Re: Building Permit Application, Twidwell, 1865 Concordia Street
Dear Mr. Bren:
The City of Orono is in receipt of your application for a building permit for construction of a new
residence at the above referenced address. Review ofthe submitted survey/grading plan by Gronberg
&Associates dated 8/13/02 indicates approximately 4 feet of fill is proposed above the base of the
mature maple tree between the garage and the front entry. This fill will undoubtedly have a negative
impact on the continued vitality of that tree,and would appear to be in direct conflict with Condition
No. 3 of variance approval Resolution No. 4792, which reads as follows:
"3. Applicants and their agents shall take all feasible and reasonable steps to ensure the
continued viability of the 3 mature maple trees identified as contributing to the
hardship situation on the property. If one or more of said trees dies or is removed
within the first 5 years after redevelopment of the site commences,said trees shall be
replaced immediately with the most substantial trees of like character that can feasibly
be transplanted in the approximate same locations as the trees lost."
Filling around the base of this tree as proposed would also appear to be in conflict with the
recommendations of the Twidwell's forester, Steven J. Cook,per his letter of March 2, 2002 (copy
attached).
It is our conclusion that the proposed grading plan is unacceptable as presented, hence a building
permit cannot be issued until this matter is resolved. In order for the City to issue the building
permit, you must provide the following:
1. A revised grading plan.
2. A written plan and diagram indicating exactly how the three maples will be protected during
the demolition/construction process.
3. Written confirmation from the Twidwell's forester that the revised grading plan and tree
protection plan will,if followed,provide a reasonable expectation that the trees will survive.
