HomeMy WebLinkAbout#5279-approving plat-Creekside-2005 � . . �2�o C��;� R; � � o � 3 � � o �, o '�a����� � C ITY of ORONU A � ' ' n�'�h� ti RESOLUTION OF THE CITY COUNCIL N O. � � �`'' �;' G t`�kEs8�4� A RESOLUTIOI� APPROVING THE PLAT OF CREEKSIDE IN ORONO - FILE #04-3016 WHEREAS,the City of Orono is a m�uzicipal corporation organized and existing under the laws of the State of Mimlesota; and WHEREAS,the City Council of the City of Orono(hereinafter"City Council")has adopted subdivision and la�id development re�ilations for the orderly,econonuc a11d safe development of land within the City; aild WHEREAS,the City Council has considered the application by Creekside uz Orono LLC (hereinafter the"Developer")for subdivision of property located at 120 Brown Road South and legally described as follows: Tract H,Registered Land Survey No.352,Hennepin County,Minnesota (hereinafter"the property"); and WHEREAS,on July 12,2004 the City Council adopted Resolution No.5204 granting Preliminary Plat Approval for the proposed development of a seven-lot Pla�lned Residential Development (PRD)plat for sin�le family residential purposes; and WHEREAS, the Developer has completed or has agreed to complete all other requirements of the platting regulations of the City including: 1. Completion of all platting requirements of Preliminary Plat Resolution No. 5204. 2. Submittal of a`recordpreliminaryplat drawing'incozporatin�all eleinents described in Conditions 1 and 2 of Resolution No. 5204. 3. Dedication on the plat of perimeter Drainage and Utility Easements and Drainage Easements as required in Resolution No. 5204. Submittal of Miiulehaha Creek Watershed District (MCWD) permit approving the grading, drainage and stornZwater management plan for development of the Property. 7. Provision to the City of an underlying Road and Utilities Easement for the private road within Outlot B. 8. Provision to the City of azl underlying Road and Utilities Easement for the piivate road with Tract G, RLS 352. 9. Provision to the City of a Declaration of Covenants,Conditions and Restrictions,and Private RoadwayEasement for the private road in Outlot B and Tract G,RLS 352,in favor of Lots 1 through 7, Creekside In Orono. 10. Provision to the City of a signed and executed Developer's Agreement and letter of credit for approved site improvements including constniction of the private road,sewer and water systems, stormwater and drainage systems and facilities, vegetation improvements, etc. 11. Provision to the City of a title commitment as well as a title policy in the amount of $100,000 in favor of the City to ensure coverage of all City interests associated with filing of the subdivision and associated easements,etc.,and certified copies of all recorded easements currently affecting the Property. 12. Payment to the City of Stormwater and Drainage Trunk Fee in the amount of$54,000.00 as established in Resolution No. 5204. 13. Pa}nnenttotheCityofParkDedicationFeeintheamountof$33,300.00asestablished in Resolution I�,To. 5204. 14. Payment to the City of final plat review fees and legal review and filin�fees in the amount of$530.00 as established within Resolution No. 5204. Provision to the City of final plans and specifications for improvements to the property including construction of a private road, sanitary sewer system, water system and stornlwater facilities,site�-ading,landscaping,etc.per the requirements ofresolution No. 5204. 16. Provision to the City of a pemut from Hennepul Cotulty for construction of the private road access to Brown Road South. NOW,THEREFORE,BE IT RESOLVED thatbased on the findings ofResolutionNo. 5204,the City Council of the City of Orono does hereby approve the Plaruzed Residential Development plat of CREEKSIDE IN ORONO,Heru�epin County,Miiulesota subj ect to the following declaz ations and conditions: 1. Shoreland Status.In addition to the various development limitations established hereul,Lots 1 through 7 are within or partially within the designated Shoreland Overlay District and subject to the City of Orono Sl�oreland regulations pertinent to tributaries. 2. Lot Developinent Standards.Lot development standards applicable to Lots 1 through 7 are generally as shown on the approved Grading,Drainage and Erosion Control Plan, Sheet 4 of 6,by Schoell and Madson,Inc.,revision dated O l-19-OS and attached hereto as EXHIBIT A(which Plan shall be designated for reference purposes as the`Record Preliminary Plat Drawing') and more specifically as follows: All Lots: Required Front Yard: 35' Required Side Yard: 30' Required Side Street Yard: 35' Setback from Creek: 75' Setback fiom Delineated Wetlands: 35' The bank of the creek for setback purposes is established at the 936.5' elevation contour line. "Required Yard" designations shall be as depicted on the `record preliminary plat drawing'with the standard`front yard abutting the private road, `side yards' abutting adjacent lots w�ithin the plat, `rear yards' generally opposite the front yards, but�vith the exceptions noted below. Additional I�Zdividual Lot Standards: Lot 1: The westerly 50'of Lot 1 is subj ect to a Conseivation Easement allowing no structures orhardcover. The northerlyyard ofLot 1 is designated as a side street yard. The rear yard �0' setback is coincident with the Conservation Easement boundaty. Lot 2: The westerly 50'of Lot 1 is subj ect to a Conservation