A RESOLUTION
APPROVING THE PLAT OF
CREEKSIDE IN ORONO
- FILE #04-3016
WHEREAS,the City of Orol�o is a muiucipal corporation organized and existing under
the laws of the State of Miiulesota; and
WHEREAS,the City Council of the City of Orono(hereinafter"City Council")l�as
adopted subdivision and land development re�.ilations for the orderly,economic and safe development of
land within the City; and
WHEREAS,the Ciry Council has considered the application by Creekside u�Orono LLC
(hereinafter the"Developer")for subdivision ofproperty located at 120 Brown Road South and legally
described as follows:
Tract H,Registered Land Surveti�No.352,Hennepin County,Minnesota
(hereinafter "the property"); and
WHEREAS,on July 12,2004 the City Council adopted Resolution No.5204 granting
Prelimuia�y Plat Approval for the proposed development of a seven-lot Pla�lned Residential Development
(PRD)plat for single family residential purposes; and
VVHEREAS, the Developer has completed or has agreed to complete all other
requirements of the platting regulations of the City including:
1. Completion of all platting requirements of Preliminary Plat Resolution No. 5204.
2. Submittal of a`record preliminaiy plat drawing' incorporating all eleinents described in
Conditions 1 and 2 of Resolution No. 5204.
3. Dedication on the plat of perimeter Draina�e and Utility Easements and Drainage
Easements as required in Resolution No. 5204.

4. Designation and dedication on the plat of open water wetlands subject to City and
other a�ency jurisdiction.
5. Provision to the City of a Flowage and Conservation Easement over all wetlands
in Outlot A,incorporatin�language for preservation of all uplands within Outlot A as well
as within the west 50 feet of Lots 1 and 2, Creekside I�7 Orono.
6. Submittal of Miilnehaha Creelc Watershed District (MCV�'D) pennit approving the
grading, drainage and stormwater management plan for development of the Property.
7. Provision to the City of an underlying Road and Utilities Easernent for the private road
within Outlot B.
8. Provision to the City of az1 underlying Road and Utilities Easement for the private road with
Tract G, RLS 352.
9. Provision to the City of a Declaration of Covenants,Conditions and Restrictions,and
Private Ro adway Easement for the private road in Outlot B and Tract G,RLS 3 52,in favor
of Lots 1 through 7, Creekside In Orono.
10. Provision to the City of a signed and executed Developer's Agreement and letter of credit
for approved site unprovements including constniction of the private road,sewer and water
systems, stormwater and drainage systems and facilities, vegetation improvements, etc.
11. Provision to the City of a title commitment as well as a title policy in the amount of
$100,000 in favor of the Cityto ensure coverage of all City interests associated with filing
of the subdivision and associated easements,etc.,and certified copies of all recorded
easements currently affecting the Property.
12. Payment to the City of Stormwater and Drainage Trunk Fee in the amount of$54,000.00
as established in Resolution No. 5204.
13. Payinent to the City of Park Dedication Fee in the amount of$33,300.00 as established
in Resolution No. 5204.
14. Payment to the City of final plat review fees and legal review and filin�fees in the amount
of$530.00 as established within Resolution No. �204.

including construction of a private road, sanitary sewer system, water system and
stormwater facilities,site�ading,landscaping,etc.per the requirements of resolution No.
5 204.
16. Provision to the City of a pemut from Heiuzepuz Cow�ty for construction of the private road
access to Brown Road South.
NOVV,THEREFORE,BE IT RESOLVED that based on the findings of Resolution No.
5204,the City Council of the Ciry of Orono does hereby approve the P1aruled Residential Development
plat ofCREEKSIDE IN ORONO,Hennepin County,Miiulesota subject to the followin�declarations and
conditions:
1. Shareland Status.In addition to the various development lirnitations established herein,Lots
1 through 7 are within or partiallywithin the designated Shoreland Overlay District and
subject to the City of Orono Shoreland regulations pertinent to tributaries.
2. Lot Development Standards.Lot development standards applicable to Lots 1 through 7
are generally as shown on the approved Grading,Drainage and Erosion Control Plan,
Sheet 4 of 6,by Schoell and Madson,Inc.,revision dated O l-19-OS and attached hereto
as EXHIBIT A(which Plan shall be designated for reference purposes as the`Record
Preliminary Plat Drawing') and more specifically as follows:
All Lots: Required Front Yard: 35'
Required Side Yard: 30'
Required Side Street Yard: 35'
Setback from Creek: 75'
Setback from Delineated Wetlands: 35'
The banl:of the creek for setback purposes is established at the 936.5'
elevation contour line.
"Required Yard" designations shall be as depicted on the `record
preliminary plat drawing'with the standard`front yard abutting the private
road, `side yards' abutting adjacent lots within the plat, `rear yards'
generally opposite the front yards, but with the exceptions noted below.

