These new plans propose certain features which would be unapproved encroachments of the Common Area, and these must be resolved before permits can be issued. Given that this is the third attempt at an approvable design for this site, at this point I think it is necessary to recap where we have been with this site, where we are today, and what needs to change in arder to allow issuance of building permits. Original Approvals 1. Per Section 5.10 of the Stonebay Community Master Declaration regarding Encroachments, certain encroachments of the Common Area are allowed "due to minor inaccuracies in survey, construction, reconstruction, settlement, movement or otherwise." Such an easement does not appear to allow an intentional encroachment that is outside the scope of a "minor inaccuracy" or outside the scope of one of the listed allowable encroachments. Those listed encroachments include: - Roof overhangs that extend no more than 36" beyond the boundary of the Unit (i.e. 36"past the lot line); � . - Box windows or cantilevered sections not more than 18" beyond the lot line. - Cantilevered deck overhangs not more than 30" beyond the lot line. a 2. The wetland setback encroachments approved for this site by the City were for a �a structure on Lot 1 that was no closer than 5' to the wetland"finger", which allowed for a structure up to 80' in total length and still being within the 41' x 86.5' lot boundaries. For Lot 2, which is offset 30' from Lot 1, buffer encroachments were approved that would allow for a structure 90' in total length, generally within the easterly 90' of the 97' x 40' lot boundaries. In both lots,the 7j� ° approved footprint and approved encroachments did not allow for a house extending the full length of the lot. In Lot 2, however,the encroachment only encompasses the southwesterly 10', so conceivably some portion of the house not affected by either the City's 26' setback requirements not the Watershed's 35' 7i�� buffer requirements could make use of the full 97' length of the lot. 3. We believed that the Watershed District approved a buffer plan that did not follow the strict 35' setback from the wetland"finger"but drew a straight line 50' in width that would allow the originally proposed homes to be constructed, but �� � similar to the City's approval, did not allow for complete use of the entire length of the lots. In both Lots 1 and 2,the southwesterly corners of the actual lots are within the 35' buffer and can't be built on. To confuse the issue, I have now obtained the official attachment to the MCWD buffer agreement that establishes where buffers are required. This is Landform Sheet C3.9 dated February 7, 2003 which James Wisker of MCWD emailed to `l��p � me at my request on February 7, 2008, coincidently. The City previously had never been provided with a copy of this sheet as approved by MCWD. Sheet C3.9 has a huge impact on the issue of the side yard of Lot 1. Sheet C3.9 r� shows a replacement ("new") buffer to be located along the side lot line of Lot l, � � . � effectively negating the ability to expand southward from Lot 1. �G �,�' Sheet C3.9 does not match Landform Sheet C3.8, last revision date January 22, 2003, which apparently is the original wetland/buffer plan provided to the �� , MCWD. My conclusion is that Sheet C3.9 reflects the revisions to C3.8 that the MCWD ultimately required. Additionally, to add to the mix, we have been working off of Landform Sheet C2.5 dated October 28, 2005, the Buffer Monumentation Plan, which makes no �0.-' mention of, and does not depict, the additional side yard buffer that appears on . C3.9. As a result, when I discussed with you the potential for a side yard deck on February 13, I was unaware that my suggestion was in conflict with the approved MCWD buffer plan. Building Permit Review 4. On January 29, 2008 we received your first plan set for these two lots. The survey and plans indicated for Lot 1 a building of total length 86' +that �. encroached closer than 5' to the wetland and with a cantilever actually over the wetland, where both features had to be at least 5' from the wetland based on the �, I�,�. VI .+ original approvals. I emailed you about this problem on February 7 and discussed it with Jeremy at City Hall on February 11. 