Regarding the building permit for Dean Johnson, I need you to calculate the space on the top level in relation to how it
meets our definition of Half Story. For the home to meet the Code the top level must meet the definition of half story as
the basement is considered a Story.

Half Story-means the uppermost floor of a building in which (i) the intersection of the exterior wall and the roof
is not more than three feet above the floor elevation, and (ii) not more than 60 percent of the floor area within
the exterior walls of the uppermost floor exceeds five feet in height as measured from the floor to the rafters.
Floors exceeding these parameters shall be deemed a full story.
Basement means that portion of a building that is partly or completely below the existing ground level. A
basement shall be considered as a story for purposes of determining the number of stories in a building, when
the finished surface of the floor above the basemenf is more than six feet above the existing ground level for
more than 50 percent of the basement's perimeter. The perimeter of the basement does not include portions of
the house or garage that do not have a lower level but are merely "unexcavated". Artificially raising the grade
adjacent to the foundation of a structure (by filling or by a combination of filling and retaining walls) above the
surrounding natural terrain shal/not be allowed as a method for converting a defined story to a defined
basement, regardless of any other benefits to the property of such action. Finished grade that increases more
than one foot from existing ground level shall be considered as artificially raising the grade. However, artificially
raising the grade when such action merely restores a previously excavated site to its original natural grade
may used as a method for converting a defined story to a defined basement.

We have reviewed the grading plan dated 8-21-09 for 110 Creek Ridge Pass. The plans propose
to build a single family home with an attached garage. We have the following comments with
regards to engineering matters:
• The new site plan lowered the basement elevation from 951.0 to 948.0. The Creekside
development sanitary sewer was designed based on a 951.0 lower level elevation and
may not be low enough to fully serve the proposed home with gravity sewer. Due to the
development's history and circumstances we do not currently have reliable elevation
information on sewer stubs. We recommend that the stub elevation be verified for
construction planning purposes.
• The site plan has drainage issues in the front yard. The drainage arrows are not
consistent with the proposed/existing contours. The plan shows a ridge running north
from the high point in the driveway. The elevation of the ridge is 961.7 as it passes the
west end of the garage which is at 959.5.
• It appears that the proposed retaining walls on the south side of the house are
collectively 8.5 feet high and separated by 5 feet. Engineered design and details should
be submitted for review and approval for all retaining walls over four in height, and for
all tiered walls with a separation of less than two times the wall height.
• This project will disturb more than 100 CY of material. Sediment and erosion control
information meeting the requirements of Orono's City Code 79-7(c)(2) must be
submitted. The minimum $2000 sediment and erosion control financial security should
be required of the applicant for this permit.

• The site plan shows the area south and east of the propose home and porch to be
graded to a 40% grade. This must be revised to a maximum 3 to 1 slope or 33.33%
grade.
• There is a discrepancy between the lot certificate from Sunde Land Surveying and the
site plan regarding the elevation of the road at the proposed driveway. Both the site
plan and lot certificate have the garage at 960.8. The site plan has the road at 958 and
the lot certificate has the road at 959.9 which would create drainage problems. This
should be resolved prior to permit approval.

For the record: Our original review called for a retaining wall designed by an engineer due to the height/separation of the
walls off the back of the patio. Building department has indicated that the foundation for the covered patio extended to
near the base of the retaining walls. There is little dirt behind the walls to retain and we are not seeking the designed
wall plans for the as-built review.
