APPROVING THE PLAT OF
CREEKSIDE IN ORONO
- FILE #04-3016
WHEREAS,the City of Orono is a muiucipal corporation organized and existing under
the laws of the State of Mim�esota; and
WHEREAS,the City Council of the City of Orono(hereinafter"City Council")l�as
adopted subdivision and la�ld developinent re�.ilations for the orderly,economic and safe development of
land within the City; and
WHEREAS,the City Council has considered the application by Creekside u�Orono LLC
(hereinafter the"Developer")for subdivision ofproperty located at 120 Brown Road South and legally
described as follows:
Tract H,Registered Land Survey No.352,Hennepin County,Minnesota
(hereinafter "the property"); and
WHEREAS,on July 12,2004 the City Council adopted Resolution No.5204 granting
Prelirriinary Plat Approval for the proposf�d development of a seven-lot Pla��ned Residential Developmeut
(PRD)plat for single family residential purposes; and
WHEREAS, the Developer has completed or has agreed to complete all other
requirements of the platting regulations of the City including:
1. Completion of all platting requireinents of Preliminaiy Plat Resolution No. �204.
2. Submittal of a`recordpreliminaryplat drawing'incorporatin�all elements described in
Conditions 1 and 2 of Resolution No. 5204.
3. Dedication on the plat of penmeter Drainage and Utility Easements and Draina�e
Easements as required in Resolution No. 5204.

4. Designation and dedication on the plat of open water wetlands subject to City and
other agency jurisdiction.
5. Provision to the City of a Flowage and Conservation Easement over all wetlands
in Outlot A,incorporating languaae for preservation of all uplands within Outlot A as well
as within the west 50 feet of Lots 1 and 2, Creekside In Orono.
6. Submittal of Mimlehaha Creek Watershed District (MCWD) pennit approving the
grading, drainage and storniwater management plan for development of the Property.
7. Provision to the City of ai1 underlying Road and Utilities Easement for the private road
within Outlot B.
8. Provision to the City of an underlying Road and Utilities Easement for the piivate road with
Tract G, RLS 3 5 2.
9. Provision to the City of a Declaration of Covenants,Conditions and Restrictions,and
Private Roadway Easement for the private road in Outlot B and Tract G,RLS 352,in favor
of Lots 1 throuah 7, Creekside In Orono.
10. Provision to the City of a signed and executed Developer's Agreement and letter of credit
for approved site improvements including construction of the private road,sewer and water
systems, stormwater and drainage systems and facilities, vegetation improveinents, etc.
11. Provision to the City of a title commitment as well as a title policy in the amount of
$100,000 in favor of the City to ensure coverage of all City interests associated with filing
of the subdivision and associated easements,etc.,and certified copies of all recorded
easements currently affectin�the Property.
12. Payment to the City of Stormwater and Drainage Tnu�k Fee in the amount of$�4,000.00
as established in Resolution No. 5204.
13. Payinent to the City of Park Dedication Fee in the amount of$33,300.00 as established
in Resolution No, 5204.
14. Payment to the City of final plat review fees and legal review and filin�fees in the amount
of�530.00 as established within Resolution No. 5204.

15. Provision to the City of final plans and specifications for improveinents to the property
including construction of a private road, sanitary sewer system, water system and
stormwater facilities,site�ading,landscaping,etc.perthe requirements ofresolution No.
5 204.
16. Provision to the City of a pennit from Hernzepin Cotu�ty for construction of the private ro ad
access to Brown Road South.
NOW,THEREFORE,BE IT RESOLVED that based on the findings ofResolution No.
5204,the City Council of the City of Orono does hereby approve the Planned Residential Development
plat of CREEKSIDE�ORONO,Hennepin County,Minnesota subj ect to the following declarations and
conditions:
1. Shoreland Status.In addition to the various developme�lt lunitations established hereu�,L,ots
1 through 7 are within or partially within the designated Shoreland Overlay District and
subject to the City of Orono Shoreland regulations pertinent to tributaries.
2. Lot Develo�ment Standards.Lot development standards applicable to Lots 1 through 7
are generally as shown on the approved Grading,Drainage and Erosion Control Plan,
Sheet 4 of 6,by Schoell and Madson,Inc.,revision dated O 1-19-OS and attached hereto
as EXHIBIT A(which Plan shall be desib ated for reference purposes as the `Record
Preliminary Plat Drawing') and more specifically as follows:
All Lots: Required Front Yard: 35'
Required Side Yard: 30'
Required Side Street Yard: 35'
Setback from Creek: 75'
Setback from Delineated Wetlands: 3�'
The bank of the creek for setback purposes is established at the 936.5'
elevation contour line.
"Required Yard" designations shall be as depicted on the `record
preliminary plat drawing'with the standard`front yard abutting the private
road, `side yards' abutting adjacent lots within the plat, `rear yards'
generally opposite the front yards, but with the exceptions noted below.

