Item Description: Encroachment Agreement- Wooddale Builders - 2460 Cobblestone Court
The City has a drainage and utility easement over a portion of this vacant Stonebay lot to
accommodate an existing municipal water line and hydrant. The easement encumbers a triangular
portion of the property. Wooddale Builders (Stonebrook Development LLC) plan to build on the
property and have designed a house that avoids encroaching upon the easement, except for two
small roof overhangs as depicted on the attached drawings. Planning Staff, City Attorney and
Public Works Director have reviewed the proposed encroachment and have concluded it is so minor
that allowing it via an encroachment agreement would be appropriate.
COUNCIL ACTION REQUESTED
Motion to approve the attached encroachment agreement.

AGREEMENT made this ��'H day of 5v 1 y . , 2015, by and between the
CTTY OF ORONO, a Minnesota municipal corporation ("City"), and STONEBROOK
DEVELOPMENT LLC(hereinafter referred to as the"Owners").
1. BACKGROUND. Owners aze the fee owners of certain real pzoperty in the City of
Orono, County of Hennepin, and State of Minnesota legally described as:

arcording to the recorded plat thereof,Hennepin County,Mi�rnesota
and having a str�eet address of 2460 Cobblestone Court, Orono, Minnesota ("subject propert}��.
The City owns drainage and utility easements over a portion of the subject properiy. Owners want
to construct a residence structure on the subject�property which will zequire the encroachment of
two small roof overhangs into the City's drainage and utility ease�ment area on the subject property
as depicted on the attached drawi.ngs.
2. ENCROAC�NT AUTHORIZAT'ION. The City hereby approves the
encroachment within its easement area of the two noted portions of roof ovezhang.

3. HOLD NARMi,Fcs AND INDENIl�ITy, In consi.derahpn of being allowed to
encroach within the City's easement area, the Owners, their successors, heits and assigos, hereby
agree to indemnify and hold the City harmless from any damage caused to the subject property as a
resuIt of City work within the easement area.

I've reviewed this wi�h the Public Works Dirertor as well as the City Attorney. The consensus is�hat we wouid accep4
ihe establishment of an Encroachment Agreement that allows you to have the overhang as shown on your sketch,at
your{property owners) risk;i.e.that if the City has to wort:within the easement and damages the'encroaching
structure,the owner assumes all liability fo�the damage occurring within the easement. If this is acceptable,we wiil
draft such an agreement and forward it to you for review. This will require City council approval; �would not anticipate
any objections to it.

To Mike and who it may concern:
Wooddale is asking for a roof overf�ang encroachment into a utility&dralnage easement at 2464 Cobblestone Court,
Orono, MN. Lot 3 Block 16"'Addition Stonebay.
Things we have already done to avoid the easement.
1. Lot width is 40'wide,we have cut the unit width to 38'wide and we cut 2'out of the width in the Dining room.
We also cut 4'off the front porch and can't cut anymore without jeopardizing the elevation look.
2. The building is pushed all the way to the back wet land set back.
3. Our existing nefghbor to the south on lot 2 looks like there overhangs are into the easement as welf.
4. Looking at our raof plan you will see it's just the tips of the overhangs that are encroaching the easement.
