The City of Orono prohibits excavating within 5 feet of the property line due to the potential to cause changes in drainage and potential for erosion. The City also requires a permit for excavating, grading or filling in excess of 10 cubic yards. It appears that you are beyond that limitation also. I will not require you to apply for the land alteration permit if you restore the excavated area within 5 feet of the property line. Please restore the excavated soil by November 7, . 2008. This Office will verify compliance after that date and if the area is found restored, no further enforcement action will be required.
