HomeMy WebLinkAbout#4906-CUP-2002 . � . , � O� O O ���_� ::� - ciTY o� o�oNo �� � �;�� ti � � � :��� � �� ,� ���,.�G RESOLUTION OF THE CITY`COUNCIL `qkESH04" N0. 4 � � �"� A RESOLUTION GRANTING A CONDITIOfiAL USE PERMIT PER MUNICIPAL ZONING CODE SECTIOIV' 10.75, SUBDIVISION 1, FILE NO. 02-2847 WHEREAS, James Nystrom, (hereinafter "the applicant") is owner of the property located at 1725 Concordia Street(herein�fter"the property")within the City of Orono (hereinafter "the.City") and legally described as follows: Lots 13 and 14, Coffee's Addition to Shadywood, Hennepin County, l�Zinnesota, (hereinafter "the property"); and `V�-IEREAS, the applicant has applied to the City of Orono for a conditional use permit per Municipal Zoning Code Section 10.7�, Subdivision 1 to permit a cupola to be constructed on the roof of a residence to be 34.5' where 30' height is the maximum for the LR-1C zoning district. WHEREAS, after due published notice and mailed notice in accordance with l�iinnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning Commission held a public hearing on November 18, 2002, at which time all persons desiring to be r.eard concerning this application were given the opportunity to speak thereon. I�'OW, THEREFORE, BE IT RESOLVED by the City Council of Orono, Minnesota: ' FIl�'DINGS ' :��. � -- 1. This applica�ion ���as revie��-ed as Zonina File #02-2847. 2. The property is located in the LR-1 C Zonin�District,One Family Residential Zoning District. 3. The Orono Planning Commission revie�ved this application on November 18,2002 and recommended approval of the proposed conditional use permit by a 6 to 0 vote. 4. The cupola is decorative, does not increase living space. B. The cupola is in character�vith the neighborhood. C. Hardcover and lot coverage by structures does not increase �vith the cupola. D. There is no access from the residence to the cupola. E. The residence meets all hardcover, setbacks, height, and lot coverage by structures requirements. � 5. The City Council finds that granting a conditional use permit will not be detrimental to the health, safety or general welfare of the public, will not adversely affect light, air nor pose a fire hazard or other danger to neighboring properties,nor will its use depreciate surroundina property values and that the proposed level of use of the property will be in keeping�vith the intent and objectives of the Zonin� Code and Comprehensive Plan of the City. 6. The City Council has considered this application including the findings and recommendations of the Plannina Commission, reports by staff and comments of the applicants and the affect of the proposed use on the health, safety, and welfare of the community. CONCLUSIONS, ORDER,AND CONDITIONS Based upon one or more of the above findings, the Orono City Council hereby grants a conditional .�.ise permit per Municipal Zoning Code Section 10.75, Subdivision 1-.tQ permit construction of a cupola on the roof of a residence to be 34.�' where 30' height is the max-�mum for the LR-1C zoning district, subject to the following conditions: 1. Council approval is based on the site plan submitted by the applicant attached to this resolution as Exhibit A. Any amendments to the site plan may require further Plannin� Commission and City Council review. 2. Authorities granted by this variance run�vith the property not���th the applicant,but are permissive only and must be exercised by application for a buildino permit within one year of the date of Council approval, or these variances w111 eYpire on that date (December 9, 2003). Violation of or non-compliance with any of the terms and conditions of this resolution shall constitute a violation of the zoning code, shall automatically terminate any authority granted herein, and shall be punishable as a misdemeanor. 4. The undersigned o�vner and applicant have read,understood and hereby aaree to the terms of this resolution and on behalf of themselves, their heirs, successors and assigns, hereby agree to the recording of this resolution in the Chain of Title of the _ property.