The lot size for administering accessory structure ordinances shall be the
actual lot area and shall not credit any of the Conservation Outlot area.
Additional I�zdividual Lot Standards:
Lot 1: The westerly 50'of Lot 1 is subj ect to a Conseivation Easement allowing
no structures or hardcover. The northerly yard of Lot 1 is designated as
a side street yard. The rear yard 50' setback is coincident with the
Conservation Easement boundary.
Lot 2: The westerly 50'of Lot 1 is subj ect to a Conservation Easement allowing
no stnictures or hardcover. The westerly 50'yard of Lot 2 is desi�nated
as a rear yard for zoning purposes. The westerly 50'setback is coincident
with the Consei-vation Easement boundary.The southerly yard of Lot 2
shall also be treated as a rear yard,and shall be subj ect to a 50'rear yard
setbacic and the 75' creek setbacic. No accessory structures shall be
placed within the 50' rear yards, nor within 75' of the creelc.
Lot 3: The existin� house setback to Lot 3's northeasterly boundary shall
be reco�ized as a legal nonconformity. However,anynew construction
within Lot 3 shall conform to the standards established herein. The
southerly and southeasterly yards of Lot 3 shall be designated as rear
yards, and shall be subject to a 50'rear yard setback and the 75'creek
setback.No accessory�structures shall be placed within the 50'rearyard,
nor within 7S of the creek.
Lot 6: There shall be no stnictural or hardcover encroachments of the stomiwater
pond easement or the 35' wetland buffers.
Lot 7: There shall be no structural orhardcover encroachments of the stormwater
pond easement,of the 35'wetland buffers,nor of the 30'drainage and
utility easement along the northwesterly boundary of Lot 7.
3. Tree Preservation aizd Landscaping. The developer shall adhere to tl�e approved tree
preservation and la�ldscapiil�pla��s.The developer sl�all walk the site with City staff prior
to site gradiil�to establish which,if any,trees within the grading area can be saved or

transplanted.The developer shall confer with the property owner of 130 Brown Road
South a.nd with Citystaffto establish an alternate layout for spacing ofboulevard trees
along that adjoining property to provide a natural look rather than a re�imented look.
Developer shall follow the landscape plan�eneral notes(upperleft on Sheet 12 of 12),
especiallywith rega�-ds to pruning a�id removal of dead wood a�1d damaged branches withul
the Conservation Easement areas.
4. Conservation Easeinent MarkinQ. Penna�zent markers of a desi�n a�id material acceptable
to the Plam�ing Director shall be placed by the developer at all points where the
Conservation Easeinent intersects a lot boundary or where the Easement boundary line
changes direction, as stipulated in the Flowage and Conservation Easement.
5. Construction ofRoads,Utilities and Site Improvements. Developer shall construct the
private road within Outlot B and Tract G,RLS 352,as well as sanitary sewer,water and
stormsewer facilities in accordance with the Developers Agreement to be executed
between the City and the Developer.
6. Sarutarv Sewer and Water Systems. All applicable City of Lon�Lake connection fees and
charges associated with the sewer and water systein servinQ tl,�e development shall be paid
to Long Lake by the Developer. Developer shall be responsible for any charges
to the City of Orono from the City of Long Lake in relation to the provision of municipal
sewer and water from Lona Lake.
Upon coinpletion by the Developer and acceptance by the City of Orono,the sanitary
sewer and water facilities within Outlot B and withuz the 30'utility easement of Lot 7,shall
become part of the City of Orono utility system,to be operated and maintained by the City
of Orono.
As part of the installation of sanitary sewer and water improvements per the approved
plans,Developer shall install two sewer and two water stubs for future service to the Dlu7n
property and 1 sewer and 1 water stub for future service to the McCuskey property.
7. Road Name. The name of the private road shall be Creek Rid�e Pass.

8. Gradin�and Drainaae Requirements.General site graduz�shall Ue in confoiznance with the
approved Grading,Drainage and Erosion Control Plan,subj ect to the recoinmendations
of the City Engii�eer in his letter dated January 13,2005. During development within
individual lots,wherever feasible,u7dividual driveways shall be graded to drain toward the
road storm sewer system.Wherever feasible,individual yard areas shall be graded to drain
tov�-ard the road storni sewer system. Wherever feasible,roof gutter systems shall be
installed to discharge roof runoff so tlzat it will draul toward the road storn�sewer system.
9. Si�na�e and Li�htine. No street lightii�g or development identificatioil si�age has been
approved for Creekside I�7 Orono. Any such proposed lighting or signa�e shall be subject
to priar City approval, which may require public hearings.
10. Citv EnQineer Approval.Approval of all improvements is subj ect to recommendations of
City Engineer Thomas Kellog� as noted in his comments dated January 13, 2005.
11. Minnehaha Creek Watershed Dish-ict Ap�roval.This subdivision approval is subject to
MCWD approvals and pernlits as required. The final plat shall not be released for filing
until the Developer has provided evidence that all required MCWD permits have been
obtained.
12. Developers A�reement.The plat shall not be released for filing until the Developer has
executed a Developer's Agreement per the conditions of Resolution No.5204,including
a letter of credit written to 150%of the cost of the proposed site improvements,including
any required landscaping.
13. Site Improvements;Buildin�Pennit Issuance. No land alteratioils shall take place until
erosion control is established and the City En�ineer has approved all final improvement
pla�zs.No building pemuts will be issued until all drainaQe facilities a�ld improvements ha�e
been installed and satisfactory road base (including road base and tl�e initial lift of
bituminous) has been installed.
14. The City Clerk shall release the plat documents for filing only upon certification by the City
Attorney and Plannin�Director that all requirements of the platting re�ulations have been
satisfied.

15. Tl�e aforesaid plat shall be filed by the City of Orono with the Heiulepiii County Registra��
of Titles Office on or before July 24,2005 together with a certified origiilal copy of
this resolution and executed co�ies of the easenlents and covenants pertinent thereto.
The approval g�•auted Uy tlus Resolution shall expire if the conditions of tlus Resolution have not been met
or the plat has not been filed by the date specified aUove. I�i that event,it will be necessaiy to file a new
application with the City of Orono for subdivision review.
