A RESOLUTION GRANTING VARIANCES
TO MUNICIPAL ZONING CODE
SECTIONS 78-305 AND 78-1405(6)
FILE NO. OS-3377
WHEREAS, Scott David Hochstedler, a single person, (hereinafter
"Owner") is the owner of the property located at 290 Crestview Avenue within the City of
Orono (hereinafter "City") and ]egally described as: Lots 7 and 8 Block l, Bayside Addition
to Lake Minnetonka, Hennepin County, Minnesota(hereinafter "the Property"); and
WHEREAS, Owner has made application to the City for variances to
Municipal Zoning Code Section 78-305 to construct a 14 foot by 16 foot addition to the rear
of the house with a 23 foot setback from the rear property line when a 50 foot setback is
required and a 17.63 foot setback from the south property line when a 50 foot setback is
required; and
WHEREAS, Owner has made application to the City for variances to
Municipal Zoning Code Section 78-305 to construct a 2.33 by 10 foot addition to the south
side of the house with a 15.3 foot setback from the south property line when a 50 foot setback
is required and a 37 foot setback from the rear property line when a 50 foot setback is
required; and
WHEREAS, the Owner has made application to the City for a variance to
Municipal Zoning Code Section 78-1405(6) to construct a detached garage with a 5.1 foot
setback from the north property line when a 10 foot setback is required; and
WHEREAS, after due published notice and mailed notice in accordance with
Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning
Commission held a public hearing on September 15, 2008, at which times al] persons desiring
to be heard concerning this application were given the opportunity to speak thereon.
NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono,
Minnesota:
FINDINGS
1. This application was reviewed as Zoning File#08-3377.

2. The Property is located in the LR-lA zoning district, where 2 acres is the
minimum lot area and 200 feet is the minimum lot width. The Property is
approximately 0.288 acre in area and 100 feet in width.
3. The Planning Commission reviewed this application on September 15, 2008
and on a vote of 6 - 0 recommended approval of the variances, based on the
following findings:
a. The property is 0.288 acres when the zoning district required 2.0 acres.
b. The existing house is small witr. no basement and no second story. It
cannot be expanded without variances.
c. The proposed additions are modest.
d. Given the location of the house, there is no location on the property where
a detached garage could be constructed without a setback variance.
e. The proposed garage will be 0.6 feet farther from the north property line
than the existing garage and 12 farther from the west property line.
f. The proposed garage will be more in character with the house and the
neighborhood than the existing garage.
4. The City Council has considered this application including the findings and
recommendation of the Planning Commission, reports by City staff, comments
by the applicants and the public, and the effect of the proposed variance on the
health, safety and welfare of the community.
5. The City Council finds that the conditions existing on this property are peculiar
to it and do not apply generally to other property in this zoning district; that
granting the variances would not adversely affect traffic conditions, light, air
nor pose a fire hazard or other danger to neighboring property; would not
merely serve as a convenience to the Owner but necessary to alleviate a
demonstrable hardship or difficulty; is necessary to preserve a substantial
property right of the Owner; and would be in keeping with the spirit and intent
of the Zoning Code and Comprehensive Plan of the City.

CONCLUSIONS, ORDER AND CONDITIONS
Based upon the above findings, the Orono City Council hereby grants variances to Orono
Municipal Zoning Code Section 78-305 to allow construction of a 14 foot by 16 foot addition
to the rear of the house and a 2.33 by 10 foot addition to the south side of the house as well as
a variance to Orono Municipal Zoning Code Section 78-1405(6) to allow construction of a
detached garage with a 5.1 foot setback from the north property line when a 10 foot setback is
required, subj ect to the following conditions:
1. Council approval is based on the site and house plans submitted by the Owner
and annotated by City staff, attached to this Resolution as Exhibits A and B.
Any amendments to these plans may require further Planning Commission and
City Council review.
2. Authorities granted by this resolution run with the Property not with the owner,
but are permissive only and must be exercised by obtaining building permits
for the new construction before October 13, 2009 or the variances will expire
on that date.
3. Violation of or non-compliance with any of the terms and conditions of this
resolution shall constitute a violation of the zoning code, shall automatically
terminate any authority granted herein, and shall be punishable as a
misdemeanor.
4. The undersigned Owner has read, understood and hereby agrees to the terms of
this resolution and on behalf of his heirs, successors and assigns, hereby agree
to the recording of this resolution in the chain of title of the property.
