WHERBAS, the City of Orono is a municipal corporation organized
and existing under the laws of the State of Minnesota; and
WH$REAS, the City Council has considered the application of Carl
Wicks, Ward P. Ferrell and Gordon Coffin that would ask the City to approve
procedures for correcting irregularities in the abstract titles of their
properties and faulty legal descriptions of the subject properties as set
forth in the metes and bounds descriptions by Mark S. Gronberg dated
September 17, 1987 and attached to this resolution together with a
descriptive survey sketch designating these disputed boundary areas; and
WHEREAS, these faulty legal descriptions resulted from an
additional 19 feet of Yineal length existing within the half section that
! was not considered at the time Auditor's Subdivision No. 230 created these
1- parcels; and
WHEREAS, the applicants have executed quit claim deeds involving
these disputed boundary areas that would relinquish al 1 interests in the
property and have directed their surveyor to create corrective legal
descriptions to be filed with the Hennepin County Recorder's Office; and
WHER�AS, this application does not attempt to create new parcels
nor does it involve the rearrangement of mutual lot lines but serves merely
to correct descriptions for existing properties.
NOW, THEREFOR$, BE IT RESOLVED, that the City Council of the City
of Orono hereby approves the application of Carl Wicks, Ward P. Ferrell and
Gordon Coffin subject to the condition that the attached certified
corrective legal descriptions be filed by the City of Orono with the
Hennepin County Recorder's Office and the Hennepin County Tax Office.
Adopted by the City Council of the City of Orono on this 28th day
of September, 1987.