Easement allowin� no structures or hardcover. The westerly 50'yard of Lot 2 is designated as a rear yard for zoning purposes. The westerly 50'setback is coincident with the Conservation Easement boundary.The southerly yard of Lot 2 shall also be treated as a rear yard,and shall be subj ect to a 5 0'rear yard setback and the 75' creek setbacic. No accessory structures shall be placed within the 50' rear yards, nor within 75' of the creelc. Lot 3: The existin� house setback to Lot 3's northeasterly boundary shall be reco�ized as a legal nonconformity. However,anynew construction within Lot 3 shall conform to the standards established herein. The southerly and southeasterly yards of Lot 3 shall be designated as rear yards, and shall be subject to a 50'rear yard setback and the 7S creek setback.No accessory structures shall be placed within the 50'rear yard, nor within 75' of tl�e creek. Lot 6: There shall be no stnictural or hardcover encroachments of the stomiwater pond easement or the 35' wetland buffers. Lot 7: There shall be no structural or hardcover encroachments of the stormwater pond easement,of the 35'wetland buffers,nor of the 30'drainage and utility easement along the northwesterly boundary of Lot 7. 3. Developer shall follow the landscape plan�eneral notes(upper left on Sheet 12 of 12), especiallywith regards to pnu�ing a��d removal of dead wood and damaged branches within the Conservation Easement areas. 4. Conservation Easement MarkinQ. Pennanent ma�kers of a desi;n a�id material acceptable to the Plam�in� Director shall be placed by the developer at all points where the Conservation Easement intersects a lot boundary or where the Easement boundary line changes direction, as stipulated in the Flowage and Conservation Easement. 5. Construction ofRoads,Utilities and Site Improveinents. Developer shall construct the pri��ate road within Outlot B and Tract G,RLS 352,as well as sanitary sewer,water and stormsewer facilities in accordance with the Developers Agreement to be executed between the City and the Developer. 6. Sanitarv Sewer and Water Svstems. All applicable City of Long Lake connection fees and charges associated with the sewer and water systein servin�the development shall be paid to Lon; Lake by the Developer. Developer shall be responsible for any charges to the City of Orono from the City of Long Lake in relation to the provision of municipal sewer and water from Long Lake. Upon completion by the Developer and acceptance by the City of Orono,the sanitary sewer and water facilities within Outlot B and within the 30'utility easement of Lot 7,shall become part of the City of Orono utilih�system,to be operated and maintained by the City of Orono. As part of the installation of sanitary sewer and water improvements per the approved plans,Developer shall install two sewer and two water stubs for future service to the Diuin property and 1 sewer and 1 water stub for future service to the McCuskey property. 7. Gradin�and Drainage Requirements. General site gradulg shall Ue in confoiznance with the approved Gradina,Drainage and Erosion Control Plan,subj ect to the recoininendations of the City Engineer in his letter dated JanLiaiy 13,2005. Durin�development within individual lots,wherever feasiUle,nidividual driveways shall Ue graded to drain toward the road storm sewer system.Wherever feasible,individual yard areas shall be graded to drain toward the road stonn sewer system. Wherever feasible,roof gutter systems shall be installed to discharge roof runoff so that it will drain toward the road storm sewer system. 9. Si��e and LiQhtin�. I�'o street li�itinQ or development identification signage has been approved for Creekside In Orono. Any such proposed lighting or si mlage shall be subj ect to prior City approval, which nlay require public heariizgs. 10. Citv En��zeer Approval.Approval of all improvements is subj ect to recommendations of City En�ineer Thomas Kellog� as noted in his comments dated January 13, 2005. 11. Minnehaha Creek Watershed District A�proval.This subdivision approval is subj ect to MCWD approvals and pernlits as required. The final plat shall not be released for filing until the Developer has provided evidence that all required MCVVD permits have been obtained. 12. Developers Agreement.The plat shall not be released for filing until the Developer has executed a Developer's Agreement per the conditions ofResolutionNo.5204,including a letter of credit written to 150%of the cost of the proposed site improvements,includin� any required landscaping. 13. Site Improvements;Buildina Pennit Issuance. No land alterations shall take place until erosion control is established and the City En�-ineer Ilas approved all final improvement plans.No building permits will be issued until all drainage facilities a.nd improvements have been installed and satisfactory road base (including road base and the initial lift of bituminous) has been installed. 14. The aforesaid plat shall be filed by tl�e City of Orono with the Heiulepin County Registrar of Titles Office on or before July 24,20051ogether witll a certified original copy of this resolution aild executed co�ies of the easenlents and covenants pertinenl thereto. The approval m-ailted Uy tlus Resolution shall expire if the conditioils of tlus Resolution have not been met or the plat has not been filed by the date specified aUove.
