Because your 35' X 65' court is more than 1000 square feet the Orono Zoning Code Sections 10.03, Subdivision 14 (C) and Subdivision 14 (D) require that it be located 30' from a side property line. Yours appears to be about 7' or 8'. If you or your contractor had applied for the required permit prior to beginning work you would have known about these requirements in advance. When your contractor started work even though there was no permit posted he left you in a difficult position You also hired a landscape contractor to build a fenced in garden. This garden does not require a permit, but it does need to be: 1. On your property 2. No more than 6' high within 30' of the property line 3. No fill or retaining wall may be within 5' of the property line Section 12.02 of the Orono Zoning Code says: "The owner and/or occupant of any property, upon which any work has been done in violation of any Building Code or zoning requirement shall be responsible for obtaining a permit, and/or for correcting, removing or abating such violation within thirty days after notice from the City that such violation exists." Therefore, if you and your contractors have not corrected these violations by July 21, 2003, the City may initiate legal action. If you have any questions or require further explanation please feel free to contact either me or the zoning department at City Hall. a. Building and Zoning Inspector Telephone(952)249-4600 • Fax(952)249-4616 www.ci.orono.mn.us // O ,;0 O ,,,, CITY of ORONO ,,,,3 , I I \.v',, ,` "U- 'ir' ti Municipal Offices '/ " ,, G; , _ . Street Address: Mailing Address: `$'EggO.,"' 2750 Kelley Parkway P.O. Please submit a survey showing the location of the proposed sport court drawn to scale. If the location is approved the permit can be issued. The City requires an inspection prior to pounng the concrete. If you can show the inspector that the project meets setbacks to the lot lines, then you can proceed. If not, you may be required to have your surveyor stake the location. If you have any questions please feel free to contact me at my office.
