around screening, and will continue planting this spring. Before any further action is taken, I would ask that you come and see the lights at night, so you can get a better perspective on both sides of this argument. My intent was not to light the neighbor's yards, but to provide a safe environment around my home and property. Thank you for your time and consideration on this matter. Unfortunately, the light is offensive to a neighbor and is in violation of City ordinance. I understand you have made numerous attempts to change the height and shield the light, however, the light remains a problem. Therefore, removal is the only alternative. I feel the property owner can provide adequate light from spotlights located on her house and garage. Please remove the light as soon as possible. His report indicated that the property to the northeast was receiving a large amount of light illuminating the west wall of the residence as well as portions of the front lawn and deck. This letter is to require you to redirect this lighting to keep it within your property. Failure to comply may result in legal action. Please redirect the lighting by April 7, 1997.
