TO MUNICIPAL ZONING CODE
SECTIONS 78-1279 AND 78-1403,
REVISING AND CLARIFYING THE APPROVAL GRANTED
BY RESOLUTION NO. 3327
AND CLARIFYING THE HARDCOVER VARIANCE
GRANTED BY RESOLUTION NO. 2642

WHEREAS, Mark R. Prueter and Jennifer A. Prueter, husband and wife,
(hereinafter "Owners") are the owners of the property located at 3215 Crystal Bay Road
within the City of Orono (hereinafter "City") and legally described as: See Exhibit A
(hereinafter "the Property"); and
WHEREAS, Owners have made application to the City for a variance to
Municipal Zoning Code Section 78-1279 to allow construction on the Property of an entry
addition forward of the average lakeshore setback; and
WHEREAS, Owners have made application to the City for a Variance to
Municipal Zoning Code Section 78-1403 to allow structural coverage on the Property of
16.94 percent to constnzct an entry addition; and
WHEREAS, Owners have made application to the City to revise the variance
to Municipal Zoning Code Section 78-350 granted by Resolution No. 3327 to allow a box
bay for a fireplace in the east wall of the house; and
WHEREAS, after due published notice and mailed notice in accordance with
Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning
Commission held a public hearing on January 22, 2008, at which times all persons desiring to
be heard concerning this application were given the opportunity to speak thereon; and
WHEREAS, in researching this application City Staff found that Resolution
No. 2642 approved hardcover in the 0 to 75 foot zone for the Property but did not state the
amount of hardcover; and
WHEREAS, in researching this application City Staff found that the
hardcover calculations included in Resolution No. 3327 contained errors.

NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono,
Minnesota:
FINDINGS
l. This application was reviewed as Zoning File#08-3340.
2. The Property is located in the LR-1C zoning district, where 0.5 acre is the
minimum lot area and 100 feet is the minimum lot width. The Property is
approximately 0.25 acre in area and 47 feet in width.
3. The Planning Commission reviewed this application on January 22, 2008 and
on a vote of 6 - 1 recommended approval of the variances, based on the
following findings:
a. The Owners have agreed to shift the proposed box bay so it complies with
the required setback for cantilevered space. The addition of the box bay
� will have no additional measurable impact on the adjacent property.
b. The existing entry is cramped and non-functional.
c. The proposed entry will have little impact on the lake views from adjacent
properties.
4. The City Council has considered this application including the findings and
recommendation of the Planning Commission, reports by City staff, comments
by the applicants and the public, and the effect of the proposed variance on the
health, safety and welfare of the community.
5. The City Council finds that the conditions existing on this properiy are peculiar
to it and do not apply generally to other property in this zoning district; that
granting the variances would not adversely affect traffic conditions, light, air
nor pose a fire hazard or other danger to neighboring property; would not
merely serve as a convenience to the Owners but are necessary to alleviate a
demonstrable hardship or difficulty; is necessary to preserve a substantial
property ribht of the Owners; and would be in keeping with the spirit and
intent of the Zoning Code and Comprehensive Plan of the City.

CONCLUSIONS, ORDER AND CONDITIONS
Based upon the above findings, the Orono City Council hereby b ants variances to Orono
Municipal Zoning Code Section 78-1279 to allow an entry addition forward of the average
lakesl�ore setback and to Orono Municipal Zoning Code Section 78-1403 to allow 1691
percent structural coverage and approves a revision to the setback variance approved by
Resolution No. 3327 to allow a box bay, subject to the following conditions:
l. Council approval is based on the site and house plans submitted by the Owners
and annotated by City staff, attached to this Resolution as Exhibits B and C.
Any amendments to these plans may require further Planning Commission and
City Council review.
2. The box bay shall be at least 8 feet from the side property line.
3. Owners shall not place any plastic or fabric liner material under any
landscaping on the property to ensure their permeability as non-hardcover
surfaces.
4. Authorities granted by this resolution run with the Property not with the
owners, but are permissive only and must be exercised by obtaining a building
permit for the entry and box bay before March 10, 2009 or the variances will
expire on that date.
5. Violation of or non-compliance with any of the terms and conditions of this
resolution shall constitute a violation of the zoning code, shall automatically
terminate any authority granted herein, and shall be punishable as a
misdemeanor.
The Orono City Council hereby clarifies and corrects Resolution Nos. 2642 and 3327 as
follows:
Hardcover in the 0-75' zone shall be limited to 764 s.f. or 22.56%. Hardcover in the 75-
250' zone shall be limited to 2,488 s.f. or 32.88% per the hardcover allowance summary
as depicted on Exhibit D. Required hardcover removals to reach these levels shall occur

at a reasonable time in the construction process for the entry and box bay, as determined
by the Building Official.
The undersigned Owners have read, understand and hereby agree to the terms of this
resolution and on behalf of their heirs, successors and assigns, hereby agree to the recording
of this resolution in the chain of title of the property.
