WH$R$AS, John A. Downey, an authorized representative of the
Wayzata Country Club (hereinafter "the applicant") has an interest in the
property located at 200 West Wayzata Boulevard within the City of Orono
(hereinafter "City") and legally described in Exhibit A attached to this
resolution (hereinafter "the property"); and
WH$REAS, the applicant has applied to the City of Orono for
� Conditional Use Pe�mits to permit the construction of a lounge addition off
the main dining room of the club house at the northwest corner per
Municipal Zoning Code Section 10.28, Subdivision 3 and per Section 10.03,
� Subdivisions 19 and 20 seeks an additional conditional use permit to permit
_ the removal of appoximately 9,600 cubic yards of fill from the greens area
adjacent to the northwest side of the club house.
NOW, TH$REFOR$, BE IT R$SOLVED by the , City Council of Orono,
Minnesota:
FINDINGS
1. This application was reviewed as Zoning File #1190.
2. The property is located in the RR-1B Single Family Rural
Residential Zoning District.
3. On September 8, 1987, the Orono Planning Commission reviewed the
application as proposed and recommended approval, finding that:
A) The proposed addition will satisfy the required 100 feet
setback for the club house structure.
B) The proposed addition and land alterations W�1i have no
negative impact on surrounding properties. •
C) The proposed land alteration will not alter drainage but
improve the treatment and retention of run-off because of the
• more graduated sloped landscape.
4. The City Council has considered this application including the
findings and recommendations of the Planning Commission, reports by
staff and comments of the applicant and the effect of the proposed use
. on the health, safety and welfare of the community.

5. The City Counci 1 f inds that granting Conditiona 1 Use Permits to
allow the construction of the addition and the removal of 9,600 cubic
yards of fill, and the regrading of the disturbed area as proposed in
the grading and drainage plan dated revised 9-10-87 will not be
detrimenta 1 to the hea 1 th, saf ety or genera 1 we 1 f are of the pub 1 i c,
would not adversely affect light, air nor pose a fire hazard or other
danger to neighboring properties, nor will it depreciate surrounding
property values and that the proposed level of use of the property
will be in keeping with the intent and objectives of the Zoning Code
and Comprehensive Plan of the City.
CONCI�DSIONS, ORDER AND CONDITIONS
Based upon one or more of the above findings, the Orono City
� Council hereby grants Conditional Use Permits per Municipal Zoning Code
Section 10.28, Subdivision 3 and Section 10.03, Subdivision 19 and 20,
subject to the fol,lowing conditions:
� 1. The applicant must process all appropriate permits with the City
_ of Wayzata prior to f i 11 ing.
� 2. Berms along the sides of the disturbed area shal 1 be constructed
at 3:1 slope ratio in order to achieve the desired level of safety for
users of adjacent greens.
3. Violation of or non-cbmpliance with any of the terms and condi-
tions of this resolution shall constitute a violation of the zoning
code, shall automatically terminate any authority granted herein, and
shal 1 be punishable as a misdemeanor.
4. The undersigned applicant has read, understood and hereby agrees
� to the terms of this resolution and on behalf of himself, his heirs,
successors and assigns, liereby agrees to the recording of this
resolution in the chain of title of the property.