5. On February 12 you dropped off a revised plan for Lot 1 depicting a house 80' in length with a 10' deep deck along the south side extending eastward from the west end of the house. The house was now 3' from the side lot line, so 7' of deck would be in the Commons Area. This eliminated the 5' setback encroachment, but raised further issues: a. With the revised plan there was now an encroachment of the 26' setback �' outside the boundaries of the originally approved house, as well as a corner encroachment of the MCWD 35' buffer; and b. The proposed deck now extended 7' past the lot line into the Common Area where only a 30" cantilevered encroachment was allowed. The cantilevered encroachments allowed within the covenants do not allow support posts outside the lot boundaries. On February 13 you and I discussed these issues and we concluded the solution was to move the deck further east along the south side of the house where it would not encroach the 26' setback or the 35' buffer, and that either a re-plat or a change to the covenants would be needed to allow the additional 4.5' of deck encroachment of the Common Area. I felt that this revision to the covenants (or a replat if determined necessary by the City Attorney) would not meet resistance from the City since no other properties' views would be impacted. At a staff level, we concluded we could issue a permit prior to such covenant revision or re- plat only if you provide an interim plan showing a fully conforming deck,then work thru the legal issues before the deck is actually built per the permanent plan. As noted above, at this time I had not become aware of the discrepancy between Sheet C3.9 and Sheet C2.5, or the (now apparent) issue of a required new buffer in the side yard of Lot 1. 6. On February 20 you submitted a further revised plan that moved the proposed deck further east, but now it has become a screen porch and extends 12' out from the house. The covenants do not contemplate this type of encroachment at all, and certainly not to the extent of enclosed space extending 9' into the Common P„ V--' Area. Based on this plan, there is no encroachment of the 26' wetland setback; �(/ ` but, there is clearly an encroachment of the required "new buffer" shown on C3.9; f,��t ' and the enclosed porch structure is being proposed outside the lot boundaries, far �l in excess of the cantilevered 18" bays allowed by the covenants. 7. Further, concentrating for the first time on Lot 2, the approved encroachment of the 26' setback was for a house 90' in length within the 97' lot. The area of allowed encroachment was the southwesterly corner of the house, with the home � pushed as far east as possible on the lot. Also, the 90' length just missed , encroaching on the 3 5' buffer by about 2'. � The proposed house for Lot 2 in your January 29 submittal extends to the west line of the lot, yielding a 5' triangular unapproved encroachment of the 35' buffer and a 7' rectangular unapproved encroachment of the 26' wetland setback. These encroachments must be removed in order for a building permit to be issued. If you choose to construct a home on Lot 3 that is longer than 90', I believe you will have the same issue on that lot; and the width of Lot 4 will be an issue because the 35' buffer extends 2-3' into that lot's side lot line. Conclusions 1. The MCWD approved buffer plan differs from the buffer monument plan we have been using as a guide. We will henceforth refer to the MCWD plan (Sheet C3.9 dated 2-7-03 with regards to buffers. 2. The City's approved encroachments of the 26' setback are shown on Sheet TD01002 dated 1/24/03 which is also Sheet C2.1 appearing in the Development Plan Approval resolution. The approved encroachments affect Lots 1 and 2 of Sixth Addition and the lots at 785-787 Boulder Drive. The approved encroachments are based on building footprints that are smaller than the lots, hence these lots may not be fully developable. 3. There are a number of remaining undeveloped lots with approved house footprints that are significantly smaller than the actual platted lots. Some of these platted lots have unbuildable portions due to required 26' wetland setbacks or required MCWD buffers that actually are within the platted lots. These should be identified ASAP so appropriate homes can be designed that don't encroach these setbacks or buffers. For the four lots in Stonebay Sixth Addition and for all future building permit requests, the surveys submitted must depict the edge of wetland per the record plats; the required 26' wetland setback line, and the required MCWD buffer line. These have been shown on surveys provided by Landform for individual homes to date, abd are critical to ensure an efficient review process. We need to discuss these issues as soon as possible. Mike, Steve and I have had similar cor.versations previously. The prob�em stems from the fact that the declaration used the incorrect site p1an. The site plan used in the recorded declaration shows where all the wetland buffers were required under the regulation. The site plan I have attached shows areas of proposed buffer impact and areas of buffer mitigation. It appears that buffer impacts were proposed and approved for this area. Since the buffer violations occurred last year, Steve and I had discussed the appropriate time to amend the declaration to show the "actual buffer". This should likely take place once the impacts are restored since there will be New Wetland Credits Created and additional buffer created. Specifically, the After the Fact mitigation plan proposed by Landform and approved last year by the Board has New Wetland Credit proposed within the 6th Addition just north west of lots 1 and 2.
