NOTICE OF VIOLATION OF ZONING CODE

Before a building perinit can be issued it is reviewed for compliance with the zoning code. In
doing this review for your children's playhouse I noticed you have placed fill in the wetland in
the southeast corner of your lot and have obliterated it. This is violation of city, state and federal
regulations. You were provided notice of the presence of this wetland and another one in the
southeast corner of your property by a covenant that is recorded a�ainst your property. A copy
of this document is enclosed as well as a copy of the city's wetland regulations.
This letter will serve as your notice that in order to avoid legal action by the City you must
do the following within 30 days of your receipt of this letter:
1. Remove all fill material placed within the easement area and replace any wetland soils
you may have removed. Enclosed is a copy a portion of the building permit survey of
your property. I have drawn the wetland easements in.
2. Restore wetland vegetation. This may be done by seeding the area with a MnDOT seed
mix appropriate to a wetland and/or by planting the area with appropriate wetland plants.
The plan should be approved by the Minnehaha Creek Watershed District, including any
trees you wish to keep in the area. (The Watershed District administers the state
regulations.)
After looking at aerial photographs taken a few years ago I can guess why you filled and
landscaped this area. Be assured that it is possible to have a wetland and an attractive yard. If
