A RESOLUTION GRANTING VARIANCES
TO 1�IU1V'ICIPAL ZONING CODE
SECTION 10.23 SUBDIVISION 6B
FILE NO. 03-2912
`VHEREAS, Marvin Smith & Mary Smith, husband and�vife, (hereinafter
"the applicants") are the owners of the property located at 1940 Country Club Road
within the City of Orono (hereinafter the "City") and legally described as follows:
Lot 6, Block 2, Long Lake Country Club Addition, Hennepin County, Minnesota
(hereinafter the "property"); and
WHEREAS, the applicants have made application to the City of Orono
for a �-ariance to Orono Municipal Zoning Code Section 10.23, Subdivision 5B to allow
the consiruct:on of additions/revisions to the existing home requiring a side setbac.k of
18.8' «-here a side setback of 30' is normally required, and a front setback of 36.8' at the
house and 39' at the garage where a 50' se.'�ack is normaliy required.
NOtiV, THEREFORE BE IT RESOL�'ED by the City Council of
Orono, �innesota:
FIi�1DINGS
1. This application was reviewed as Zoning File�03-2912.
2. The property is located in the LR-lA Zoning District, which requires a 30
foot side yard setback and a 50 foot front yard setback.
3. The Plannin� Commission reviewed this application at a public hearing
held on July 21, 2003 and recommended approval of the side and front
yard set'oack variances based on the follo�ving findin�s:
a. The existing resi�ence was buiit in 196�, prior to City adoption of the
cunent LR-lA zonin�district minimum lot requirements.
'o. The hardship is the existing house location in relation to the fror�t and
side property lines.

c. Lot coverage by structures will be 7.1%, well below the 15% limit.
4. The City Council has considered this application including the findings
and recommendation of the Planning Commission, reports by City staff,
comments by the applicants and the public, and the effect of the proposed
variance on the health, safety and welfare of the community.
�. The City Council finds that the conditions eYisting on this property are
peculiar to it and do not apply generally to other property in this zoning -
district; that grantinD the variance would not adversely affect traffic
conditions, light, air nor pose a fire hazard or other danger to neighboring
property; would not merely serve as a convenience to the applicant, but is
necessary to alleviate a demonstrable hardship or difficulty; is necessary to
preserve a substantial property right of the applicants; and would be in
keeping with the spirit and intent of the Zoning Code and Comprehensive
Plan of tne City.
CONCLUSIO�'S, ORDER AND CONDITIONS
Based upon one or more of the above findings, the Orono City Council herebv
grants a variance to Orono Municipal Zoning Code Section 10.23, Subdivision 6B to
allow the construction of additions/remodel to the eYisting home requir.ng a side setback
of 18.8' where a side setback of 30' is normally required, and a front setback of 36.8' at
the house and 39' at the garage where a 50' setback is normally required, subject to the
following conditions:
1. Council approval is based on the site plan submitted by the applicants and
annotated by City staff, attached to this Resolution as Exhibit A. Any
amendments to the site plan which are not in conformity w�ith City codes will
require further Plannin� Commission and City Council revie�v.
2. Authorities granted by this resolution run �vith the property not with the
applicants, but are permissive only and must be exercised by obtaining a building
permit for the ne�v construction ��zthin one year of the date of Council approval,
or the variance will eYpire on that date (July 28, 2004).

3. Violation of or non-compliance with any of the terms and conditions of this
resolution shall constitute a violation of the zoning code, shall automatically
terminate any authority granted herein, and shall be punishable as a misdemeanor.
4. The undersigned applicants have read, understood and hereby agree to the terms
of this resolution and on behalf of the applicants and the applicant's heirs,
successors and assigns, hereby agree to the recording of this resolution in the
chain of title of the propert�.
Adopted by the Orono City Council on the 28`h day of July, 2003.
