A RESOLQTION 1�PPROVING THE PLAT OF
LIB$RTY ACRES SECOND 1�DDITION

WH$REAS, the City of Orono is a municipal corporation organized .
and existing under the laws of the State of Minnesota; and
WH$REAS, the City Council of the City of Orono has adopted
subdivision regulations for the orderly, economic and safe development of
land within the City; and
WHBR$AS, the City Council has considered the application for a
subdivision by James and Mary Ann McGown,the subdividers; and
WH$REAS, concurrent with approval of this plat, the City hereby
grants the fol lowing variance:
1 ) A variance to Section 10.02 of the Municipal Zoning Code to allow
creation of a lot with no frontage on a public roadway.
• 2) Variances to Section 10.28 Subdivision 5 (B) for Lot 1, Block 1
which has a defined width at the rear line of the front yard of 103'
where a 200' width is required.
WHEREAS, the subdivision has been found to meet all other
standards of the RR-1B zoning district finding that each lot is of a size
and configuration that will allow its use as a single °family residence to
be fully developed without the need of any further variances, and
WHER�AS, the subdivider has completed all requirements of the
platting regulations of the City, including:
l. Completion of all the requirements of Resolution No. 2145.
2. Dedication to the City of a Drainage Easement providing for
limitations on the use of drainageways described therein and shown on
the plat as "drainage easement".
3. Payment to the City of a Park Dedication Fee in the amount of
$200. 00. ?
4. Payment to the City for the legal review and filing of the plat
easements and covenants in the amount of $150.00.
NOW, TH$REFOR$ B$ IT R$SOLVED, that the City Counci 1 of the City
• of Orono hereby approves the plat of Liberty Acres Second Addition,
Hennepin County, Minnesota; subject to the following conditions:

l. Both � lots shall access to the private Jamestown Road, and shall
share in the upkeep and maintenance of said private road. The
developer shall submit verification that the appropriate private
access documents have been executed.
2. The driveway access located for Lot 2, Block 1 shall be reviewed
by City staff at the time a building permit is issued.
3. Applicants are advised that Lot 1 at 3.16 acres is allowed to keep
no more than one horse on the premises per Section 10.20, Subdivision
3 (M) .
4. The aforesaid plat shall be filed by the City of Orono with the .
Hennepin County Recorder's Office on or before December 22, 1987
together with a certified original copy of this Resolution and
• executed copies of the documents noted above.
The approval granted by this Resolution shall expire if the plat
has not been filed by the date specified above. In that event, it will be
necessary to file a new application with the City of Orono for subdivision
review.