The lot size for administenng accessory structure ordinances shall be the
actual lot area and shall not credit any of the Conservation Outlot area.
Additional I��dividual Lot Standards:
Lot 1: The westerly 50'of Lot 1 is subj ect to a Conseivation Easement allowing
no structures or hardcover. The northerly yard of Lot 1 is desi;nated as
a side street yard. The rear yard �0' setback is coincident with the
Conservation Easement boundary.
Lot 2: The westerly 50'ofLot 1 is subj ect to a Conservation Easement allowin�
no structures or hardcover. The westerly 50'yard of Lot 2 is designated
as a rear yard for zoning purposes. The westerly 50'setback is coincident
with the Conservation Easement boundary.The southerlyyard of Lot 2
shall also be treated as a rear yard,and shall be subj ect to a 50'rear yard
setback and the 75' creek setbacic. No accessory structures shall be
placed within the 50' rear yards, nor within 75' of the creelc.
Lot 3: The existin� house setback to Lot 3's northeasterly boundary shall
be reco�ized as a legal nonconformity. However,anynew construction
within Lot 3 shall conform to the standards established herein. The
southerly and southeasterly yards of Lot 3 shall be designated as rear
yards, and shall be subj ect to a 50'rear yard setback and the 75'creek
setback.No accessory structures shall be placed within the SO'rear yard,
nor within 7�' of the creek.
Lot 6: There shall be no structural or hardcover encroaclunents of the stomlwater
pond easement or the 3�' wetland buffers.
Lot 7: There shall be no strucn�ral or ha�•dcover encroaclunents of the stormwater
pond easement,of the 35'wetland buffers,nor of the 30'drainage and
utility easement along the northwesterly boundary of Lot 7.
3. Tree Preservation and Landscapina.The developer shall adhere to the approved tree
preservation and landscaping pla�ls.The developer shall walk the site with City staff prior
to site gradina to establish which,if any,trees within the gradin�area can be saved or

transplanted.The developer shall confer with the property owner of 130 Brown Road
South and with City staff to establish an alternate layout for spacing of boulevard trees
along that adj oinin�property to provide a natural look rather than a regimented look.
Developer shall follow the landscape plan general notes(upperleft on Sheet 12 of 12),
especiallywith regards to pruning and removal of dead wood a�ld damaged branches within
the Conservatioii Easement areas.
4. Conservation Easement Ma�•kina. Pennanent markers of a desi�n a��d material acceptable
to the Plamiing Director shall be placed by the developer at all points where the
Conservation Easement intersects a lot boundary or where the Easement boundary line
changes direction, as stipulated in the Flowage and Conservation Easeinent.
5. Construction ofRoads,Utilities and Site Improvements. Developer shall construct the
pnvate road within Outlot B aizd Tract G,RLS 352,as well as sanitary sewer,water and
stonnsewer facilities in accordance with the Developers Agreement to be executed
between the City and the Developer.
6. Sanitary Sewer and Water Svstems. All applicable City of Lon�Lake connection fees and
charges associated with the sewer and water systein servina the development shall be paid
to Long Lake by the Developer. Developer shall be responsible for any charges
to the City of Orono from the City of Long Lake in relation to the provision of municipal
sewer and water from Long Lake.
lipon completion by the Developer and acceptance by the City of Orono,the sanitary
sewer and water facilities within Outlot B and within the 30'utility easement of Lot 7,shall
become part of the City of Orono utility system,to be operated and maintained by the City
of Orono.
As part of the installation of sanitary sewer and water improvements per the approved
plans,Developer shall install two sewer and two water stubs for future service to the Dunn
property and 1 sewer and 1 water stub for future service to the McCuskey property.
7. Road I�Tame. The name of the pnvate road shall be Creek Rid�e Pass.

8. Gradin}and DrainaQe Requirements. General site grad'u�g shall be in conformance with the
approved Grading,Drainage and Erosion Control Plan,subject to the recoinmendations
of the City Engineer in his letter dated January 13,2005. During development within
individual lots,wherever feasible,llzdividual dliveways shall be graded to drain toward the
road storm sewer system.Wherever feasible,individual yard areas shall be graded to drain
toward the road stonn sewer systein. Wherever feasible,roof gutter systems shall be
installed to discharge roof runoff so that it will drain toward the road storm sewer system.
9. Si�naQe and LiQhtin�. No street ligliting or development identification si�age has been
approved for Creekside I��Orono. Any such proposed lighting or signa�e shall be subj ect
to prior City approval, which may require public hearings.
10. Citv En�leer Approval.Approval of all improvements is subj ect to recommendations of
City Engineer Thoinas Kellog� as noted in his comments dated January 13, 2005.
11. Minnehaha Creek Watershed Distri ct Approval.This subdivision approval is subj ect to
MCWD approvals and pernlits as required. The final plat shall not be released for filing
until the Developer has provided evidence that all required MCWTD permits have been
obtained.
12. Developers A�reement.The plat shall not be released for filing until the Developer has
executed a Developer's Agreement per the conditions ofResolution No.5204,including
a letter of credit written to 150%of the cost of the proposed site improvements,including
any required landscaping.
13. Site Improvements:Buildina Pennit Issuance. No land alterations shall take place until
erosion control is established and the City Engineer has approved all final improvement
plans.No building pemuts will be issued until a11 drainage facilities a�ld improvements have
been installed and satisfactory road base (including road base and the initial lift of
bituminous) has been installed.
14. The City Clerk shall release the plat documents for filing only upon certification by the City
Attorney and Planning Director that all requirements of the platting regulations have been
satisfied.

15. Tlie aforesaid plat shall be filed by the City of Orono with the Heiule�in County Registra�•
of Titles Office on or before July 24,2005 iogether with a certified original copy of
this resolution and executed copies of the easements and covenants pertinent thereto.
The approval granted by tlus Resolution shall expire if the conditions of tlus Resolution ha�e not been met
or the plat has not been filed by the date specified aUove. I�i that event,it will be necessaiy to file a new
application with the City of Orono for subdivisioil review.
