AGREEMENT made this ��� day of A�'�a � , 2010, by and between the CITY OF ORONO, a
Minnesota municipal corporation ("City") and TODD R. and MARY J. MURLEY, husband and wife (Owners").
Recitals
1. A building permit application has been filed for a swimming pool and for a land alteration permit
for grading located at 2775 Countryside Drive West (the "Subject Property"), legally described as Lot 1 Block 3
Old Crystal Bay Road Addition, Hennepin County Minnesota.
2. Owners request the City to review these applications.
3. The City will commence its review of the application and incur costs associated with said review
only if the Owner establishes an escrow to ensure reimbursement to the City of its costs.
NOW THEREFORE, THE PARTIES AGREE AS FOLLOWS:
1. DEPOSIT OF ESCROW FUNDS. Contemporaneously with the execution of this Escrow
Agreement, the Owners shall deposit $2,500 with the City. All accrued interest, if any, shall be paid to the City to
reimburse the City for its cost in administering the escrow account.
2. PURPOSE OF ESCROW. The purpose of the escrow is to guarantee reimbursement to the City
for all out-of-pocket costs the City has incurred (including planning, engineering, in excess of $500, or legal
consultant review) or will incur in reviewing the pian. Eligible expenses shall be consistent with expenses the
Owners would be responsible for under a building permit application. The escrow will also guarantee
reimbursement to the City for all out-of-pocket costs the City has incurred to assure that the work is completed in
accordance with the Stormwater Pollution Prevention Plan and the provisions of Orono City Code Chapter 79.
The financial security may also be used by the City to eliminate any hazardous conditions associated with the
work and to repair any damage to public property or infrastructure that is caused by the work (including planning,
engineering, or legal consultant review) associated with building permit 2010-00239 and general permit 2010-
00241 if compliance with the approved permits is not accomplished.
3. MONTHLY BILLING. As the City receives consultant bills for incurred costs, the City will in turn
send a bill to the Owners. Owners shall be responsible for payment to the City within 30 days of the Owners'
receipt of bill.
4. DISBURSEMENT FROM ESCROW ACCOUNT. In the event that the Owners do not make payment
to the City within the timeframe outlined in #3 above, shall issue a Stop Work Order until the Owners pay all expenses
invoiced pursuant to #3. The City may draw from the escrow account without further approval of the Owners to
reimburse the City for eligible expenses the City has incurred.
5. CLOSING ESCROW. The Balance on deposit in the escrow, if any, shall be returned to the
Owners when the review has been completed and written notification is received from the Owners requesting the
funds.
6. CERTIFY UNPAID CHARGES. If the project is abandoned by Owners, or if the eligible expenses
incurred by the City exceed the amount in escrow, the City shall have the right to certify the unpaid balance to the
subject property pursuant to Minn. Stat. §§ 415.01 and 366.012.

Hi Jessica,
I'm emailing to check on the status of a project escrow refund. We put in a pool and sportcourt a couple
years ago, and i believe at the time we wrote out a check to the city of Orono at the beginning of the
project. I don't believe we've received this money back, and our surveyor sent an as built survey to the
city a while back. Who do I contact to check on this?

In the process of closing out completed building permit project files, it was noted we have not
received an as-built survey for the projects at your property. We continue to hold an escrow of
$2,500 pertaining to the installation of an in-ground pool and sport court. In order to begin the
process for the release of the escrow, submittal of an as-built survey is required so we may
verify conformance with approved permit plans. Once our engineer determines the property
conforms to the approved building permit plans, approved grading plan, etc. your escrow can be
refunded.

Sec. 86-68. Permit application; information required.
(a) The application for a construction permit shall include such information as may be
required by the city, which may vary between types of construction projects.
(b) Surveys required:
(1) Initial survey. Any building or general permit application for construction of a new
structure or expansion of an existing structure shall be accompanied by a
certificate of survey prepared by a Minnesota Registered Land Surveyor unless
the building official dete�rmines the construction project is exempt from this
section. The certificate of survey shall conform to the standards on file in the
office of the building official.
(2) Foundation survey. A foundation survey shall be submitted to the city for review
and approval, unless exE�mpted by the building official, upon completion of the
foundation work for all b�uildings and all additions to buildings. The foundation
survey, prepared by a Minnesota Registered Land Surveyor, shall certify the lot
dimensions; front, side, rear, lakeshore, and wetland setbacks; and foundation
elevation. A foundation s�arvey must be submitted before proceeding with framing
or further construction. In lieu of a survey a letter prepared by a Minnesota
Registered Land Surveyor containing the same information as a foundation
survey may be submitted.
(3) As-built survey. An as-b�ailt survey, prepared by a Minnesota Registered Land
Surveyor, shall be subrnitted to the city for review and approval upon the
completion of all buildings and all additions to buildings, unless exempted by the
building official. The as-built survey shall certify the final topography of the site;
verify drainage patterns; and provide hardcover calculations for lots in the
Shoretand Overlay District. An as-built survey must be approved before the
issuance of a certificate� of occupancy. In the event that weather or other
conditions prevent the co�mpletion of an as-built survey at the time the Certificate
of Occupancy is reque�sted, applicant shall provide a sufficient financial
guarantee and establish an escrow agreement to ensure completion of the as-
built survey.
